TERMS AND CONDITIONS
The Permittee, Mark Baxter, residing at 5805 Main Bayview Rd., Southold, NY, as part of the
consideration for the issuance of the Permit does tmderstand and prescribe to the following:
That the said Board of Trustees and the Town of Southold are released from any and all
damages, or claims for damages, of suits arising directly or indirectly as a result of any
operation performed pUrsuant to this permit, and the said Permittee will, at his or her own
expense, defend any and all such suits initiated by third parties, and the said Permittee
assumes full liability with respect thereto, to the complete exclusion of the Board of
Trustees of the Town of Southold.
That this Permit is valid for a period of 24 months, which is considered to be the estimated
time required to complete the work involved, but should circumstances warrant, request for
an extension may be made to the Board at a later date.
That this Permit should be retained indefinitely, or as long as the said Permittee wishes to
mair!tain the structure or project involved, to provide evidence to anyone concerned that
authorization was originally obtained.
That the work involved will be subject to the inspection and approval of the Board or its
agents, and non-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
That there will be no unreasonable interference with navigation as a result of the work
herein authorized.
That there shall be no interference with the right of the public to pass and repass along the
beach between high and low water marks.
That if future operations of the Town of Southold require the rempval and/or alterations in
the location of the work herein authorized, or if, in the opinion of the Board of Trustees,
the work shall cause unreasonable obstruction to free navigation, the said Permittee will be
required, upon due notice, to remove or alter this work project herein stated without
expenses to the Town of Southold.
The Permittee il required to provide evidence that a copy of this Trustee permit has been
recorded with the Office of the Clerk of the County of Suffolk as a notice covenant and
deed restriction ~o the deed of the subject parcel. Such evidence shall be provided within
ninety (90) calendar days of issuance of this permit. ;
That the said Board will be notified by the Permittee of the completion 0fthe Work
authorized.

That the Permittee will obtain all other permits and consents that may be required
supplemental to this permit, which may be subject to revoke upon failure to obtain same.

Dear Mr. Baxter:
The Board of Town Trustees took the following action during its regular meeting held on
Wed., May 20, 2009 regarding the above matter:
WHEREAS, Young & Young on behalf of MARK BAXTER applied to the Southold
Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town
Code, the Wetland Ordinance, application dated December 1, 2008, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, the LWRP Coordinator recommended that the proposed application be
found Inconsistent with the LWRP, and,
WHEREAS, the Board of Trustees has furthered Policies 5, 5.2, 6, 6.1, 6.3, 9, and 9.4
of the Local Waterfront Revitalization Program to the greatest extent practical through
the imposition of the following Best Management Practice requirements: the reduction of
the size the footprint of the proposed dwelling, the elimination of the proposed
swimming pool and the proposed catwalk, the installation of gutters and drywells to
contain roof run-off in accordance with Chapter 236-Stormwater Management of the
Town Code, the installation of a line of staked hay bales and silt fencing along the limit
of cleating, grading and ground disturbance area prior to all construction activities, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on May 20, 2009, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the Standards set forth in Chapter 275 of the
Southold Town Code, and,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that for the mitigating factors and based upon the Best Management.
Practice requirements imposed above, the Board of Trustees deems the action to be
Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268-5
of the Southold Town Code, and,
RESOLVED, that the Board of Trustees approve the application of MARK BAXTER to
construct a single-family dwelling with garage, sanitary system, and driveway, with the
condition gutters and drywells are installed to contain the mol run-off in accordance with
Chapter 236-Stormwater Management of the Town Code, a line of staked hay bales
and silt fencing is installed along the limit of clearing, grading and ground disturbance
area prior to all construction activities, and as depicted on the survey prepared by
Howard W. Young, last dated April 24, 2009.
Permit to construct and complete'project will expire two years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.
Inspections are required at a fee of $50.00 per inspection. (See attached schedule.)

Located n/o Main Bayview Road, 325' e/o Smith Drive South; in SOUthold
SCTM#1000-78-7-5.3 and 5.4 Zoning District: R-40
Dear Mr. Baxter:
The Southold Town Planning Board, at a meeting held on Monday, October 16, 2006,
adopted the following resolutions:
WHEREAS, this standard subdivision proposes to subdivide a §,78-acre parcel into 2
lots where Lot 1 equals 4.4417 acres and Lot 2 equals 2.3841 acres, inclusive of the
wetlands; and
WHEREAS, an application for sketch approval was submitted on September 10, 2004;
and
WHEREAS, dudng the initial review of the application, the wetlands boundary was re-
flagged by the Town Trustees and a 50'~wide non-disturbance buffer was delineated on
the subdivision map; and
WHEREAS, on May 6, 2005, the Southold Town Planning Board received a
memorandum from the Town Trustees dated May 4, 2005 indicating that the subdivision
map was satisfactorily revised to show the amended wetlands line and a 50'-wide non-
disturbance buffer with the proposed structure to be outside of the Trustee's jurisdiction;
and
WHEREAS, on June 13, 2005, the Southold Town Planning Board granted conditional
sketch approval upon the map prepared by Howard Young, L.S. dated December 15,
2005 and last revised on December 22, 2005; and
WHEREAS, on June 13, 2005, the Southold Town Planning Board granted a Negative
Declaration for the project pursuant to SEQRA; and
WHEREAS, on August 1, 2005, the Southold Town Planning Board received comments
from the LWRP Coordinator; and

