On Tuesday, November 13t", I met with Marcia Hefter, the attorney representing
Edward and Daniel Latham owners of the property in question. Her clients are under
contract to sell two lots, but there needs to be a subdivision that takes place prior to the
sale. I discussed with her the requirements for an application. It was suggested that the
prior application, that was submitted to the Planning Board office by her clients in 1994,
was no longer applicable because that application was for a set-off. Her clients currently
are asking for a minor subdivision for the creation of at least three lots.
At this meeting, I gave Ms. Heifer a copy of the major and minor subdivision
applications forms along with the applicable fee schedule. I indicated that in addition to
a new application and new fee (whether a major or a minor) the following items would
be needed as part of the application:
Her clients would have to submit proof of a right of access over the adjoining
Tuthill property. Also, a variance or 280A application would be needed from the
Zoning Board of Appeals for permission to have alternate access for two
proposed land-locked parcels.

2. The Trustees may require a variance for the proposed construction of a right-of-
way or driveway within 100' of irrigation pond and any wetlands associated with
that irrigation pond.
In addition, Ms. Heifer was advised to speak with Doug Feldman of the Suffolk County
Department of Health Services to find out what the County's requirements would be
(whether for a major or a minor) in order to obtain subdivision approval. Finally, the
proposed subdivision map would have to show a building envelope for each of the two
lots. The envelope should be set back at least 100' from any and all wetlands on the
property. Ms. Heifer indicated that she would speak with her clients and make a
decision about how to proceed.
