However, if said pool is located more than four feet above the ground, then a fence is not required, provided that all points of access to said pool are adequatelY protected by a self-closing, self-latching gate. Any swimming pool in existence at the effective date of the provisions of this subsection shall, within one year from such date, comply with all of the provisions hereof. To wit; the defendant has constructed an in-ground swimming pool, which is currently operational, without the required enclosure.
