(631) 765-1809 Fax (631) 765-9064 $outhold Town Clerk FINDINGS, DELIBERATIONS, AND DETERMINATION MEETING HELD APRIL 14, 2009 ZBA FILE # 6258 - Paul Katz, Applicant PROPERTY LOCATION: 100 West Mill Road (at Mattituck Creek), Mattituck CTM 113-4-2 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Adminislrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. PROPERTY FACTS/DESCRIPTION: The subject property is located on Mattituck Creek and is 41,392 square feet in the R40 District. It is a comer lot with 297 ft. fronting on Mill Road, 108.27 ft. fronting on a 25 ft. right-of- way to the west and 187.4 ft. along the easterly property line. It is improved with a two-story, single-family dwelling. BASIS OF APPLICATION: Request for Variances under Sections 280-15(F), based on the Building Inspector's June 23, 2008 Notice of Disapproval concerning a proposed accessory garage at a setback of less than the code- required minimum of 50 feet from the front yard lot line. RELIEF REQUESTED: The applicant's original plan was submitted for a 30 ft. x 23.4 ft accessory garage with a front yard setback from Mill Road of 37 feet, were the code requires a minimum setback of 50 feet. AMENDED APPLICATION: On March 20, 2009, the applicant's agent, Nancy Dwyer, submitted to the Board of Appeals an amended plot plan requesting an additional two feet in size on the proposed garage, now measuring 32 ft. x 23.4 feet and located two feet closer to the house at 32 feet 10.5 inches rather than the 34 feet 10.5 inches applied for. The front and side yard setbacks remain the same as applied for and the size, height and location of the proposed accessory garage remain conforming as proposed with this amendment. Page 2 -April 14, 2009 ZBA File # 6258 - Paul Katz CTM 113-4-2 FINDINGS OF FACT LWRP DETERMiNATION: This application is exempt under Chapter 268, also confirmed on March 18, 2009 by the Town LWRP Coordinator in a letter received by the Board of Appeals, for the reason that no natural resources concerns were observed relative to construction of the proposed accessory garage. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Town Law §267~b(3)(b)(3)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The proposed accessory garage is in keeping with the architectural styles in the neighborhood. The subject property and the adjacent properties are naturally wooded, and the garage will have limited visual impacts. 2. Town Law §26%b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The location of the accessory garage is heavily constrained by the presence of wetlands and slopes on the subject property. 3. Town Law §267-b(3)(b)(3). The variance granted herein is not substantial given the odd shape of the parcel, the burden of two street frontages and a waterfront location with wetlands on the property. 4. Town Law §267-b(3)(b)(5). The difficulty has not been self-created but is the result of constraints on the site. 5. Town Law §267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The proposed garage is located on fiat terrain and a drywell is proposed to contain rain water runoff. 6. Town Law §267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an accessory garage, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Weisman, seconded by Chairman/Member Goehringer, and duly carried, to GRANT the variance as applied for and shown on the AMENDED copy of the John C. Ehlers partial plot plan/survey dated 08-18-05, as modified March 20, 2009 by Nancy Dwyer, Designer with cover letter of explanation, subject to the following Condition: That the accessory garage shall only contain the utility of electricity. That the above condition be written into the Building Inspector's Certificate of Occupancy, when issued. Any deviation from the variance given such as extensions, or demolitions which are not shown on the applicant's diagrams or survey site maps, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is dc minimis in nature for an alteration that does not increase the degree of nonconformity. · Vote of the Board: Ayes: Members Goehri~ge~, ~va~~a~. and Schneider. Applicant does not make any claim that there is anyundue hardship or that the hardship created is unique or that it would observe the spirit of the Ordinance and not change the charaCter of the district. The applicant does not own this property where the sign would be located and has no financial interest in it. He has permission to locate his sign there provided he does not violate the Ordinance. The situation is not Unique in any sense of the word. The same restriction applies to everyone and the Board ~ay not grant a benefit for the benefit of one property when all other properties are left with a restricted use. A sign at this point would verydefinitelynot observe the spirit of the Ordinance and would change the character of the neighborhood involved because the Town has recently aequirod 92 feet on the ~in Road with a depth of 295 feet in order to build a public street 50 feet wide by at least 295 feet long and negotiations are no~ going on to continue the depth in order to m~ke a connection with an existing street. A new Post Office is being constructed. It will face this plaza and beginning on the Main Road there will be a free public parking place. Immediately to the west is a Ohurch and it is expected that the worshippers will use the parking lot daily. This applicator proposed erecting a sign approximately 12~' x 6~', either attached or detached, directly facing the parking field - a sign advertising various products or a restaurant. The space would be rented for short periods. This new plaza is an expensive undertaking and with a new post office building and modern parkimg facilities for the benefit of the people of Outchogue, ~ection 408, paragraph (a) allows ~ si~n to be erected in this district provided it advertises only the business conducted on the premises. The comfort and convenience of the Town would be adversely affected. This location is peculiarly unsuited due to the uses of the adjoining premises. There had not been any change in the conditions which led to the adoption cf Section ~08 on April 8, 1958. The Board, after discussion, voted unanimously to have a supply of 500 stamped, name imprinted, envelopes ordered and ~.~. Terry was requested to see that this was taken care of.