WHEREAS, on November 7, 2005, the Southold Town Planning Board granted conditional
preliminary plat approval upon the map prepared Howard Young, L.S, dated September 23,
2005; and
WHEREAS, on November 15. 2005, the applicant submitted eight (8) paper prints and five (5)
mylars of the final plat, prepared by Howard W, Young, L.S. dated June '10, 2002 and last
revised on November 14, 2005, each containing the Health Department stamp of approval; and
WHEREAS, on January 26, 2006, the applicant submitted the application and fee for final plat
approval; and
WHEREAS, on January 30, 2006, the applicant submitted one (1) copy of recorded Declaration
of Covenants and Restrictions as filed in the Office of the County Clerk; and
WHEREAS, the final public hearing was held for this application on February 13, 2006 where a
number of neighborhood residents objected to the proposal due to severe flooding problems on
the subject property and their concerns that the wetlands line was inaccurately delineated; and
WHEREAS, the opposition submitted photographs and written statements pertaining to their
concerns about the potential for increased flooding problems by the creation of another building
lot in a flood-prone area; and
WHEREAS, due to the considerable amount of evidence submitted to Planning Board, the
hearing remained open until July 10, 2006 in order to give the Board time to re-evaluate the site
conditions and ask the New York State Department of Environmental Conservation, the Suffolk
County Department of Health Services and the Southold Town Trustees to also re-evaluate the
site conditions and the permits/approvals they issued for the project; and
WHEREAS, on March 6, 2006, the applicant submitted the park and playground fee in the
amount of $7000; and
WHEREAS. April 24, 2006, the Southold Town Planning Board received a memorandum from
the Town Trustees indicating that the parcel was re-inspected and that the wetlands line as
shown on the final map is correct; and
WHEREAS, in the Spring of 2006, representatives from the New York State Department of
Environmental Conservation re-inspected the subject property and surrounding area, found no
changes to the wetlands boundary and therefore validated the permit issued by the agency on
March 26, 2003 (permit #1.-4738-03072/00001); and
WHEREAS, on July 17, 2006, the Suffolk County Department of Health Services submitted a
letter dated July 11, 2006 indicating that their approval for this project is valid based on the
Town's SEQRA Determination, the issuance of a NYSDEC wetlands permit and the filing of a
covenant to raise the grade of the site to accommodate the sanitary system; and

WHEREAS, in a letter dated July 11, 2006, the Suffolk County Department of Health
Services indicated that the project, as proposed, complies with the requirements of the
County's Sanitary Code; and
WHEREAS, on September 12, 2006, the Engineer for the project submitted a letter
dated September 11, 2006, indicating that the construction of a single-family residence
would not exacerbate the flooding problem and therefore would not have any
deleterious effects on the adjacent properties; and
WHEREAS, the Southold Town Planning Board has considered the comments and
evidence submitted by the neighboring property owners; and
WHEREAS, the applicant has complied with Chapter 240, Subdivision of Land, of the
Southold Town Code; be it therefore
RESOLVED, that the Southold Town Planning Board hereby grant Conditional Final
Plat Approval upon the map prepared by Howard W. Young, L.S. dated June 10, 2002
and last revised on November 14, 2005, subject to the following conditions as per the
LWRP Coastal Consistency Review:
a. Submission an Affidavit which states that the applicant is fully aware
that the parcel is located within the coastal barrier flood zone and that
the Planning Board has advised the applicant of the risks associated
with this designation and is requiring that the proposed structure
constructed within this area be designed to withstand and avoid
expected flooding to the greatest extent possible.
b. Submission of additional Covenants and Restrictions which limits
clearing on Lot 2 to 25,572 square feet and requires that the driveway
be constructed of pervious materials.
Upon fulfillment of the conditions, the Planning Board Chair is authorized to endorse the
maps. Upon endorsement by the Chairperson, the mylar maps must be picked up at
this office and filed in the Office of the Suffolk County Clerk. Any plat not so filed or
recorded within sixty-two (62) days of the date of map signing shall become null and
void.

