(631) 765-1809 · Fax (631) 765-9064 · RECEIVED ~JJUN ~ :?08 FINDINGS, DELIBERATIONS AND DETERMINATION MEETING OF JUNE 16, 2008 $outhold Town Clerk ZBA # 6168 - Application of Carl Juul-Nielsen and Patricia Cadavid Property Location: 1125 West Cove Road, Cutchogue CTM 111-3-14 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued a reply dated May 28, 2008 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter- community impact. LWRP EXEMPT: This application is exempt under Town Code LWRP Chapter 268, since no natural resource feature was found within 100 feet of the construction area requested under this zoning variance. PROPERTY FACTS/DESCRIPTION: The applicant's property consists of 27,906 square feet with 90 feet along West Cove Road. The property is improved with a one-story frame house with garage and accessory shed, as shown on the October 10, 2007 survey prepared by Nathan Taft Corwin. BASIS OF APPLICATION: Request for Variances under Sections 280-122 and 280-124, based on the Building Inspector's May 5, 2008 Notice of Disapproval and ZBA Interpretation #5039 (Walz) concerning proposed additions and alterations to the existing single-family dwelling. The reasons for disapproving the applicant's request for a building permit are that the new construction will constitute an increase in the degree of nonconformance Page 2 - June 16, 2008 ZBA # 6168 - C. Juul-Nielsen & ano. CTM 111-3-14 when proposed with a minimum single side yard setback at less than 15 feet, and with total side yards at less than 35 feet. FINDINGS OF FACT The Zoning Board of Appeals held a pubhc hearing on this application on May 29, 2008, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: The relief requested is an area variance concerning proposed additions and alterations to the existing nonconforming dwelling, at less than the code-required minimum of 15 feet on a single side yard and less than 35 feet total, combined side yard setback (15 feet & 20 feet). The nonconforming setbacks as requested for the alterations/addition are a single side yard setback at 14.4 feet and the total side yard setback at 26.5 feet. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Town Law §267-b(3)(b)(3)(1). Grant of relief will not produce an undesirable change in the character on the neighborhood and a possible detriment to nearby properties because the proposed construction is similar in size and scale to the neighboring houses. 2. Town Law §267-b(3)(b)(3)(2). The benefit sought by the applicant cannot be achieved by some method feasible for the applicant to pursue, other than an area variance because in order to create a consistent roof pitch the entire roof has to be removed. 3. There has been no evidence submitted to suggest that a variance in this residential neighborhood may have an adverse impact on the physical or environmental conditions in the neighborhood. 6. The grant of the requested relief to alter the roof line is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an addition to the dwelling, while preserving and protecting the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Dinizio, seconded by Member Simon, and duly carried, to GRANT the variance as applied for, as shown on the drawings Al, A2, A3, A4 prepared March 28, 2008 by Mark K. Schwartz, A.I.A. Any deviation from the variance given such as extensions, or demolitions which are not shown on the applicant's diagrams or survey site maps, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action.
