located at 405 Albertson's Lane, Greenport, New York
party of the second part,
WITNESSETH, that the party of the first part, in consideration of Ten Dollars and other valuable
consideration paid by the party of the second part, does hereby grant and release unto the party of the
second part, the heirs or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected,
situate, lying and.being at Arshamomaque, Town of Southold, County of Suffolk and State of New
York, more particularly bounded and described as follows:
BEGINNING at a point marking the intersection of the northerly line of Main Road and the
northeasterly line of Albertson's Lane; RUNNING THENCE along said Albertson's Lane North 87
degrees 24 minutes 30 seconds West, 596.81 feet to the land now or formerly of Cassidy; RUNNING
THENCE along said land South 31 degrees 43 minutes 20 degrees East, 644.70 feet to the northerly
line of Main Road; RUNNING THENCE along said line on an arc to the right having a radius of
2896.79,'feet, a distance of 584.37 feet to the point or place of BEGINNING.
SUBJECT TO a'permanent easement to the State of New York along the southerly line.
'BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by deed
dated April 2, 1985 and recorded on April 23, 1985 in Liber 9776 Page 159 in the Suffolk County
Clerk's Office.
SAID PREMISES being known as arid by the street address 405 Albertson's Lane, Greenport, New
York.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets
and roads abutting the above described premises to the center lines thereof; TOGETHER with the
appurtenances and all the estate and rights of the party of the first part in and to sai~l premises; TO
HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or
successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenafifs that the party
of the first part will receive the congideration for this conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement
and will apply the same first to the payment of the cost of the improvement before using any part of thc
total of the same for any other purpose.
AND the party of the first part covenants as follows: that said party of the first part is seized of the said
premises in fee simple, and has good right to convey the same; that the party of the second part shall
quietly enjoy the said premises; that the said premises are free from incumbrances, except as aforesaid;
that the party of the first part will execute or procure any further necessary assurance of the title to said
~remises; and that said party of the first part will forever warrant the title to said premises.
[OTWITHSTANDING THE FOREGOING, the foregoing covenants of the party of the first part shall
be personal to the party of the second part and such covenants shall not inure to the benefit of any of
the party of the second part's successors and assigns and may not be relied upon by any other party
whatsoever.
Fhe word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.
