My dear Supervisor Klipp:-
In re Zeigler-Kra~cher matter
I have your letter of March 3rd, 1958 in which you
advise me that Mrs Zeigler has applied for a 1958 Trailer Camp
Permit for her trailer camp at East Marion and further note
that you believe that if the Building Inspector's report indicates
the Ordiance is being complied with, the To~m Board will grant
the permit. If the O~dlnance were being complied with I certainly
would be the last one to object to a permit being granted.
Ags~in I very respectfully call the attention of the
Town Board and yourself to Section 19 of your Ordinance which is
as follows:-
"On every Trailer Camp a suitable planting not less
than five (5) feet high, sufficient to screen the Trailer
Camp from view shall be erected along all lines of public
land and public highways and such fence shall be not less
than ten (10) feet from such public lands or highway lines."
Certainly the language of this Section is definite
and clear enough so that there should not be, and in fact cannot
be, any doubt as to what the Town Board meant when it adopted
this Ordinance. The principal word in this Ordinance is "screen"
and the word screen, to give a few difinitio~s from Webster's
Dictionary is - "a partition or curtain that cuts off inconvenience
a protective barrier .... A wall or partition often ornamental,
carried up to a certain height for sepsratlon and protection .... "
It so happened that this mornlng I was in Judge Hlll's
chambers here in Mineola and discussed the matter with him very
informally. If the Judge found in the Southampton case that the
ordinance had been complied ~ith, of course he was absolutely
right in issuing the permit. Our contention is that the Ordinance
has not been complied with and while perhaps I should not say, it
seems quite evident after the Meeting before the Town Bosrd last
Fall, that the Zeiglers do not intend to comply with the Ordinance.

to tho Town Board and to yourself.
It will be impossible for me to appear personally before
Your Board on Tuesday next as I have an appointment at the Chase
Manhattan Bank in New York to close a bond issue for our 8chool
District.
I do appreciate your courtesy in keeping me informed in
this matter and very respectfully suggest that I have no alter-
native but to protect the rights of the nearly 150 people that
I represent in this matter and also to respectfully suggest that
unless drastic changes have been made since I last saw the
Petitioner's property your Ordinance has not been complied with.

So far as I know the conditions have not cha~ged at
I had the privilege of appearing before your Town

I am correct in my recollection your Board was of
the opinion at that time that the Town Ordinance covering this mat-
ter had not been complied with and therefore the Zelglers were not
entitled to the Permit.
Because of their continued neglect or refusal to comply
with the Ordinance I have no other alternative so far as my clients
are concerned but to continue to object and I do, therefore, formally
object and protest agalnst any permit being granted. If I am in
error as to the Ordinance not havlmg been complied with I should
appreciate being so advised.
I thank you for givlng me formal motice of this
application.

Re: Trailer Camp Ordinance.
Dear Mr. Klipp:
With reference to your inquiry as to what the
existing trailer camp ordinance of the Town of Southold re-
quires in order to fulfill the requirements of Section 19,
your attention is invited to the fact that the ordinance states
that "On every Trailer Camp a suitable planting not less than
five (5) feet high, sufficient to screen the Trailer Camp from
view, shall be erected along all lines of public lands and public
highways.. ", and I think the phraseology is suffic-
iently clear to indicate what is meant.
The obvious purpose of t~ie provision was to
attempt to provide a screen for anything that might be regarded
as unsightly, and to attain that purp_ose the Board in adopting
the ordinance no doubt felt that a planting, oresumably of a
hedge or row of evergreens, would present a more beautiful aspect
than a solid board fence or any other type of fence. The wording
may perhaps be a bit severe, but it would be my opinion that the
official in charge of enforcement of this ordinance would be
Justified in issuing the permit ~nere there was ample evidence of
the applicant's good faith in the installation of the planting,
and that it would be substantially adequate to provide the screen-
ing at the beginning of the season, even though it was not, at the
time of the application, a solid screening or of a full five foot
heighth. In addition, it would be my opinion that no such fence
or screening would be required where, due to the topography, the
desired effect would not be achieved. Consequently, where the
immediately adjacent public land consists of a stream of water,
from which the applicant's land has a constant rise, the constr-
uction of a fence would serbe no purpose as it would not screen
anything. Hence, it would be my opinion that the legal meaning
of the ordinance should be so construe5 as to not require any
screening in such a place.