At the meeting of the Southold Town Conservation Advisory Council held Wed., January
14, 2009, the following recommendation was made:
Moved by Jack McGreevy, seconded by Don Wilder, it was
RESOLVED to SUPPORT the Wetland Permit application of MARK BAXTER to construct
a single-family dwelling, sanitary system, driveway, pool, deck, foot path and 4'X 82' open
grate catwalk.
Located: 5805 Main Bayview Rd., Southold. SCTM#78-7-5.6
The CAC Supports the application with the Condition the driveway is relocated in order to
prevent removal of the large trees, and gutters and drywells are installed to contain run-
off.
The CAC also questions the height of the proposed catwalk.

The Land Preservation Committee and Town Board reviewed your offer to
sell the above mentioned property to the Town for preservation purposes. It is
understood that the property is on the market for $475,000 and that you are
willing to sell the property for something close to the asking price.
The Land Preservation Committee and Town Board reviewed the property
in regard to pumhasing it for open space purposes. Both the Committee and the
Town Board believe that there are environmental and public benefits to
preserving the property; however the Town does not feel that spending $475,000
to purchase it is cost effective or in the best interest of the Town. The Town
Board would be willing to discuss a purchase of the property at a significantly
reduced purchase price of approximately $60,000, assuming that this value is
supported by an appraisal.

THE FOLLOWING SECTION ADDRESSES THE PROPOSED HOUSE AND SWIMMING POOL:
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town
Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided
on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to us, it is our
recommendation that the proposed action is INCONSISTENT with LWRP policy standards and therefore is
INCONSISTENT with the LWRP.
6.3 Protect and restore tidal and freshwater wetlands.
Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and
regulations for all Andros Patent and other lands under their jurisdiction
1. Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions.
The setback from the wetland boundary to the proposed actions (single-family dwelling~ sanitary system and
driveway) is less than 100 feet; a minimum setback distance of 100' from the wetland line is required pursuant to
Chapter 275-3. Findings; purpose; iurisdiction; setbacks.
§ 275-3 Findings; purpose; jurisdiction; setbacks.
D. Setbacks.
(1) The following minimum setbacks apply to any and all operations proposed on residential property within the
jurisdiction of the Board of Trustees:
(a) Wetland boundary.
[1] Residence: 100 feet.
[2] Driveway: 50 feet.
[3] Sanitary leaching pool (cesspool): 100 feet.
[4] Septic tank: 75 feet.
[5] Swimming pool and related structures: 50 feet.
[6] Landscaping or gardening: 50 feet.
[7] Placement ofC & D material: 100 feet.
Further~ pumuant to § 275-6 the applicant must show all wetlands within a two-hundred-foot radius of the area
from which the removal or in which the deposit of materials is proposed~ or in which structures are to be erected~
certified by a registered land surveyor or registered professional engineer~ licensed by the State of New York.
§ 275-6 Application.
A. Contents of application. A permit may be issued upon the written, verified application of the person proposing to
perform operations on wetlands. Three copies of the complete application, including all written descriptions, pictures and
surveys, shall be submitted to the Clerk. Such application shall contain the following information: [Amended 10-11-2005
by L.L. No. 17-2005]
(8) Such application shall be accompanied by a survey and topographical map, created no more than one year prior
to the date of application, with contours at two-foot intervals, showing all wetlands within a two-hundred-foot
radius of the area from which the removal or in which the deposit of materials is proposed, or in which
structures are to be erected, certified by a registered land surveyor or registered professional engineer,
licensed by the State of New York. Such survey and topographical map shall show the soundings of the area
in which operations are proposed to be conducted. The horizontal control of said survey shall be based on an
approved local coordinate system. The vertical control for elevations shall be based on the United States Coast
and Geodetic Survey datum.
The sanitary system as proposed will involve grade changes ~0the subiect parcel and construction of a permanent
concrete water wall which may alter the existing storm water drainage patterns therefore redirecting storm water
flow to the neighboring properties to the South~ South East and West.
Policy 5 Protect and improve water quality and supply in the Town of Southold.
5.2 Minimize non-point pollution of coastal waters and manage activities causing nonpoint pollution..
2t. Minimize non-point pollution of coastal waters using the following approaches, which are presented in order of
priority.
1. Avoid non-point pollution by limiting non-point sources.
b. Avoid activities which would increase off-site stormwater runoff and transport of pollutants.
c. Control and manage stormwater runoff to:
· achieve no net increase of runoff where unimpaired stormwater runoff conditions exist
e. Preserve natural hydrologic conditions.
Pursuant to § 275-11 the applicant may be required to submit a drainage plan for the entire site detailing how all
surface waters generated from impervious surfaces shall be kept onsite through infiltration or retention pursuant
to § 275-11 as referenced below.
§ 275-11 Construction and °P~kti°n~r standards. ~r~h
A. General. The following standards are required for all operations wit in
the
jurisdiction
of
the
Trustees:
(1) Drainage upgrade. Applicants for a permit for any form of construction may be required to Upgrade the site's
drainage system such that all surface water generated from impervious surfaces shall be kept onsite through infiltration or
retention. Applicants proposing grading or filling operations will be required to submit a drainage plan for the entire site
at the discretion of the Trustees. See § 275-6A (14) for requirements.

