The Zoning Board of Appeals held a public hearing on this application on October 18, 2007 and January 8, 2009, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: REQUEST MADE BY APPLICANTS: The Applicant-Owner requests a Special Exception under Section 280-13B of the Zoning Code, to establish an Accessory Apartment with owner-occupancy in a single-family dwelling as enlarged with recent additions. PROPERTY FACTS/DESCRIPTION: This property is 31,912.27 square feet with 84.45 feet along the mean high water line of Mattituck Creek, 336.25 feet along the western boundary, 101.90 feet along Holbrook Lane to the north, and 330 feet along the eastern boundary. The property is improved with a single-family house and an accessory shed, as shown on a July 30, 2007 survey prepared by William R. Simmons Ill, L.S. FINDINGS OF FACT In considering this application, the Board has reviewed the code requirements set forth pursuant to Article III, Section 280-31B(13) to establish an Accessory Apartment and finds that the applicant has failed to comply with the requirements for the reasons noted below: 1. The principle dwelling unit will occupy 1,423 square feet of livable floor area. Section 280-13B lc] of the Code requires a minimum of 1,600 square feet. No Certificate of Occupancy pursuant to Building Permit No. 32609Z, dated January 3, 2007, authorizing additions and alterations to the existing single family dwelling, has been issued. Section 280-13-B[m] requires that a building which is converted to permit an accessory apartment shall be in existence and have a valid certificate of occupancy issued prior to January 1, 1984, or proof of occupancy prior to that date. BOARD RESOLUTION: On motion by Member Simon, seconded by Member Oliva, it was RESOLVED, to DENY the Special Exception for an Accessory Apartment. We have owned the house next to the Bonagura's for 10 years and are opposed to the approval of an accessory apartment. Holbrook Lane is a one-lane private road that is maintained by the residents. Current traffic (which has recently increased due to sales listings with realtors) has caused degrading of the road, which was just scraped and laid with stone in August. Additional cars are a detriment to the road and increase maintenance costs to the residents. We have experienced a number of rentals on this road since we purchased the house, and renters tend to disregard maintenance of the area because they're not "permanent." We have owned the house next to the Bonagura's for 10 years and are opposed to the approval of an accessory apartment. Holbrook Lane is a one-lane private road that is maintained by the residents. Current traffic (which has recently increased due to sales listings with realtors) has caused degrading of the road, which was just scraped and laid with stone in August. Additional cars are a detriment to the road and increase maintenance costs to the residents. We have experienced a number of rentals on this road since we purchased the house, and renters tend to disregard maintenance of the area because they're not "permanent." At present, the house is in probate since my mother recently died. My brother and I are the only heirs and ac, cording to her will, everything my mother had is divided equally between us. Our home is two houses away ti'om the Bonagura's. While thc Bonaguras are vel7 nice people, we have many concerns about their proposal tbr an apartment within their gigantic house, and we wish to have the application denied. It has been very troubling to all of us for many years that when Mr. Bonagura rented his small house he did so ~ very wild tenants. There was nothing any of us could do about the rowdiness at all hours, the drunkenness, or the cars racing up and down our dirt and gravel road. In short, the Bonaguras were not at all discriminating about who they accepted as renters in the past, and there is no reason to believe their rental policy has changed. Allowing this apartment to be within their home will enable them to rent to such tenants again. We all have moderately sized homes on Young's Point, and the Bonagura home has completely ruined the look and feel of what was once a neat, quiet country road. This house is no addition; it is a mansion on a piec~ of property that just cannot sustain it. How Anthony Bonagura got zoning for it has boggled the mind of every homeowner on thc road. The Bonaguras have been building this addition for years, and we have all been living in a construction site with them. They do not cie, an up any of their building materials, nor do they have any oi~ their discarded furniture or other bulky waste removed. Rather, it "decorates" the property, for all to see, in huge piles out by the road. As I said, the Bonaguras are very nice people, very p~rsonable when you speak with them. However, they are not very considerate neighbors, and we fear that allowing this apartment application to go through will lead to more problems for all the homeowners on the road. Please deny it.
