BEING AND INTENDED TO BE an undivided one-twelfth interest in the same premises in which respective
undivided one-fourth interests were conveyed to the party of the first part, the party of the second part and two
other parties by deed, dated November 10, 2003 and recorded in the Office of the Suffolk County Clerk on
December 1,2005 in Liber 12423 page 059, the undivided one-twelfth interest conveyed hereby constituting one-
third of said undivided one-fourth interest so acquired by the party Df the first part by such deed.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads
abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all
the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises
herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second
part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby
the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first
part will receive the consideration for this conveyance and will hold the dght to receive such consideration as a
trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first
to the payment of the cost of the improvement before using any part of the total of the same for any other
purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.

ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon
erected, situate, lying and being in the Town of Southold, Suffolk County, State of New
York, being bounded and described as follows:
BEGINNING at a stone monument set on the northwesterly side of a road forty feet wide,
said monument being 3994.44 feet West of a point which is 634.06 feet South of another
monument marking the U.S. Coast and Geodetic Survey Triangulation Station
"Chocomount 2" (which said "Chocomount 2" monument is located on the summit of the
highest hill of Fishers Island, N.Y. about two and one-quarter miles West of the Eastern
end of Fishers Island and lies South 79 degrees 29 minutes and 46 seconds East of Nodh
Dumpling Light in Fishers Island Sound); and
RUNNING THENCE along the northwesterly side of said road South 61 degrees 27
minutes 40 seconds West, 250.33 feet to a stake marking a point of curve to the right
whose radius is 783.95 feet and the direction of whose radius at that point is North 28
degrees 32 minutes 20 seconds West;
THENCE southwesterly along the northwesterly line of said road (following the arc of said
curve), 107.29 feet to a stake:
THENCE North 25 degrees 38 minutes 00 seconds West, 80.28 feet;
THENCE North 30 degrees 16 minutes 40 seconds East, 44.04 feet;
THENCE North 08 degrees 46 minutes 20 seconds East, 42.37 feet;
THENCE North 30 degrees 37 minutes 40 seconds West, 39.10 feet;
THENCE North 11 degrees 10 minutes and 10 seconds East, 142.40 feet to the shore of
Fishers Island Sound;
THENCEwith the meanders of said Sound North 86 degrees 45 minutes 50 seconds East,
105.95 feet, and North 40 degrees 49 minutes 00 seconds East, 87.60 feet to a stake;
THENCE South 33 degrees 04 minutes 50 seconds East, 279.10 feet to the monument at
the point of BEGINNING.
TOGETHER WITH all right, title and interest of the party of the first part in and to the land
which may lie between the respective meander lines above described and the actual high
water mark and in and to the shore of Fishers Island Sound in front of and adjoining said
premises.
TOGETHER WITH an easement for ingress and egress from the premises hereby
conveyed over and along such private roads as may now or hereafter exist connecting the
premises hereby conveyed with the public highway; provided, however, that Fishers Island
Estates, Inc., its successors or assigns, may change the location, route or grade of said
roads from time to time provided that such change shall not prevent adequate access to
the premises hereby conveyed.
