They presently have a "tourist permit #3" issued by the Town Board. The present application is to move two cabins and enlarge the snack bar and make it into a restaurant. The new parking lot, for the restaurant, would further be cut down by the moving of two other cabins. Next door, the property to the East, belongs to the Village of Greenport and this is where the Greenport Water System has one of its well fields. These fields are on the edge of a very high nitrate zone (study done by H2M in 1974) and also there were indications that one or two of the wells were experiencing salt water intrusion. With the proposed plans, I would like to know as to whether the Town Board would still feel that this "tourist" facility would still be operating within the confines of the issued permit with this expansion? Gentlemen; In response to your motion (minutes of To~n Boar~eeting Sept. 27th) Iohave reviewed the Hartofelis & Giannaris appligation to erect a slab with canvas awning for temporary shelter in connection with the snack bar~ Main Road~ East Marion. This property was formerly Brown's Cabins, Town Permit # 3. I have compared surveys in the file with the plan submitted by Har~ofelis for the erection of the canvas toped slab. Brown had 15 cabind, Gus has 1~ (two have been combined) the snack bar was stradle the property line - partialy on Village of Greenport property and has been pulled back entirely on the Hartofelis property. As far as I know, no other changes have been made on the premises. The buildings were all in existance prior to the a~nended camp cottage requirement of 5000 Sq Ft per unit. The survey shows 1.~2 acres whiCh is 6Z~1.2 sq ft of area; 1~ units mU 5,000 Sq Ft each would require 70~.~ Sq Ft if being built today. In both plans the ~$~.dwelling (main~house) is shown in addition to the cabins. Based on keeping the existing setback from the main goad - (RT25) - from the corner of main house to corner of snack bar~ at ground level for the slab. I cannot see where there would be an increase in occupation density, only more convenience for the tennants now using the lawn for recreation, eating lunch, sn~cks etc. Trusting the above will be helpful. December 9, 1975 Mr. Merlon Wiggin North Fork Environmental Council Main Road East Marion, New York 11939 Dear Merlon: The Village of Greenport-Water Department is concerned about the possible development of what was formerly known as Brown's Cabins in East Marion. The Water Department would like you to review the attached material and make a statement of concern. The Village of Greenport owns and operates a public water supply in the To%~ of Southold; its Well Field #4, located in East Marion consists of some 16 acres of land, 3 public water supply wells and one test well. Well Field #4 (East Marion) was opened in 1943. Well #4-6, 200 gallons per minute, depth 79 feet, 8" casing, decision March 23, 1943. Well #4-7, 200 gallons per minute, depth 79 feet, 8" casing, decision March 23, 1943; Well #4-8, 300 gallons per minute, depth 80 feet, 8" casing, decision May 7, 1957. At the time Well Field #4 was placed on the public water supply system, the chlorides were 35 p.p.m, and ran between 35 p.p.m. - 50 p.p.m, until about 1963 when it had a sharp increase to 194 p.p.m. due to the encroachment of salt water nearer to the supply. In August 1963, the Village held a hearing with the Water Power and Control Commission concerning the dredging at Fordham Acres but was unsuccessful in stopping the project. On October 23, 1968 the Village along with Mr. John Wickham (representing the Town of Southold) appeared at a hearing objecting to Mr. William Pollert's dredging in from Long Island Sound; this project did not materialize. The Village watched very closely the plans of Pebble Beach Farms which finally had a density of one acre. Mr. Merlon Wiggin -2- December 9, 1975 The present level of chloride readings at Well Fiedl #4 is between 80 p.p.m, and 140 p.p.m, relative to the seasons. Since 1963, the Village has had to' cut back on pumping from this site and monitor the wells weekly. The water table contour in this area is one and one half foot (1½) above mean sea level, is very critical and subject to injury. The water supply has engaged the Engineering Firm of Holzmacher, McLendon & Murrell to make certain studies of the quality of water in the Town of Southold; (1) Recommended Improvements to the Water Supply System - October 1972, (2) Water Quality Study in the To~ of Southold September 1974. Both of these studies required extensive nitrate samples and analysis. The area to be considered is in a nitrate pollution area. The Village of Greenport-Water Department does not object to the use of Brow~s Cabins but is concerned at the level and density that could be allowed. We hope that the use of the former Brown's Cabins will not have a higher density or a greater pollution effect than was allowed in the past. We thank you for your consideration in this matter. Supervisor: You have heard the