THIS INDENTURE, made the 22"a day of April, Two Thousand Nine
BETWEEN
ANITA B. MORAN, residing at 105 Smith Road, Peconic, New York 11958, and
DOUGLAS A. MORAN, residing at 235 Smith Road, Peconic, New York 11958,
party of the first part, and
CAROLE J. ACKERMAN, residing at 14 Soundview Farm Road, Weston, Connecticut

party of the second part,
WITNESSETH, that the party of the first part, in consideration of Ten Dollars and other
valuable consideration paid by the party of the second part, does hereby grant and release'
unto the party of the second part, the heirs or successors and assigns of the party of th~
second part forever, their 99.5% interest in and to
ALL THAT CERTAIN plot, piece or parcel of land, with the buildings thereon erected,
situate, lying and being at Peconic, Town of Southold, County of Suffolk, and State of
New York, known and designated as all of Lot No. 2 and the northerly part of Lot No. 4
on a certain map entitled "Map of Indian Neck Park" and filed in the Office of the Clerk
of Suffolk County on May 27, 1913 as Map No. 551, and being bounded and described as
follows:
BEGINNING at a point on the easterly side of a private road called Smiths Lane and the
southerly side of Indian Neck Road;
RUNNING THENCE along the southerly side of Indian Neck Road, North 78 degrees 44
minutes 00 seconds East, 96.92 feet to the easterly line of said Lot No. 2;
RUNNING THENCE along the easterly side of Lot Nos. 2 and 4, South 11 degrees 11
minutes 00 seconds East, 154.69 feet to other land of the party of the first part;
RUNNING THENCE along said other land through Lot No. 4, South 81 degrees 26
minutes 30 seconds West, 103.90 feet to the easterly line of Smiths Lane;
RUNNING THENCE along said line, North 8 degrees 33 minutes 30 seconds West,
149.97 feet to the point or place of BEGINNING.
TOGETHER with a right of way over said private road called Smiths Lane, in common
with others, running from Indian Neck Road to high water mark of Little Peconic Bay.
BEING AND INTENDED TO BE the same premises conveyed to Anita B. Moran by
deed dated November 26, 1990, and recorded December 4, 1990 in the Office of the
Suffolk County Clerk in Liber 11183, Page 277, and to Douglas A. Moran by deed dated
July 29, 1991 and recorded September 16, 1991 in the Office of the Suffolk County Clerk
in Liber 11334, Page 371.
RESERVING, HOWEVER, a legal life estate in the above-described premises with the .,~.
buildings and improvements thereon erected, in and to Anita B. Moran, as to her 99%
interest.
AS TO HER 99% INTEREST, ANITA B. MORAN HEREBY RESERVES A SPECIAL
POWER OF APPOINTMENT, exercisable as often as they may choose, to change their
remainderman as follows:
TO or among any one or more members of a class consisting of the party of the first
part's descendants, in any degree, whether presently living or born hereafter, in such
proportions and amounts, without regard to equality, outright or in trust, as the party of
the first part may direct and appoint during her lifetime by properly written and
acknowledged instrument, and recorded prior to death, making specific reference to this
power of appointment. The party of the first part may not appoint themselves, their
estate, their creditors or the'creditors of their estate, under any circumstances.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to
any streets and roads abutting the above described premises to the center lines thereof;
TOGETHER with the appurtenances and all the estate and rights of the party of the first
part in and to said premises; TO HAVE AND TO HOLD the premises herein granted
unto the party of the second part, the heirs or successors and assigns of the party of the
second part forever.
AND the party of the first part covenants that the party of the first part has not done or
suffered anything whereby the said premises have been encumbered in any way
whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants
that the party of the first part will receive the consideration for this conveyance and will
hold the right to receive such consideration as a trust fund to be applied first for the
purpose of paying the cost of the improvement and will apply the same first to the
payment of the cost of the improvement before using any part of the total of the same for
any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this
indenture so requires.