(14) Drainage upgrade. At the discretion of the Board, nonadministrative applications may require submittal of a
drainage upgrade plan. This plan must indicate how all existing and proposed on-site drainage from a two-inch rainfall is
retained within the subject parcel landward of the wetland boundary. Retention can include but is not limited to
infiltration or impoundment. All drainage plans shall show the calculations used to develop the plan. At the discretion of
the Board said plans may require certification from a licensed engineer.
If the Agency~ (Board of Trustees) makes a contrary determination of consistenc% the Agency shall elaborate in
writing the basis for its disagreement with their recommendations Pursuant to Chapter 268 Waterfront
Consistency Review.
§ 268-5. Review of actions.
In the event the LWRP Coordinator's recommendation is that the action is inconsistent with the LWRP, and the
agency makes a contrary determination of consistency, the agency shall elaborate in writing the basis for its
disagreement with the recommendation and state the manner and extent to which the action is consistent with the
L WRP policy standards.

CRITICAL ENVIRONMENTAL AREAS -- All sites previously nominated by the Town of SouthoM and designated by
the New York Sate Department of state as Critical Environmental Areas worthy of protection including: Cutchogue
Harbor Wetlands, Hallock's Bay, Dam Pond, Downs Creek, Orient Creek, West Creek, Richmond Creek and Beach,
Brush's Creek, Cedar Beach Creek, Corey Creek, Deep Hole Creek, Goldsmiths Inlet, Hails Creek, Goose Creek, Little
Creek, Mill Creek and Pipes Cove Creek.
§ 275-11 Construction and operation standards.
(7) Critical environmental areas. At the discretion of the Board of Trustees, any operations proposed in critical
environmental areas (§ 275-2) may be subject to more stringent requirements than detailed in this section. Such
requirements may include, but are not limited to, denial of certain operations, shortening or reducing the size of
structures, and increasing the width of nondisturbance buffers.
The applicant must demonstrate that the following dock standards pursuant to § 275-11 Construction and
operation standards have been met.
§ 275-11
(2) Docks.
Review and approval of dock applications. Before issuing a permit for a dock structure, the Trustees shall
consider whether the dock will have any of the following harmful effects:
[1] Whether the dock will impair navigation or be located in areas of high vessel traffic or vessel congestion;
[2] Whether the dock will unduly interfere with the public use of waterways for swimming, boating, fishing,
shellfishing, waterskiing and other water-dependant activities;
[3] Whether the dock will unduly interfere with transit by the public along the public beaches or foreshore;
[4] Whether the dock will significantly impair the use or value of waterfront property adjacent to or near the dock;
[5] Whether the dock will cause degradation of surface water quality and natural resources;
[6] Whether the dock will cause habitat fragmentation and loss of significant coastal fish and wildlife habitats;
The proposed docking facility if approved will result in habitat fragmentation and impairment with the
physical loss of fish and wildlife habitat within a Critical Environmental Area. If the dock is constructed
the loss of high and Iow intertidal marsh habitats will occur. The proposed action and associated impacts
could be mitigated by seasonally mooring a vessel in public waters. This alternative would lessen the
potential impacts to the habitat within Goose Creek a Critical Environmental Area.
[7] Whether the dock will result in the destruction of or prevent the growth of vegetated wetlands, seagrasses
including eelgrass (Zostera marina) and widgeon grass (Ruppia maritima) or shellfish;
[8] Whether the dock will unduly restrict tidal flow or water circulation;
[9] Whether the dock will be safe when constructed;
[10] Whether the d~ck will adversely a~ect views~ viewsheds and vistas imp~rtant t~ the c~mmunity~.
[11] Whether the cumulati]~mpacts of a residential and commercii~dock will change the waterway or the
environment and whet~alternate design, construction, and loc~n of the dock will minimize cumulative
impacts; and
[12] Whether adequate facilities are available to boat owners and/or operators for fueling, discharge of waste and
rubbish, electrical service and water service.
Policy 6 Protect and restore the quality and function of the Town of Southold ecosystem.
6.1 Protect and restore ecological quality throughout the Town of Southold.
B. Protect and restore ecological quality by adhering to the following measures.
3. Avoid fragmentation of ecological communities and maintain corridors to facilitate the free exchange of biological
resources within and among communities.
a. Each individual resource area should be maintained as' complete contiguous areas to protect the area's natural
resource values. Specifically, actions that would fragment the ecological community into separate ecological islands
should be avoided
b. Where fragmentation of ecological communities has already occurred, the adverse effects of fragmentation can be
mitigated by maintaining or providing connecting corridors to allow exchange of biological resources.
Habitat fragmentation can be avoided through other public land access alternatives such as vessel moorings. The
action, as proposed, will result in thi~ continued fragmentation of a Critical Environmental Area. If approved~ the
proposed action will result in the physical loss of habitat within Goose Creek an ecological sensitive area.
Policy 9 Provide for public access to, and recreational use of, coastal waters, public lands, and public resources of
the Town of Southoid.
The proposed action is private, noncommercial and will not support a pattern of development that enhances
community character nor preserves "Public" access or public recreational activities
Policy Standard 9.4 Assure public access to public trust lands and navigable waters.
A. Provide free and substantially unobstructed passage along public trust shorelands.
E. Provide access to, and reasonable recreational use of, navigable waters and public trust lands under water.
3. Obstruction of navigable waters and underwater lands is limited:

The applicant currently enioys access to Goose Creek through an established walking path. The applicant also
has an alternate means of access to Goose Creek via the Town's boat ramp off Gagen's Landing Rd.

and devoid of any man-made structure, to provide a walkway to a body of water.

b. to minimize the loss of navigable waters and use of underwater lands.
c. to minimize the fragmentation, impairment and physical loss of wetland habitat.

I am writing in response to your letter in which you eq~s-[ that the Health Department re-
evaluate this project.
As you arc aware, thc Office of Wastcwatcr Management granted approval for this subdivision
on January 27, 2006. This approval was granted based upon thc following conditions: Town
SEQRA was received for the project, NYSDEC wetlands permit was issued for the project, and a
covenant to raise thc grade of the site to accommodate the sanitary system was placed upon the
property. It is now come to our attention that the town will not allow the use of fill to raise the
grade at this site. Staff has spoken to a representative of the town and is presently awaiting
written confwmation of this fact. Once received, thc conditions under which the approval was
granted will be impossible to meet and the Health Department approval will be suspended until
such time that the requirements of the Sanitary Code are met.

SPECIAL CONDITIONS
1. During construction, concrete or leachate shall not escape or be discharged, nor shall washings from transit mix
trucks, mixers, or other devices enter tidal wetlands and/or protected buffer areas,
2. Any debris or excess material from construction of this project shall be completely removed from the adjacent area
and removed to an approved upland area for disposal, No debris is permitted in tidal wetlands or protected buffer areas,
3. There shall be no disturbance to vegetated tidal wetlands or protected buffer areas as a result of the permitted
activities.
4, All areas of soil disturbance resulting from the appreved project shall be stabilized with apprepriate vegetation
(grasses, etc.) immediately following project completion or prior to permit expiration, whichever comes first. If the
project site remains inactive for more than 48 hours or planting is impractical due to the season, then the area shall be
stabilized with straw or hay mulch or jute matting until weather conditions favor germination.
5. The storage of construction equipment and materials shall be confined within the project work area and/or upland
areas greater than 75 linear feet from the tidal wetland boundary,
6. All disturbed areas where soil will be temporarily exposed or stockpiled for longer than 48 hours shall be contained
by a continuous line of staked haybales / silt curtains (or other NYSDEC approved devices) placed on the seaward side
between the fill and the wetland or protected buffer area. Tarps are authorized to supplement these approved methods.
7. Cover material used for the footpath is limited to natural wood/bark chips, stone, gravel or sand.
8. The use of wood treated with pentachlorophenol or other wood treatment not specifically approved by the Department
for use in wetlands and/or marine waters, is strictly prohibited in the construction of structures that will be in contact with
tidal waters.
9. This permit does not authorize the installation of floats.
10. The authorized structure is provided for access to the waterway and is not intended for the mooring or launching
of vessels. Prop dredging, resulting from motorized vessels intentionally powering in shallow waters, is a regulated
activity and is not authorized by this permit.
11. To protect the values of the tidal wetlands, a permanent vegetated buffer zone shall be established. There shall be
no disturbance to the natural vegetation or topography within an area extending 50 linear feet landward of the tidal
wetland boundary.
12. A row of staked haybales or other approved erosion contrel devices shall be placed as per the NYSDEC appreved
plan, prior to commencement of any regulated activities and remain in place and in good, functional condition until the
project is completed and all disturbed areas are stabilized with vegetation.
't 3. Roof runoff shall be directed into dry wells a minimum of 75 linear feet landward of the tidal wetland boundary for
immediate on-site recharge.
'14. Dry wells for pool filter backwash shall be located a minimum of 75 linear feet landward of the tidal wetland
boundary.
'~ 5. There shall be no draining of swimm lng pool water directly or indirectly in tidal wetlands or protected buffer areas.
16, Driveways and parking areas shall be constructed of NYSDEC approved pervious materials.
17. Roads, driveways and parking areas shall be graded to direct runoff away from tidal wetlands and protected buffer
areas.
18. Sanitary systems (bottom of the tank and leaching pools) shall be located a minimum of 2' above seasonal high
groundwater.
19. At least 48 hours prior to commencement of the project, the permittee and contractor shall sign and return the top
portion of the enclosed notification form certifying that they are fully aware of, and understand all terms and conditions
of, this permit. Within 30 days of corn pletion of project, the bottom portion of the form must also be signed and returned,
along with photographs of the completed work.