TO THE TOh~N BO~D OF THE TOWN OF SOUTHOLD:
FLORENCE and CHARLES ZIEGLER, being the owners of
premises on the W/S of Bay Avenue, East Marion, New York,
respectfully suk~it the following in answer to objections filed
with the Town Board relative to the issuance of a renewal of the
permit for the operation of a trailer park on the above premisew:
1 - With respect to the first objection, containing two
parts:
(a) That more than three trailers were installed
on the property during the past season, we were operating on an
agreement that not more than three tra~ers were to be used for
habitation. Since we own two of the trailers, and one was used
for storage purposes, we felt we could add an additional trailer
for habitation. The addition of this fourth trailer was by no
means intended as a breach of faith with the Town Board. The
fourth trailer is no longer located on the property, and if the
Town Board finds it objectionable to use a trailer for storage
purposes, in addition to the three permitted, such use will be
discontinued. And
(b) That no screening has been installed, we had
every intention of installing a high planting, but upon speaking
to a number of the immediate neighbors, they expressed the feeling
that it would obstruct the view toward the lake. Here again, if
the Town Board wishes to make such installation a prerequisite to
the issuance or the requested permit, we will promptly install the
necessary planting and screening.
2 - With respect to the second objection, the objectants
are in error. Renewal permit No. i was issued by the Town Board,
which permit expired December 81, 1956.
3 - The third objection is false.
4 - With respect to the fourth objection that the trailer
camp is an eyesore and a detriment to the community, it is respect-
fully submitted that the trailers are neat, orderly, and in
appearance do not compare unfavorably to many of the houses in
the area.
5 - With respect to the fifth objection, we deny at any
time deliberately or wilfully disregarding legal requirements and
on the contrary have in all respects put forth our best efforts
to improve the appearance and quality of the neighborhood, and will
continue to follow such a course.
Wherefore, we respectfully request that the renewal of
the permit be granted.

The Undersigned, all being over the age of 21 years
and residents of East Marion, in the Town of Southold,
Respectfully Object to either the renewal or the issuance
of a New Permit to Florence and Charles Zeigler for the
operation of a Trailer Camp on the West side of Bay Avenue,
East Marion for the following reasons:_
FIRST:- When Florence and Charles Zeigler first
applied for a Permit to operate a Trailer Camp a Promise
was made by them to the people in the area that no more
than three (3) trailers would be placed on the property
and that adequate planting would be provided to properly
screen the trailers. This promise was made for the purpose
of persuading the residents not to object to the granting
of the Permit. Now a Fourth (4th) trailer has recently
been installed on the property and NO planting or screening
whatsoever has been provided, although about two and one-hal
years have elapsed since the making of said promise.
SECOND:- The permit issued by the Town Board on
May 24th, 1955 expired on December 31st, 1955 and has not
been renewed and the Camp has been operated unlawfully and
illegally since January. lst, 1956.
THIRD:- That it was not until a complaint had been
made that any attempt was made by Florence and Charles
Zeigler to obtain a Permit from the Health Department or
to obtain a new Permit from this Board.
FOURTH:- The Trailer Camp is an eye sore and a
detriment to the community and has tended to and will con-
tinue to depreciate property values and cheapen the
neighborhood.
FIFTH:-

Yesterday Supervisor Kllpp telephoned my
office, but unfortunately I was not in. I h~w~ t~lked
with him this morning and he is keeping me fully advlse~
as to developments. I must therefore make it emphatic that
a~y complaints from now on, if I am to represent you people,
should be made to me and not to him.
The matter is receiving attention from both
the Department of Health and the ~olice 2epartmemt and the
Town Boar~l's action, as you of course know, must be base~ on
those reports. If we~are not satisfied, actio~ will be possible.
I appreciate the concern of yourself and all
the others simlliarly situated, but there are ways '~uud stepm
which must be complied with in matters of this kind where the
Law is involve~. Will you therefore please advise all of you~

Board of the Town of Southold, Suf-
folk County, New York, at a regular
meeting of said Board held at the

