BETWEEN
STAR CONSTANTINE, residing at 600 Sound Beach Drive, Mattituck, New York 11952, party of the
first part, and
HARRY CONSTANTINE, residing at 3532 Neville Way, Nazareth, PA 18064, and ,
TYRONE CONSTANTINE, residing at 26 Brunswick Ave., Williston Park, NY 11596, as tenants in
common, party of the second part, and
WITNESSETH, that the party of the first part, in consid6ration of Ten and 00/100--($10.O0)--dollars, and other
good and valuable consideration paid by the party of the second part, does hereby grant and release unto the
party of the second part, the heirs or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected,
situate, lying and being at Mattituck, in the Town of Southold, County of Suffolk and State of New
York, known and designated as Lots 53 and 54 and the easterly one-half of Lot 52 in Block 2 on a
certain map entitled "Map of Captain Kidd Estates at Mattituck Inlet, Town of Southold,.Suffolk
County, New York, owned and developed by Dawn Estates, Inc., Smithtown, L.I. New York" and
filed in the Office of the Clerk of the County of Suffolk on January 19, 1949, as Map No. 1672, said
lots and part of lot when taken together, being more particularly bounded and described as follows:
BEGINNING at a monument on the northwesterly side of Sound Beach Drive, distant 315.33 feet
southwesterly from the extreme southerly end of a curve connecting the southwesterly side of Inlet
Drive with the northwesterly side of Sound Beach Drive;
RUNNING THENCE South 52 degrees 00 minutes West along the northwesterly side of Sound
Beach Drive 125 feet to a monument;
THENCE North 38 degrees 00 minutes West and through a monument 262 feet to the high-water
mark of Long Island Sound as of September 1959;
THENCE along said high-water mark of Long Island Sound as of September 1959 along a tie line of
North 48 degrees 30 minutes East 125.23 feet;
THENCE South 38 degrees 00 rfiinutes East and through a monument 269.65 feet to the
northwesterly side of Sound Beach Drive, to the point or place of BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by deed
dated 10/10/2000, recorded 11/9/2000 in the office of the Suffolk County Clerk in Liber 12083 page
622.
Reserving to the Party of the First Part a life estate in the premises. ~J~)]
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads
abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all
the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the
premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of
the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the
first part will receive the consideration for this conveyance and will hold the right to receive such consideration
as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same
first to the payment of the cost of the improvement before using any part of the total of the same for any other
purpose. The word "party" shall be construed as if it read "part es" when ever the sense of th s indenture so
requires.
