New York, the defendant Steven Racanelli wrongfully, intentionally, knowingly, recklessly, with criminal
negligence, committed the offense of violating Sonthold Town Code Section 144-15(A)
§ 144-15. Certificate of occupancy required; application.
A. No building hereafter erected shall be used or occupied in whole or in part until a certificate of
occupancy shall have been issued by the Building Inspector.
To wit; the defendant has constructed an in-ground swimming pool, which is in operation, without a certificate of
occupancy.
This complaint is based on personal observation, and records and files of the building department.

The undersigned Town Employee of the Town of Southold, being duly sworn, says that
On and before March 13, 2009 at 1200 Arbor Lane, Mattituck, Town of Southold, County of Suffolk, State of
New York, the defendant Steven Racanelli wrongfully, inlentionally, knowingly, recklessly, with criminal
negligence, committed the offense of violating Southold Town Code Section 280-13(4)(a)
Any swimming pool shall be completely enclosed with a permanent chain link (or similar type) fence of
not more than two-inch mesh, not less than four feet in height, erected, maintained and provided With a
self-closing, self-latching gate to prevent unauthorized use of the pool and to prevent accidents.
However, if said pool is located more than four feet above the ground, then a fence is not required,
provided that all points of access to said pool are adequatelY protected by a self-closing, self-latching
gate. Any swimming pool in existence at the effective date of the provisions of this subsection shall,
within one year from such date, comply with all of the provisions hereof.
To wit; the defendant has constructed an in-ground swimming pool, which is currently operational, without the
required enclosure.
This complaint is based on personal observation, and records and files of the building department.

attached, notice from Suffolk Cotmty for the revocation of License and refusal to renew
License to SJB Masonry/Blue Ribbon Gunite Pools Inc.
As a result of this individual's actions, the timetable to complete said project at
1200 Arbor Lane, Mattimck was delayed.

a. This application MUST be completely filled in by typewriter or in ink and submitted to the Building Inspector with 4
sets of plans, accurate plot plan to scale. Fee according to schedule.

c. The work covered by this application may not be commenced before issuance of Building Permit.
~' d. Upon approval of this application, the Building Inspector will issue a Building Permit to the applicant. Such a permit

f. Every building permit shall expire if the work authorized has not commenced within 12 months after the date of
issuance or has not been completed within 18 months from such date. If no zoning amendments or other regulations affecting the
property have been enacted in the interim, the Building Inspector may authorize, in writing, the extension of the permit for an
addition six months. Thereafter, a new permit shall be required.