reading of the notice by Council- man Homan and the application to be able to operate a tourist camp in East Marion by the applicant; proof of publication has been demonstrated in the Traveler and The Suffolk Times and proof that it has been posted on the Bulletin Board in the Town Clerk's Office in Southold. Does anyone wish to speak on this application in support thereof. George Parker: I am George Parker of East Marion. What does this entail? Does it mean an expansion of the existing facility? I understand this is Brown's Cabins property that's involved. Does it mean any change in the number of cabins or in the number of people that can come in there or does it also mean that trailers, house trailers, can be accommodated in this area? It's asking to operate what he presently has there now legally, I guess. Mr. Parker: There are eight or nine cabins there now as I understand it. Supervisor: This is the first chance we have gotten to look at this tonight. Question: Is that a non-conforming use? Supervisor: George Brown, you owned that before. Was that a non-conforming use before? Mr. Brown: It was business-zoned, not non-conforming. Gus Hartofelis: I am Mr. Hartofelis, the applicant. We intend to operate it the same way as Mr. Brown operated it with no changes at all. Just the way it has been operating all these years. We don't intend to add anything or trailers or anything like that. We intend to make quite a few improvements there but not add anything. Supervisor: Anyone else wish to speak in support of this application for a tourist camp? Anyone else wish to speak support? in Mrs. Brown: That is the same application we had to make twenty years ago. You need a permit to operate no matter who it is. Fred Wingate: I am President of the Gardiners Bay Estates Club. On behalf of our people, I think the general consensus of feeling is that there can be no objection to existing facilities as such but I think this Town Board in granting this must put some restrictive covenants prohibiting any further expansion, any expansion of sewage facility and other factors that could affect the water supply. I think the Village of Greenport is very much interested because they own the adjacent property, in fact they have their wells there. Those restrictive covenants, I think, are the most important thing of all. Supervisor: Thank you, Mr. Wingate. Anyone else? In support? Anyone in opposition to granting of this permit to operate a tourist camp? Robert Reybine: I have a question. If this place should change hands again, the present owner, the one that is coming up, says he will not change the general idea of what is being done there now but if there is a future owner would he be permitted to bring in house trailers and that type of installation? Supervisor: One of the covenants that is put on, if there are any put on, they ride with the land and not with the owner. Mr. Reybine: Under the present zoning, would they be permitted to put house trailers in there? Justice Demarest: I would doubt it. In counting the cabins, there are more here on this map. There are 15 cabins plus a residence on an acre and a half. I would say that if anyone were to make an application on this land as it is, with nothing on it, they would probably have difficulty getting a permit for 15 cabins. They probably are beyond what would be permitted on a permit. Mr. Reybine: In other words, this is a non-conforming use? Justice Demarest: I don't think so. Supervisor: I would like to look at the map later to see how it is presently zoned. Justice Suter: Regulations on a tourist camp are more restrictive than they were then. Mr. Reybine: Is the renewal being restricted to present facilities with no further expansion? Justice Surer: He couldn't get a renewal under our present restrictions. Mr. Reybine: Renewal automatically would mean there would be no expansion. Councilman Homan: This is not a zoning change, it is merely a permit to operate this type of facility in the town. If he wants to increase the density or something else like that, that is something else. This is just a permit to operate the present facility. Supervisor: Anyone else? Is there anyone who wishes to speak in either direction. If there are any other points you want to clear up in your mind, that we have answers to, we have the applicants here and this is the proper time to ask the question. Question: I was speaking to Mr. Monsell about the water situation and they said they were going to have somebody here to voice their objection to increasing it from the standpoint of their water supply. It is near the wells and any further expansion would be a critical item to the wells. In fact, I believe the wells suffered some salt water intrusion from the time that that inlet was dug on the south side of the road so they were very concerned about the contamination of the water, supply. Mr. Brown: You have to worry about something like Pebble Beach; you wouldn't have to worry about that in a little place like we run.
