Down's Farm Preserve
A meeting of the Southold Town Conservation Advisory Council was held Wed., June 17,
2009 at Down's Farm Preserve.

CALL TO ORDER
Acting-Chairman James Eckert called the meeting to order at 4:30 PM.
ANNOUNCEMENTS
Acting-Chairman James Eckert announced that Chairman Don Wilder resigned as of June
2, 2009. Jim and the other members expressed their appreciation for all of Don's efforts
and wished him well in his future endeavors.
OLD BUSINESS
Member Jack McGreevy requested a status report on three memos he drafted and
presented to the members several meetings ago. The first memo was regarding the
shoaling condition of Down's Creek. The members were in agreement to re-review the
memo at the next meeting when the majority of the members were present.
The second memo was regarding saltwater fishing licenses. Trustee Dave Bergen
mentioned that he attended a press conference on Fri., June 12, 2009. He stated that the
law has already been passed and in effect as of October 1,2009. The intent of the
management of the estuary is good on the surface, however, the revenue is going to the
general fund and not to the management of the fisheries of the Peconic Estuary.
A third memo was regarding the mission statement of the CAC and goal setting. The
members agreed to re-review the memo at the next meeting.
NEW BUSINESS
Member Jack McGreevy requested the CAC prepare a proposal to the Town Board a
short heritage trail from the head of CR 48, Mattituck Park District property, south through
Love Lane to James Creek.
REPORTS
Members Jack McGreevy and Peter Young began the stake/mooring inventory at the end
of Rochelle Place, James Creek. A memo has been sent to the Board of Trustees with
their findings and requested feedback. Trustee Dave Bergen instructed them to continue
the inventory. Jack stated that most moorings can only be accessed by a watercraft. He
suggested the Town purchase a couple of kayaks. Trustee Bergen stated that he would
like to have the Town purchase a boat for the Trustees, or look for a donation.
APPROVAL OF MINUTES
Moved by James Eckert seconded by Jack McGreevy, to Approve the Minutes of May 13,
2009.
DISCUSSION AND RECOMMENDATION OF WETLAND PERMIT & COASTAL
EROSION PERMIT APPLICATIONS
Moved by Jack McGreevy, seconded by James Eckert, it was
RESOLVED to SUPPORT the Wetland Permit application of ARTHUR TORELL to
construct a single-family dwelling, garage, sanitary system, and pervious driveway.
Located: 365 Westwood Lane, Greenport. SCTM#33-2-11

The CAC Supports the application with the Condition gutters and drywells are installed to
contain roof run-off and the installation of a 12' non-disturbance buffer.

Moved by James Eckert, seconded by Jack McGreevy, it was
RESOLVED to SUPPORT the Wetland Permit application of ELIZABETH MCNULTY to
remove and replace 57' of existing bulkhead, in-place; backfill voids with approx. 38 cy. of
sand; replace existing seasonal staircase with new 3' wide staircase, and provide 10' wide
non-turf buffer.

The CAC Supports the application with the Condition the bulkhead is replaced with vinyl
sheathing, the existing buffer is maintained and a 10' non-turf buffer is installed landward
of the retaining wall.

Moved by Jack McGreevy, seconded by James Eckert, it was
RESOLVED to SUPPORT the Wetland Permit and Coastal Erosion Permit applications of
JAMES GRACE to remove concrete from beach. Place a single row of 1000 lb. stone
along the toe of the existing slope and north and south sides of the proposed access ramp
and cover with 60 cy. of sand to create a 10' wide dune, and stabilize dune with native
plantings. Install a 4'X 4' platform, 4' wide access stairs to beach, and 12' wide access
ramp.

landward of the boulders and a 10' non-turf buffer landward of the stairs.

Moved by Jack McGreevy, seconded by James Eckert, it was
RESOLVED to SUPPORT the Wetland Permit and Coastal Erosion Permit applications of
JOSEPH & JOANNA CHERNUSHKA to convert dormered second-floor bedrooms into
second-floor conforming space, remove the existing chimney, lift the dwelling to conform
to flood plain regulations, and install gutters and drywells to contain roof run-off.

RESOLVED to SUPPORT the Wetland Permit application of ADRIENNE LANDAU to
renovate the existing single-family dwelling, construct a 548 sq.ft, addition, replace
existing pool and patio, and upgrade the sanitary system.

RESOLVED to SUPPORT the Wetland Permit application of PAUL KATZ to construct a
detached three-car garage.

RESOLVED to SUPPORT the Wetland Permit application of GEORGE YATRAKIS to
construct a single-family dwelling, swimming pool, fence and patio; construct beach stairs;
install a bluestone on sand walk to beach stairs; remove remains of existing building; and
install a drainage structure 20' from top of bluff.

The CAC Supports the application with the Condition the proposed structures are properly
staked, gutters and drywells are installed to contain roof run-off, establish a non-
disturbance buffer landward of the top of the bluff, and erosion control devices are
constructed to support the beach stairs.

RESOLVED to SUPPORT the Wetland Permit application of COYOTE PROPERTIES,
LLC to clear and maintain a 4' wide path through the existing buffer and construct a 4'X
40' fixed timber catwalk with stairs over the tidal marsh.

The proposed project was not staked, however, the CAC Supports the application with the
Condition the driveway is pervious, and public access is provided along the creek, up and
around the dock.

DISCUSSION AND RECOMMENDATIONS OF APPLICATIONS TO AMEND PERMITS
Moved by James Eckert, seconded by Jack McGreevy, it was
RESOLVED to SUPPORT the application of JOSEPHINE GElS to Amend Permit #35 to
remove and replace a 3'X 4' platform, 3'X 8' catwalk, 3'X 12' hinged ramp and replace
existing float with a 6'X 20' floating dock.

The CAC Supports the application with the Condition the catwalk is constructed with Thru-
Flow decking and best management practices.

Motion Carried
Member Jack McGreevy will attend the next regular meeting of the Board of Trustees
scheduled for Wed., June 24, 2009.
The next meeting of the Conservation Advisory Council has been set for Wed., July 15,
2009 at 4:30 PM at Down's Farm Preserve.
There being no further business to come before the Council, the meeting was adjourned
at 6:00 PM.