If future operations by the State of New York require an alteration in the position of the structure or work herein
authorized, or if, in the opinion of the Department of Environmental Conservation it shall cause unreasonable
obstruction to the free navigation of said waters or flood flows or endanger the health, safety or welfare of the people
of the State, or cause loss or destruction of the natural resources of the State, the owner may be ordered by the
Department to remove or alter the structural work, obstructions, or hazards caused thereby without expense to the
State, and if, upon the expiration or revocation of this permit, the structure, fill, excavation, or other modification of
the watercourse hereby authorized shall not be completed, the owners, shall, without expense to the State, and to
such extent and in such time and manner as the Department of Environmental Conservation may require, remove
all or any portion of the uncompleted structure or fill and restore to its former condition the navigable and flood
capacity of the watercourse. No claim shall be made against the State of New York on account of any such removal
or alteration.
2. The State of New York shall in no case be liable for any damage or injury to the structure or work herein authorized
which may be caused by or result from future operations undertaken by the State for the conservation or
improvement of navigation, or for other purposes, and no claim or right to compensation shall accrue from any such
damage.
3. Al! necessary precautions shall be taken to preclude contamination of anywetland or waterway by suspended solids,
sediments, fuels, solvents, lubricants, epoxy coatings, paints, concrete, leachate or any other environmentally
deleterious materials associated with the project.
4. Any material dredged in the conduct of the work herein permitted shall be removed evenly, without leaving large
refuse piles, ridges across the bed of a waterway or floodplain or deep holes that may have a tendency to cause
damage to navigable channels or to the banks of a waterway.
5. There shall be no unreasonable interference with navigation by the work herein authorized,
If upon the expiration or revocation of this permit, the project hereby authorized has not been completed, the
applicant shall, without expense to the State, and to such extent and in such time and manner as the Department
of Environmental Conservation may require, remove all or any portion of the uncompleted structure or fill and restore
the site to its former condition. No claim shall be made against the State of New York on account of any such
removal or alteration.
If granted under 6NYCRR Part 608, the NYS Department of Environmental Conservation hereby certifies that the
subject project will not contravene effluent limitations or other limitations or standards under Sections 301,302, 303,
306 and 307 of the Clean Water Act of 1977 (PL 95-217) provided that all of the conditions listed herein are met.
8. At least 48 hours prior to commencement of the project, the permittee and contractor shall sign and return the top
portion of the enclosed notification form certifying that they are fully aware of and understand all terms and
conditions of this permit. Within 30 days of completion of project, the bottom portion of the form must also be
signed and returned, along with photographs of the completed work and, if required, a survey.
9. All activities authorized by this permit must be in strict conformance with the approved plans submitted by the
applicant or his agent as part of the permit application.

