THIS INDENTURE, made the 30th day of September nineteen hundred and ninety four

party of the second part,
WITNESSETH, that the party of the first part, in consideration of ten dollars and other valuable consideration
paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs
or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate,
lying and being in the

TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances
and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO
HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of
the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this conveyance and will hold the right to receive such consid-
eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply
the same first to the payment of the cost of the improvement before using any part of the total of the same for
any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indentpre so requires.

SCHEDULE A
PARCEL I
ALL that certain plot, piece or parcel of land lying and being in
the Village of Mattituck, Town of Southold, County of Suffolk and
State of New york, bounded and described as follows:
BEGINNING at a point on the southerly side of Westphalia Road at
the northeast corner of premises herein described and at the
northwest corner of a 50 foot private right of way and which
point of beginning is distant 1540.45 feet westerly from the
westerly side of Youngs Avenue; running thence along the westerly
side of the 50 foot private right of way South 15 degrees 55
minutes 20 seconds West 200 feet to land of C. A. Bennett Estate;
thence along said last mentioned land the following 3 courses and
distances: (1) North 74 degrees 04 minutes 40 seconds West
155.26 feet; (2) North 47 degrees 06 minutes 20 seconds East
58.44 feet; (3) North 15 degrees 55 minutes 20 seconds East 150
feet to the southerly side of Westphalia Road; thence along the
southerly side of Westphalia Road, South 74 degrees 04 minutes 40
seconds East 125 feet to the point or place of beginning.
TOGETHER WITH a right of way 50 feet in width along the easterly
boundary of said premises from the southerly corner of said
premises to Westphalia Avenue. The party of the first part
reserves the right to dedicate said right of way to the Town of
Southold for highway purposes. Until such dedication, however,
nothing herein contained shall obligate the party of the second
part to participate in the maintenance of said right of way.
BEING AND INTENDED TO BE the same premises conveyed to the
parties of the first part by deed dated May 9, 1962, and recorded
in the Office of the Clerk of the County of Suffolk in Liber 5165
of Conveyances at page 289 on May 15, 1962 .
PARCEL II
ALL that certain plot, piece or parcel of land, lying and being
at Mattituck, Town of Southold, Suffolk County, New York, bounded
and described as follows:
BEGINNING at a point on the southerly line of Westphalia Avenue
at the northeasterly corner of land conveyed by the party of the
first part to the party of the second part, from said point of
beginning running along said southerly line of Westphalia Avenue,
South 74 degrees 04 minutes 40 seconds East 25.0 feet; thence
along land conveyed or about to be conveyed by the party of the
first part to Harrison, South 15 degrees, 55 minutes 20 seconds
West, 442. 75 feet; thence along land conveyed or about to be
conveyed by the party of the first part to Harold R. Reeve &
Sons, Inc. , North 29 degrees, 22 minutes 50 seconds West, 287.87
feet; thence along land of LeValley, North 47 degrees, 06 minutes
20 seconds East, 47. 06 feet; thence along said land of the party
of the second part, two courses and distances as follows: (1)
South 74 degrees 04 minutes 40 seconds East, 155. 26 feet; thence
(2) North 15 degrees 55 minutes 20 seconds East, 200. 0 feet to
the point of beginning.
The premises described herein are adjacent to the premises
conveyed to the party of the second part herein by deed dated May
9, 1962 and recorded in Suffolk County Clerk's Office on May 15,
1962 in Liber 5165 of deeds at page 289, and both parcels shall
hereinafter be considered as one parcel.
BEING AND INTENDED TO BE the same premises conveyed to the
parties of the first part by deed dated November 30, 1965, and
recorded in the Office of the Clerk of the County of Suffolk in
Liber 5869 of Conveyances at Page 318 on December 2, 1965.
