Dear Mr. Terry:
You will recall that we discussed this matter at your office on 12/3/03.
Frank Cichanowicz of Briarcliff Sod, Inc., wishes to subdivide the referenced property as shown
in the attached map prepared by John Ehlers LS, and last dated 7/30/01.
The development rights applying to Lot #3 were granted to Suffolk County by deed dated August
9, 1994. Lot #1 and Lot #2 are intended to be building lots, each of 74,336 square feet Lot #4, as
I described to you during our conversation, exists as a result of the action of the then-surveyor,
Rodefick Van Tuyl, in responding to the County's desire to not have the structures existing on
Lot//4 included in the transfer of development rights. It is my understanding that the boundaries
of Lot #3 cannot be changed, and the property to the west of Lot #4 is owned by others, so we are
left with an anomalous Lot #4.
On 6/27/01 application was made to the ZBA for approval of the undersized lots. The application
went to public hearing on 9/20/01. The ZBA did not act on the application, saying that they
"wanted to hear what the Planning Board had to say." A copy of part of an exchange of e-mails
between Ms. Kowalski and Ms. Scopaz is attached for your information.
You indicated that there was a possibility that the Planning Board might consider a cluster
subdivision of the property which could include the lots as shown on the map. I would appreciate
it if you arrange to present this information to the Board to determine if that is the case. If you
need anything else from me at this point, please let me know.

I left word that you should talk with Melissa on this.....Suffolk County bought development dghts to bulk of this
property, but Bdarcliff never file subdivision papem......I donl know if intent was to keep house with farm, in which
case, maybe area vadance for subdivision should NOT be granted. Lot looks terribly undersized. PB has advocated
for a long time that if property owner intends to sell off house at some point that the lot should be at least one acre in
size to permit expansion of house under Health regulations.....However, the county has gone off and done its own
thing sometimes....you need to talk to MeL
One last suggestion, I know yo~ are swamped. We are also and we are short of staff. Craig has not been replaced.
Bob is going on jury duty and then will be on vacation for a month. I cannot turn around on information requests
overnight anymore......so I am juggling three jobs at once. You will have to give me at least a week's advance notice
if you need information for a specific meeting date.
