No. 10-0278) - Installation of 500 gallon generic tank for marina use. - SCTM: 1000 02700 0200 004000 Hearing Date: February 17, 2005 Statement of Problem Article 7, §760-706 B.2 of the Suffolk County Sanitary Code restricts the storage of restricted toxic or hazardous materials to no more than 250 gallons in water supply sensitive areas. The applicant is requesting a variance to store more than the 250-gallon limit. Findings and Facts 1. Applicant operates an existing marina and requires on-site storage of gasoline for marina operations. Applicant requires the fuel to fill the tank on a tow boat (200 gallons) and to operate equipment used in the operation of a marina, such as tractors, tow vehicles and mowers. 3. No retail sales of gasoline are planned. 4. The water supply for the site is private on-site drinking water well. 5. There are no public water well fields within ½ mile of the site. The applicant presently purchases gasoline in small 5-gallon quantities fi.om a gasoline station approximately 1 mile fi.om the marina. During periods of high use in the summer, several daily trips are made to the station. The applicant is requesting to install a 500-gallon Hoover Lubecube® tank for gasoline storage. This is a generic, industry standard, pre-approved tank that includes additional spill protection in that a concrete vault is also provided. The tank design complies with the requirements of Article 12 of the Sanitary Code. This tank is the smallest available of its type. Although smaller tanks of a different type are available, they do not have the additional spill protection of the concrete vault. Brian L. No. 10-0278) - Installation of 500 gallon generic tank for marina use. - SCTM: 1000 02700 0200 004000 Determination It was a 3 to 0 determination of the Board of Review to grant the variance to install a 500-gallon gasoline tank at the marina provided that the tank is installed at least 150 feet from the on-site drinking water wel!. The applicant is requesting to install the smallest tank available that is designed with an integral concrete vault. Any increased pollution potential caused by placing a tank in this area is slight and is mitigated by the fact that the installation will comply with all Article 12 requirements. Additionally, the potential for pollution caused by accident or spillage from frequent deliveries of small amounts of gasoline is reduced. As per §760-609 of the Suffolk County Sanitary Code (Sanitary Code), the approval of the variance is in harmony with the general purpose and intent of the Sanitary Code to protect grotmdwater and drinking water supplies, surface water and other natural resources, and public health, safety and welfare. ~(~--'~-~ ~,~. Box 672 Greenport, NY 11944 Re: F-89-516 U.S. Army Corps of Engineers/New York District Permit Application - Narrow River Marina Town of Southold Request for Additional Information Dear Mr. Wiggin: Pursuant to 15 CFR 930.58, the following data and information is necessary to enable the Department of State to adequately assess the coastal zone effects of this proposed project. 1) Please indicate the number, sizes, and drafts of the crafts presently using this marina. Are they power boats or sail boats? 2) Please indicate on a plan where previous dredging was done, both inside and outside of the marina basin. It would be helpful if you can indicate the dates and the agency responsible for the previous dredging. 3) Is the siltation of the marina basin and adjacent areas coming mainly from the drain pipe, the town ramp or agricultural runoff? If it is the former two, what steps are being taken to reduce the adverse surface water quality impacts from these point sources. 4) Please provide a diagram of the shellfish concentration in the immediate vicinity of the area to be dredged, especially in the waters certified for shellfishing. Perhaps a survey will be necessary to determine this and also the grain size distribution. 5) Please explore the possibility of reducing the amount of dredging by eliminating all dredging in the channel where the soundings indicate depths of greater than -4' MLW. See attached map for guidance. Mr. Merlon Wiggin March 28, 1990 Page 2 6) A distribution of sediment type map (sand, silt, etc.) and a grain size analysis map would also be needed to assess the impacts of the dredging in this significant habitat area that is open to shellfishing. 7) It is also be necessary to indicate that no further expansion of the marina is anticipated in the near future without the requisite regulatory approvals. Please provide the information requasted above to the Department of State within thirty days from the date of this letter. Pursuant to 15 CFR 930.64(d), if this necessary data and information is not provided, the Department of State may object to your consistency certification on the grounds of insufficient information. Any additional information which you believe will facilitate our consistency review of this project would be appreciated. A copy of this letter has been sent to the U.S. Army Corps of Engineers.
