THIS INDENTURE, made the 12th day of May, Two Thousand Nine
BETWEEN,
AGNES DUNN, whose address is 45 Queen Street, Greenport, New York 11944, as Executor of the last
will and testament of ANTONE J. MAL1NAUSKAS, who died on the 25th day of December, Two
Thousand Seven, the party of the first part, and
RICHARD WINDMULLER and CAROLINE ROCCHETTA, as joint tenants with right of survivorship,
residing at 14225 Soundview Avenue, Southold, New York 11971, party of the second part,
WITNESSETH, that the party of the first part, to whom letters testamentary were issued by the
Surrogate's Court, Suffolk County, New York on June 18, 2008, and by virtue of the power and
authority given in and by said last will and testament and/or by Article 11 of the Estates, Powers and
Trusts Law, and in consideration of TWO HUNDRED SEVENTY FIVE THOUSAND ($275,000.00)
DOLLARS, paid by the party of the second part, does hereby grant and release unto the party of the
second part, the distributees or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land with the buildings and improvements thereon erected,
situate, lying and being at Arshamomoque, near the Village of Greenport, in the Town of Southold,
County of Suffolk and State of New York, bounded and described as follows:
BEGINNING at a rod on the easterly side of Queen Street (a/k/a Queens Street f/k/a Queens Lane), said
rod being distant 243.25 feet southerly, as measured along the said easterly side of Queen Street, from
the corner formed by the intersection of the southerly side of North Road (C.R. 48) and the said easterly
side of Queen Street;
RUNNING THENCE along land now or formerly of Mary Ann Boken and Susan M. Malinauskas,
North 72 degrees 56 minutes 30 seconds East, 221.60 feet to a pipe and land now or formerly of Charles
and Judy Kozom;
THENCE along last mentioned land, North 55 degrees 02 minutes 00 seconds East, 57.55 feet to a stone;
THENCE continuing along said last mentioned land and along land now or formerly of Charles Kozora,
South 00 degrees 06 minutes 30 seconds East, 235.12 feet (deed) 191.01 feet (actual) to land now or
formerly of Lenore and Steven Atkins;
THENCE along said last mentioned land, South 75 degrees 42 minutes 50 seconds West (deed) South 78
degrees 42 minutes 50 seconds West (actual), 236. l,~"feet to the easterly side of Queen Street;
THENCE along the said easterly side of Queen Street, North 11 degrees 17 minutes 10 seconds West,
142.00 feet to a rod at the point or place of BEGINNING.
BE1NG AND INTENDED TO BE the same premises conveyed to Antone J. Malinauskas by deed dated
1/31/1969, and recorded 2/19/1969, in the Office of the Suffolk County Clerk in Liber 6507, Page 279.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center line thereof,
TOGETHER with the appurtenances, and also the estate which the said decedent had at the time of
decedent's death in said premises, and also the estate therein, which the party of the first part has or has
the power to convey or dispose of, whether individually, or by virtue of said will or otherwise,
TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the
distribut~es or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been incumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party
of the first part will receive the consideration for this conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for the purpose of paying the cost of improvement and
will apply same first to the payment of the cost of improvement before using any part of the total of the
same for any other purpose.
The word "party" shall be construed as if it reads "parties" whenever the sense of this indenture so
requires.
