THIS INDENTURE,made the day of nineteen hundred and nine -three

party of the first part, and
JOHN H. BINNS and CAROL A. BINNS, being married to each other, residing at 33995 Main
Road, Cutchogue, New York 11935
party of the second part,
WITNESSETH, that the party of the first part, in consideration of ten dollars and other valuable
consideration paid by the party of the second part, does hereby grant and release unto the party of the
second part,the heirs or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the building and improvements thereon erected,
situate,lying and being in the
Town of Southold, County of Suffolk, and State of New York being
bounded and described as follows:
261' to the south on Route 25.
180' on the west boundary.
264' on the north boundary.
145' on the east boundary.
Said premises are more particularly described as follows:
BEGINNING at a monument on the westerly side of Main Road (New York State Route 25)
where same is intersected by the southwesterly corner of land conveyed to H.K. Ressler and R.S.
Ressler; running thence along the westerly side of Main Road and the following two (2) courses
and distances: (1) South 50° 29' 20" West 195.48 feet to a monument; thence (2) South 42° 09'
00" West 65.10 feet to a monument and other land of the grantors; running thence along said
land North 430 28' 50" West 180.00 feet to a monument and land now or formerly of Resslers;
running thence along the last mentioned land the following two (2) courses and distances: (1)
North 560 02' 10" East 263.54 feet to a monument; thence (2) South 43° 28' 50" East 145.00
feet to a monument at the point or place of BEGINNING.
The grantors herein being the same parties as the grantees and the premises same as described in
deed dated July 1, 1991, and recorded, August 5, 1991, in Liber 11310 Page 326.

1000 TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
Sec. roads abutting the above described premises to the center lines thereof; TOGETHER with the
097.00 appurtenances and all the estate and rights of the party of the first part in and to said premises; TO
Block HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or
successors and assigns of the party of the second part forever.

Lot AND the party of the first part covenants that the paty of the first part has not done or suffered anything
011.005 whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part,in compliance with Section 13 of the Lien Law,covenants that the party of
the first part will receive the consideration for this conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and
will apply the same first to the payment of the cost of the improvement before using any part of the total
of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever sense of this indenture so
requires.
