THIS INDENTURE, made the 7t~"day of ~'~6,/ ,two thousand and nine,
between JOHN ANTONIOU and AGATHI ANTONIOU, his wife, both residing at 22-15 26th
Street, Astoria, New York 11105 party of the first part, and
ANTONIOS ANTONIOU, AS TO A FORTY (40%) PERCENT INTEREST, LEONIDAS
ANTONIOU, AS TO A TH1RTY (30%) PERCENT INTEREST, and NIKOLAOS ANTONIOU AS TO
A THIRTY (30%) PERCENT INTEREST, as tenants in common, residing at 22-15 26th Street, Astoria,
New York 11105, party of the second part,
WITNESSETH, that the party of the first part, in consideration of ten dollars, lawful money of the United
States, paid by the party of the second part, does hereby grant and release unto the party of the second part,
the heirs or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate,
lying and being in Mattituck, Town Of Southold, County of Suffolk, and State of New York, desibmated as
lot # 111 on a certain map entitled "Map of Captain Kidd Estates", filed in the Suffolk County Clerk's
Office on January 19, 1949 as Map No. 1672.
PREMISES BEING KNOWN AS: RFD Inlet Drive, Lot 111, Mattituck, New York, a/k/a 155 East Road.
District 1000, Section 106, Block 3, Lot 9
Being the same premises described in the Deed to the party of the first part herein by Deed dated July 29,
1982, recorded on August 5, 1982 in Reel 9222 Page 345.
Reserving, however, to the parties of the In'st part the exclusive occupancy, possession and the use and
enjoyment of the above described premises during the natural lifetime of the parties of the first part, with
the party of thc first part to pay for all the expenses relating to the premises and is intended to reserve to the
Grantors a life estate. Parties of the la'st part each reserve the power to appoint the remainder and/or parties
of the first parts' life use in the premises to any one or mom of the children of the parties of the first part.
The power shall be exercisable or may be relinquished during parties of the first parts' lifetime by a deed to
the parties of the second part herein or to others who are members of the class of appointees set forth
herein, making express reference to this power and executed and recorded in the Cg. unty Clerk's Office
where this deed is recorded, prior to parties of the first parts' death. This power shall not be exercisable by
a Will. No exercise of this power shall be deemed to release party of the first parts' life estate unless such a
release is explicitly made in a deed. The exercise of this power shall not exhaust it, and unless the power is
specifically released in such a deed, the deed recorded last shall control as to any ambiguities or
inconsistencies.
TOGETHER with all right, title and interest, if any, of the party of the fn-st part in and to any streets and
roads abutting the above described premises to the center lines thereof, TOGETHER with the
appurtenances and all the estate and rights of the party of the first part in and to said premises, TO HA VE
AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and
assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the f-n-st part, in compliance with Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for the purpose of paying the costs of the improvement and
will apply the same fLrst to the payment of the cost of the improvement before using any part of the total of
the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