Section I Definitions.
(al A Tourist Camp is hereby de-
fined to be any lot, pleca or parcel of
ground where two or more tent~, tent
houses, camp cottages, house cars, or
traders used as living or slesping
quarters are or may be located, said
camp being operated for or without
compensation.
(b) A unit is hereby defined to be
any section or plo4 of ground, upon
which is erected any tent, tent house
or camp cottage, and/or for the ac-
commodation of ~ach automobile trailer
or hoace car.
icl Oamp Cottage is defined to be
any small baalding of whatever ma-
terial construeted having less than 350
square feet of cro~ saction area and~
used as living or sleeping quarters and

sites of ample size, free from heavy
or dense growth of brush or weeds.
The land shall be free from marsh and
shall be graded to insure rapid drain-
ago during and following rain.
Section 5. Each site used as a tourist
camp shall ,be provided with an ample
and adequate supply of w~ter of safe
sanitary quality, approved by the
Board of Health. Where water from
other sources than that of the muni-
cipal supply is prol~sed to .be used,
the sources of supply shall first be
approved by the Board of Health.
Section 6. Each tourist camp shaal
be provided with safe and adequate
provision for the collection and re-
moval of gar.bags and shall provide
a proI~r and acceptable sewer system
either by connection to a municipal
sewer system, where such is available,
or to septic tanks; all of which shah
comply fully with all laws, ordinances
and/er requirements prescribed by the
Board, of Health.
Section 7. Each unit in any tourist
camp upon which a tent, tent house,
camp cottage, trailer or house car is
erected or placed shall not be less than
40x50 feet in area clcerly defined by
markers in each corner and no single
family cottage used for living or sleeping
quarters shall be less than 280 square
feet or les~ than 14 feet wide at its
narrowest point or less than 7 feet
high from floor to plate or shall have
less than 27 square feet of ventilating
opening or windows properly and fully
screened.

(c) Each toilet room shall be pro-
vided with one lavatory or wash basin
for every five toilets or fraction there-
of.
id) One shower or bathtub shall
be provided for each sex for each 10
units or fraction thereof.
(el All toilets, basins and showers,
shall be placed in properly constructed
buildings conveniently located as to
each cottage or unit.
(fl Buildings shall be well lighted
at all times, day or night, well venti-
lated with seresned openings, and
constructed of such moisture-procd
material ac shall permit r~pid and
satisfactory cleaning, scouring and
washing.
(gl The floors shall be of water-
proof material elevated not less than
four inches above grade and each floor
provided with floor drains.
ih) Slop sinks or basins with water
supply over shall be provided to serve
each seven units and shah be con-
structed in accordance with design,
size and material approved by the
Board of Health.

(el Board of Department of Pub-

or Department established pursuant to
the laws of the S~ate of New York and
entrusted with the regulation, control
and supervision of matters pertaining
to and affecting fhe public health in
the Town of Southuld.
Section 2. It shall be unlawful for
any porsan, persons, firm, acsoclation,
corporation or co-partnership to estab-
lish, maintain, or operate within the
limits of the Town of Southold, any
tourist camp on any location or plot
of ground for use of transients by the
day, week, month, or season, whether
a charge is or is not made, who does
not posses~ a permit from the Depart-
ment of Health and the Town Board!
of the Town of Southuld. The permit i
of the Town Board of the Town of
Southuld shah expire on December 31st
following the date of issuance. Such
permit shall not be transferable or as-
signable. All Town Board permits may
be revoked for cause by such Board
after ~ hearing.
Section 3. Any person or persons,
firm, assoc/ation, corporation or co-
partnership hereafter applying for a
permit and/or a license to establish:
and operate ~ tourist camp must first
file with the Heard of Health and
the Town Clerk a complete copy of
the plan of the proposed camp. This
plan with the legal description of the
property show~, shall be drawn to
cottage shall extend sufficiently be-
yond the exterior wall line so that all
roof water shall fall free of walls.
Section 10. No cottage shah be
erected or placed upon any site at less
distance than 15 feet from any other
bui/ding or cottage.
Section 11. NO trailer or camp car
shall be located on any site where
there is less than 15 feet between the
trailer or camp car and other build-
lng, trailers, or camp cars included
in the camp area and no cottage site
or location of trailer or camp car site
shall be placed or erected within less
than 20 feet from the property line
separating the camp from adjulning
)roperty, measuring from the nearest
mint of the cottage site or locatior
;ralier or camp car site. No tourist
camp abutting any public street, avenue,
boulevard, terrace, court, or place shall
locate any tent, tent house, or cottage

beyond the established line set and
agreed upon and in no case closer than
20 feet to such street, avenue, boule-
vard, terrace, court, or place.
Section 12. Roadways or driveways
shall be provided not less than 25 feet
in width, wsll marked in the daytime
and lighted at night· Said, roadways,
or driveways to be so located that each
unit of the camp is easily accessible.
Said railways or driveways shall be
so constructed, that a dust nuisance
will not be created. All entrances and
scale and must show clearly the extent exits from the camp shall be well

