party of the first part, and
JOHN S. GORGA and TERRY A. GORGA, residing at 310 Woodland Avenue,
Manorville, New York 11949
party of the second part,
WITNESSETH, that the party of the first part, in consideration of Ten Dollars and
other valuable consideration paid by the party of the second part, does hereby grant
and release unto the party of the second part, the heirs or successors and assigns of
the party of the second part forever, in
ALL that certain plot, piece or parcel of land, with buildings and improvements
thereon erected, situate, lying and being in the Township of East Hampton, County
of Suffolk and State of New York,
SEE SCHEDULE A ATTACHED HERETO AND
MADE A PART HEREOF
BEING AND INTENDED TO BE the same premises conveyed to the Grantors by
Deed dated February 27, 2003 and recorded in the Suffolk County Clerk's Office on
July 22, 2003 in Liber D00012262 page 564.
PREMISES ALSO KNOWN AS 1710 Trumans Path, East Marion, New York
Together with all right, title a~d interest, if any, of the party of the first part in and
to any streets and roads abutting the above-described premises to the center lines
thereof;
Together with the appurtenances and all the estate and rights of the party of the first
part in and to said premises;
To have and to hold the premises herein granted unto the party of the second part,
the heirs or successors and assigns of the party of the second part forever.
And the party of the first part covenants that the part), of the first part has not done
or suffered anything whereby, the said premises have been encumbered in any way
whatever, except as aforesaid.
And the party of the first part, in compliance with Section 13 of the Lien Law,
covenants that the party of the first part will receive the consideration for this
conveyance and will hold the right to receive such consideration as a trust fund to
be applied first for the purpose of paying the cost of improvement and will apply the
same first to the payment of the cost of the improvement before using any part of
the total of the same for any other purpose. The word "party" shall be construed as
if it read "parties" whenever the sense of this indenture so requires.

SCHEDULE A
ALL that certain plot, piece or parcel of land, with the
buildings and improvements thereon erected, situate, lying and
being at East Marion, Town of Southold, Suffolk County, State of
New York, bounded and described as follows:
BEGINNING at a monument at the intersection of the westerly line
of a strip of land 25 feet in width along the easterly line of
premises herein described with the northerly line of a second
strip of land 24 feet in width, running about parallel to and
about 250 feet northerly from Gardiners Bay;
RUNNING THENCE along the northerly line of the second above
mentioned strip of land South 43 degrees 19 minutes 40 seconds
West 333.51 feet to a monument and land formerly of Schiavoni
and otheres;
THENCE along said land North 20 degrees 13 minutes 10 seconds
West 22 feet to the shore line of Marion Lake;
THENCE along the shore line of Marion Lake (having a tie line of
North 11 degrees 06 minutes 20 seconds West 151.38 feet) to land
now or formerly of Edna A. Brown;
THENCE along said land North 64 degrees 05 minutes 40 seconds
East through a monument 271 feet to a monument on the westerly
side of the first mentions strip of land;
THENCE along said line South 25 degrees 54 minutes 20 seconds
East 50 feet to the point or place of BEGINNING.
TOGETHER also with a non-exclusive right of way over a 25 ft.
wfde strip of land from Marion Lake along the southeasterly line
of the above mentioned premises to land now or formerly of F.
Milton Welch and thence northerly along said land formerly of F.
Milton Welch about 1100 ft. to land now or formerly of Florence
Tuthill and continuing northerly, 16 ft. in width over said land
now or formerly of Florence Tuthill and land now or formerly of
Griffing to the Main Road, along said land now or formerly of f.
