PONTINO Property Location: 2675 Indian Neck Lane, Peconic CTM Parcel # 1000-86-5-13 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this aPplication and determines that this review falls under the Type II category of the State's List of Actions, without further requirements under SEQRA. The Zoning Board of Appeals held a public hearing on this application on February 19, 2009, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: REQUEST MADE BY APPLICANT: The Applicant-Owner requests a Special Exception under Zoning Code Section 280-13B to establish an Accessory Apartment in this single-family dwelling, with owner-occupancy. PROPERTY FACTS/DESCRIPTION: The property is 32,949 square feet with 200 feet along Indian Neck Road. The property is improved with a single-family two-story residence as shown on the August 28, 2008 survey by John T. Metzger, Licensed Land Surveyor. The dwelling has a Pre-Existing Certificate of Occupancy of record dated February 10, 2009 under Certificate of Occupancy #Z-33531 confirming that the one family dwelling with two one story enclosed porches was built prior to April 9, 1957. The owner/applicant resides in the dwelling. Page 2 - March 5, 2009 ZBA # 6254 - Deborah M. Pontino, Applicant CTM 86-5-13 FINDINGS OF FACT In considering this application, the Board has reviewed the code requirements set forth pursuant to Article III, Section 100-31B(13) to establish an Accessory Apartment and finds that the applicant complies with the requirements for the reasons noted below: 1. The Accessory Apartment unit will be located on the second floor with an area of 815.15 Sq. Ft., in conformity as proposed, with 36.55% reserved for the apartment, which percentage is less than the code's limitation of 40%, with 1,212.51 Sq. Ft. reserved for the owner/applicants livable floor area (1,149.41 Sq. Ft. on the first floor and 265.10 Sq. Ft. on the second floor) for a total of 63.44% of the applicant's dwelling, as described and shown on the first floor plan by Environments East dated 11.10.08 and signed by J. Chambers, and the second floor Accessory Apartment floor plan by Environments East dated 11.5.08 and singed by J. Chambers. 2. The applicant herein, has owned and resided at the property and will continue to occupy the dwelling as a principal residence while the Accessory Apartment is occupied. 3. The applicants' plans comply with the on-site parking requirements and provide for a total of three (3) parking spaces, two for the principal use and one for the Accessory Apartment, utilizing the existing driveway areas, as shown on the site plan by Environments East dated Feb. 4, 2009 4. The dwelling unit shall comply with the code requirements as defined in Section 100-13 of the Zoning Code. The applicant confirms the existing livable space Of the dwelling is 2,229.66 square feet for both floors of the single family dwelling. 5. The building Plan will retain the existing appearance of a single-family dwelling. The accessory apartment will be entered through the existing one story porch along the side yard. REASONS FOR BOARD ACTION DESCRIBED BELOW: Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: 1) The Accessory Apartment, as applied for, is reasonable in relation to the District in which is located, adjacent use districts, and nearby adjacent residential uses. 2) This A~cessory Apartment shall be in conjunction with the owner's residence in the principal single,family dwelling unit, and as proposed will not prevent the orderly and reasonable use of districts and adjacent properties. 3) No evidence has been submitted to show that the safety, health, welfare, comfort, Page 3 - March 5, 2009 ZBA # 6254 - Deborah M. Pontino, Applicant CTM 86-5-13 convenience, order of the Town would be adversely affected. 4) The special exception is authorized under the Zoning Code through the Zoning Board of Appeals as noted herein, and issuance of a Certificate of Occupancy from the Building Inspector is required by code before an Accessory Apartment may be occupied. 5) No adverse conditions were found after considering items listed under Sections 280- 142 and 280-143 of the Zoning Code. 6) Submission of a Certificate of Compliance or similar document will be necessary for issuance by the Building Inspector certifying that the premises conforms to Chapter 280 of the Zoning Code for an Accessory Apartment use. BOARD RESOLUTION: In considering all of the above factors and applying the standards of law, motion was offered by Member Weisman, seconded by Member Simon, it was RESOLVED, to GRANT a Special Exception for an Accessory Apartment, in conjunction with the applicant's single-family residence, as applied for, SUBJECT TO THE FOLLOWING CONDITIONS: 1. Owner shall occupy the dwelling as her principal single family residence. 2. Certificate of Occupancy/Compliance shall be obtained from the Building Department before occupancy of the Accessory Apartment 3. The Certificate of Occupancy/Compliance will terminate upon the transfer of title or upon the owner(s) ceasing to occupy one of the dwelling units as the owner's principal residence; and that in the event of the owner's demise, the occupant of the accessory apartment may continue in occupancy until a new owner shall occupy the balance of the dwelling, or one year from the date of said demise, whichever shall first occur. 4. It measures 200' wide along Indian Neck Road frontage (west) and the rear (east) property boundaries, 166.74' along the northerly boundary, and 173.30' along the southerly boundary. BASIS OF APPLICATION: Request for a Variance under Sections 280-122 and 280-124, and Zoning Code Interpretation ZBA # 5039 (R. Town Law §257-b(3)(b)(3)(1). Grant of the variance of will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The applicant's house is sited far back from the road with very large side yards and will remain unchanged. The subject property is bounded by a sod farm to the north and east (rear) where the proposed deck will be constructed. To the south is a wooded lot improved with an accessory structure and to the west is an unimproved wooded lot. The majority of the proposed deck will be shielded from view from the street by the house and will have no effect on adjacent properties. 2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance because the existing dwelling has a non-conforming rear yard setback that will be maintained by the proposed deck. 3. Town Law .q267-b(3)(b)(3), The variance granted herein is substantial in that is represents a 20% variance from the code required 50' rear yard setback but is not substantial insofar as the proposed deck will not be increasing the existing non-conforming setback. 4. Town Law §267-b(3)(b)(5). The difficulty has not been self-created but is the result of the existing non-conforming rear yard setback of the applicant's house. 5. Town Law .q267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The proposed wood deck will be built on fiat terrain and will pose no drainage problems. There are no protected features such as wetlands on or adjacent to the subject property. 6. Town Law §267-b. Grant of the requested relief is the minimum action necessary and to enable the applicant to enjoy the benefit of a deck while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community.