Item A: . Permittee Accepts Legal Responsibility and Agrees to Indemnification
' The permittee, excepting state or federal agencies, expressly agrees to indemnify and hold harmless the Department
of Environmental Conservation of the State of New York, its representatives, employees, and agents ("DEC") for all claims,
suits, actions, and damages, to the extent attributable to the permittee's acts or omissions in connection with the permittee's
undertaking of activities in connection with, or operation and maintenance of, the facility or facilities authorized by the permit
whether in compliance or not in compliance with the terms and conditions of the permit. This indemnification does not
extend to any claims, suits, actions, or damages to the extent attributable to DEC's own negligent or intentional acts or
omissions, or to any claims, suits, or actions naming the DEC and arising under article 78 of the New York Civil Practice
Laws and Rules or any citizen suit or civil rights provision under federal or state laws.
Item B: Permittee's Contractors to Comply with Permit
The permittee is responsible for informing its independent contractors, employees, agents and assigns of their
responsibility to comply with this permit, including all special conditions while acting as the permittee's agent with respect
to the permitted activities, and such persons shall be subject to the same sanctions for violations of the Environmental
Conservation Law as those prescribed for the permittee.
Item C: Permittee Responsible for Obtaining Other Required Permits
The permittee is responsible for obtaining any other permits, approvals, lands, easements and rights-of-way that may
be required to carry out the activities that are authorized by this permit.
Item D: No Right to Trespass or Interfere with Riparian Rights
This permit does not convey to the permittee any right to trespass upon the ~ands or interfere with the riparian rights of
others in order to perform the permitted work nor does it authorize the impairment of any rights, title, or interest in real or
personal property held or vested in a person not a party to the permit.
GENERAL CONDITIONS
General Condition 1: Facility Inspection by the Department
The permitted site or facility, including relevant records, is subject to inspection at reasonable hours and intervals by an
authorized representative of the Department of Environmental Conservation (the Department) to determine whether the
permittee is complying with this permit and the ECL. Such representative may order the work suspended pursuant to ECL
71-0301 and SAPA 401(3).
The permittee shall provide a person to accompany the Department's representative during an inspection to the permit
area when requested by the Department.
A copy of this permit, including all referenced maps, drawings and special conditions, must be available for inspection
by the Department at all times at the project site or facility. Failure to produce a copy of the permit upon request by a
Department representative is a violation of this permit.
General Condition 2: Relationship of this Permit to Other Department Orders and Determinations
Unless expressly provided for by the Department, issuance of this permit does not modify, supersede or rescind any
order or determination previously issued by the Department or any of the terms, conditions or requirements contained in
such order or determination.
General Condition 3: Applications for Permit Renewals or Modifications
The permittee must submit a separate written application to the Department for renewal, modification or transfer of this
permit. Such application must include any forms or supplemental information the Department requires. Any renewal,
modification or transfer granted by the Department must be in writing.
The permittee must submit a renewal application at least:
a) 180 days before expiration of permits for State Pollutant Discharge Elimination System (SPDES), Hazardous
Waste Management Facilities (HWMF), major Air Pollution Control (APC) and Solid Waste Management
Facilities (SWMF); and
b) 30 days before expiration of all other permit types.
Submission of applications for permit renewal or modification are to be submitted to:

General Condition 4: Permit Modifications, Suspensions and Revocations by the Department
The Department reserves the right to modify, suspend or revoke this permit in accordance with 6 NYCRR Part 621. The grounds
for modification, suspension or revocation include:
a) materially false or inaccurate statements in the permit application or suppoding papers;
b) failure by the permittee to comply with any terms or conditions of the permit;
c) exceeding the scope of the project as described in the permit application;
d) newly discovered material information or a material change in envirenmental conditions, relevant technology or applicable
law or regulations since the issuance of the existing permit;
e) noncompliance with previously issued permit conditions, orders of the commissioner, any previsions of the Environmental
Conservation Law or regulations of the Department related to the permitted activity.

I am writing in regards to the property of MARK BAXTER lot gtwo.
It is my understanding that the Board of Trustees has approached the Dept of Land
Preservation to release funds so the town can acquire this property, and keep it forever
wild. I would strongly encourage this endeavor.
I have been a resident of 5485 Main Bayview Road for over sixty years I have know this
land as only wetlands. Years ago eelgrass covered the area. Because of the dredging that
has replaced by phragmites both of these grasses grow only on wetlands.
In this era of thinking "Green" we all have become more aware of the importance of good
stewardship towards our environment as attested by Mark Terry and Scott Itilary any
construction on this land would have a negative impact on the surrounding properties and
Goose Bay.
It is my sincere hope that this land will remain forever wild and our precious wetlands are
kept safe.

Dear Sir or Madam:
We are writing in response to the certified letter notifying us of the board's review of the proposed
construction of a dwelling adjacent to my pmpeAy. The owners name is Mark Baxter, SCTM
1000-78-7-5.6.
We am deeply concerned about the increased flood risk and the resultant devaluation this will
have on our property. The property identified as "Lot 2 Mark Baxter" in the Board of Trustees
letter is susceptible to severe flooding in a storm event. This fact was well documented by photos
and testimony provided by adjoining neighbom during a Southold public hearing held in the spring
of 2006. This documentation can be provided at your request. According to the proposed site
development plan, prepared by Young & Young Surveyors, the proposed high water wall Mr.
Baxter plans to build for his septic system and the elevated access driveway will create a pooling
affect on my properly dudng a storm event and prevent the natural seaward drainage that
currently exista. This inevitable flooding will cause damage to my property and create an undue
financial burden to me.
In addition, Mr. Baxte(s proposed 5 bedroom house will obscure my view-shed of Goose Creek
that my family has enjoyed for over 60 years. When my family purchased the property at 5485
Main Bayview Rd the property behind us was by all accounts a wetland based on habitat and
vegetation. Characterized as a wetland, the land could not be developed. This unrestricted view
of the water provided a greater valuation of my pmperty. Development of the subject property will
obscure the waterfront view from my property and decrease its value.
I would also like to call to your attention that the site plan we were provided does not indicate that
"Lot 2 Mark Baxter" is waterfront property. To my knowledge Lot 2 does have clear access to
Goose Creek, and should be considered watenYont property. Therefore, any development of the
properly requires review and approval by the Department of Environmental Conservation.
Lastly, given the damaging effects that this proposed land development will have on our properly
we are compelled to notify you that if my property is damaged by flood waters, to a degree that the
property would not have of othenMse experienced, we will hold the Town and the property owner
of'Lot 2 Mark Baxter" legally responsible.