Sectioz*. 16. It shall be the duty of
the owner, his agent or manager,
keep a register of all persons accom-

rules and regulations for the manage-
ment of the camp; to make adequate
provision for the enforcement of such

agement of such camps.
Further, it shall be the duty cf the
owner, his ~gent or manager, to:
(al Provide for regular inspection
of the water and the sanitary con-
veniences.
(b) Provide for the collection and
removal of garbage or other wacte ma-
teriul.
(c) Prohibit the placing or storage
of unsightly material or vehicles of
any kind.
id) Provide for the regular clean-
ing, painting, repairing, distrdecting of
all buildings, and
(el Provide at least one 2% gallon
soda and acid fire extinguisher, or its[
equivalent, for each 5 units, so located
that all uaat~ shall be within 200 fect~
of an extinguisher.
(fl Take such other measures as
ma~ be deemed to be necessary by the
Board of Health to preserve the health,
comfort, and safety of all persons re-
siding in the camp and the general
public.
/g) Cause each dog, cat, or other
pet animal to be kept under control
at aH times, either by being tied up
or confined in proper enclosure.

Section 17. Each tourist camp shall
clearly indicate one or more ex,trances
and exits, the use of which shall be
enforced. Where it is established by
complaint cd adjoining property owners
that their property is bein~ trespsasad.

to provide fence or other effective
barrier to insure such owners of ad-
joining property protection against
trespassing.
Section 18. The provisions of this
ordinance shall be in addltion to and
supplementary to the provisions of
other ordinances of the Town of
Southuld and where there is any con-
diet between the provisions of this
ordinance and any other ordinance,
then the ordinance providing the
stricter regulation shall prevail.
Sect/on 19. On every Trailer Camp

Trailer Camp from view shall be
erected along all lines of public lands
and public highways and such fence
shall be not less than ten (10) feet

lines.
Section 20. On receipt of any
plication for a permit, other than a
renewal under this artigle the Town
Clerk shall cause a notice of public
hearing thereon specifying the time
and place thereof to be published once
in a newspaper published in the Town
at least 10 days before the day of the
hearing.
Section 21. This ordinance shall not
apply to any territory included within
the limits of the incorporated village
of Grecnport. This ordinance shall not
apply to any tourist camp, unit, camp
cottage, or house trailer camp in
~eration on or before July 1, 1~3.
Section 22. Any person, firm or
corporation who shall violate or fail
to comply with any of the provisions
of this ordinance, shall be guilty of
a misdemeanor and shall upon con-
vict/on be punishable by a fine of not
le~s than $50.00 nor to exceed $100.00
or by imprisonment for a term not
exceeding six months or by beth such
fine and imprisonment. Each day that
a violation is permitted to exist shall
constitute a separate offense.
EFFECTIVE DATE
This ordinance shall take effect
upon publication and posting as re-
qaared by law.

shall be placed or erected within less
than 20 feet from the property line

Section 1~ Each tourist camp shah

Section 15. Each tourist camp sh. ali

kept coplee of all records pertaining
to the management or supervision of
the camp, such recorde to be available
!for inspection by the Board of Health

Sectim~ 16. It shall h~ the duty of
the owner, his agent or manager, to
keep a register of all persons accom-
modated in the camp, said register to
include the names of all persons, their
home addressee, the registration num-
ber and description of their automo-
biles or other vehicles; to prescribe
rules and regulattone for the manage-
ment of the camp; to make adequate
~rovision for the enforcement of such
rules; to subscribe to and adopt such
general rules and regulations which
may be hereafter adopted for the man-
agement of such campe.
1~urther, it shall be the duty cf the
owner, his ngent or manager, to:
(a) Provide for regular inspection
of the water and the sanitary con-
v~ntences.
(b) Provide for the ceilsetion and
; removal of garbage or other waste ma-
i terial.
(c) Prohibit the placing or storage
of unsightly material or vehiclse of
any kind.
(d) Provide for the regular ele~n-
. lng, painting, repairing, disinfecting of
or driveways to be so located that each all buildings, and
unit of the camp is ca~fly accessible. (e) Provide at least one 2% gallon
