WITNESSETH, that the party of the first part, by virtue of the power and authority given in and by said last
will and testament, and in consideration of
----TEN and 00/00 and other good and valuable consideration --------------- dollars,
paid by the party of the second part, does hereby grant and
release unto the party of the second part, the heirs or successors and assigns of the party of the second part
forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate,
lying and beings at Mattituck in the Town of Southold, Suffolk County, New York,
bounded and described as follows:
BEGINNING at a concrete monument set on that course of the southwesterly line of
Deep Hole Drive which rums South 30 degrees 11 minutes 20 seconds East 10.0 feet
southeasterly along said course from the northwesterly terminus thereof, being
the northeasterly corner of other land of the parties of the second part; and
rumriing along said other land of the parties of the second part South 65 degrees
10 minutes 10 seconds West 350 .feet; more or 1e�s, to the ordinary high water
mark of Deep Hole Creek;
thence northwesterly along said ordinary high water mark of Deep Hole Creek,
tl 70 feet, more or less;
thence along other land of the parties of the second part and passing through
a concrete monument North 70 degrees 21 minutes 00 seconds East 340 feet, more
or less, to a concrete monument set on said southwesterly line of Deep Hole Drive;
thence along said southwesterly line of Deeo Hole Drive 2 courses as follows:
(1) on a,-curve to the left having a radius of 330.0 feet, a distance of 30.0 feet;
thence (2) South 30 degrees 11 minutes 2.0 seconds East 10.0 feet to the point
of BEGINNING.
TOGETHER with all the right, title and interest of the parties of the first
part of, in and to that portion of Deep Hole Drive, adjacent to said premises
to the center line thereof.
TOGETHER with all the right, title and interest of the parties of the first
part in and to waters and the land under water of Deep Hole Creek lying in front
of and adjoining the above described premises.
SUBJECT to the following covenants and restrictions:
1. That the purchasers shall not erect or permit to be erected on any lot
any buildings except one detached dwelling house for one family and one garage
for private use for said dwelling.
2. That no dwelling erected thereon shall cost less than $3,000.00.
3. That no part of any building or cesspool on any lot shall be less than
15 feet from said Deep Hole Drive and less than 5 feet from the side boundary
line of any lot.
4. No outside toilets or stables shall be erected or permitted to be
erected on any part of the premises and no fowl or pigs shall be kept on said
premises.
5. The parties of the second part shall not manufacture, sell or permit to
be manufactured or sold, on said premises any goods or merchandise of any kind,
and shall not carry on, or permit any business or trade whatsoever, upon said
premises, and will not carry on or permit any manner Of things which will be a nuisanc(
