SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply received October 15, 2008 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. PROPERTY FACTS/DESCRIPTION: The subject property is a 34,538 square foot parcel measuring 168.64 feet along Calves Neck Road to the north, 189.75 feet to the east, 83.40 feet long Midfarm Road to the south, and 135.96 feet to the west. The lot is improved with a single-family house as shown by a survey prepared by John T. Metzger, L.S. dated February 8, 2007, amended September 11, 2008. BASIS OF APPLICATION: Request for a Variance under Section 280-15, based on the Building Inspector's September 9, 2008 Notice of Disapproval concerning proposed swimming pool construction in a yard other than a rear yard. ADDITIONAL INFORMATION: A variance was granted on May 23, 2007 (ZBA File No. 6023) concerning this property in an application to locate a pool partly in the side yard and partly in the southerly front yard. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on October 30, 2008 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: Page 2 of 3 -December 18, 2008 ZBA # 6226 L. and R. Daddona CTM 1000-63-7-25 REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Town Law §267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The property has two front yards and two side yards. The pool will be located in the functional backyard and will be set back from the road behind the house. 2. Town Law §267-b(3)Co)(2). The benefit of adding a swimming pool cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The house fronts on two streets and has no rear yard. 3. Town Law §267-b(3)(b)(3). The proposed variance is not substantial. The lot is 34,538 square feet in size. Constructing the pool will increase the lot coverage from 8% to 10%, well within the code-required 20%. 4. Town Law §267-b(3)Co)(5). The difficulty has not been self created. It is a consequence of the house being located on a lot with two front yards. 5. Town Law §267-b(3)Co)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. 6. Town Law §267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of adding a swimming pool, while preserving and protecting the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering ail of the above factors and applying the balancing test under New York Town Law 267-B, a motion was offered by Member Simon, seconded by Member Weisman, and duly carried, to GRANT the variance as applied for, as shown on the September 11, 2008 site survey prepared by John T. Metzger, Land Surveyor, subject to the following conditions: 1. Evergreens at 6 to 8 ft. in height shah be planted for the full 42 ft. length along the yard adjacent to Midfarm Road, and 2. Any drainage of pool water must be contained in a drywell on this site. Any deviation from the variance given such as extensions, or demohtions which are not shown on the applicant's diagrams or survey site maps, are not authorized under this application when involving nonconformities under the zoning code. Daddona CTM 1000-63-7-25 future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity.