Here is a copy of the LWRP submitted by LWRP coordinators, Mark Terry and Scott
Hilary to the Board of Trustees.
Their recommendations to the Board states that,
1. The proposed action is INCONSISTENT with LWRP.
2. The setback f~om the wetlands is less then 100 feet.
3. The sanitary system will involve grade changes which may alter existing storm water
drainage, effecfing neighboring properties.
Also addressed is that Goose Creek is a Critical Environmental Area, and many other
importan! facts that validate my concerns as well as my neighbors.
However, even with this information Mr. Ghosio, (Mr Bergen agrees) feels that the board
must issue a permit because Mr. Baxter has three letters from the previous Board of Trustees
approving his sub-division and has been working on this project for seven years.
Mr. Ghosio was asked by board member Peggy Dickerson, if he could live with his
decision even though LWRP has presented new information indicating a permit should not be
given. His response was yes.
What is this saying to the people in the Town of Southold. Keep trying eventually
someone will make a mistake and you'll get what you want whether it is right or wrong. There is
a reason why it has taken Mr. Baxter seven year to get where he is today. And it's not because
this project will have no effect on the wetlands and surrounding property as Mr. Baxter states.
Mr. Ghosio job is to protect our wetlands, NOT DESTROY THEM.

We the undersigned are strongly opposed to the proposed subdivision of SCTM#
1000-78-7-5.3 & 5.4 by Mark Baxter. Our opposition is based on the following reasons
and concerns.
* The area in question (Lot 2) is frequently flooded during storm weather and
has been flooded at least twice during the last six months. These floods
occurred in November 2005 and February 12, 2006. Flooding on Lot 2 in the
area of the proposed house and sanitary system was between 1-3 feet deep
during these storms. (Please refer to pictures submitted from February 12,
2006 to verify.)
· We are concerned that the proposed sanitary system will leak into the ground
water of the wetlands. The area of the proposed house and sanitary system
abut (to the north) land owned by Joel W. Warner Jr. and this land consists of
phragmites where the land is often water soaked even during dry weather.

· We are gravely concerned that any grading and/or elevation of the land on
the proposed site will subject neighboring properties to additional flooding to
these properties. Furthemxore we are concerned that grading and/or elevation
will subject the neighboring properties to standing water on these properties
due to a lack of drainage.
· We propose that storm water runoff will not be able to be contained on the
property secondary to flooding and the close proximity of the wetlands.
· We propose that the test hole dug for this subdivision which shows sand and
loam to a depth of one foot and grey "clay" from one to five feet constitutes a
wetland (hydrie) soil. ,
· We are also concerned as to whether Mr. Baxter had the correct permit to
'~now" the phragmltes on this land down to ground level.
· We are also concerned that considering that Goose Creek is labeled a critical
environmental area, a negative declaration SEQRA should not have been
issued without an Environmental Impact Assessment.
· We propose that the area in question constitutes a Class 1 wetland secondary
to the fact that a substantially developed area may be subject to significant
additional flooding should the area be modified.
· We propose that this area constitutes a critical environmental area which
may contain endangered and/or threatened plant and animal species.
We request that the Planning Board carefully reviews the Tidal Wetland- Land
Use Regulations set forth in 6 NYCRR Part 661 and the Tidal Wetlands Act and we
call for the planning board to consider our concerns in Ol~posing this subdivision.

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town
Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided
on the LWRP ConSistency Assessment Form submitted to this department, as well as the records available to us, it is our
recommendation that the proposed action is INCONSISTENT with LWRP policy standards and therefore is
INCONSISTENT with the LWRP.
6.3 Protect and restore tidal and freshwater wetlands.

The setback from the wetland boundary to the proposed actions (single-family dwelling, sanitary system and
driveway) is less than 100 feet; a minimum setback distance of 100' from the wetland line is required pursuant to
Chapter 275-3. Findings; purpose~ iurisdiction~ setbacks.
§ 275.3 Findings; purpose; jurisdiction; setbacks.
D. S~tbacks.
(1) The following minimum setbacks apply to any and all operations proposed on residential property within the
jurisdiction of the Board of Trustees:
(a) Wetland boundary.
Residence: 100 feet.
Drive(ray: 50 feet.
Sanitary leaching pool (cesspool): 100 feet.
Septic tank: 75 feet.
'Swimming pool and related structures: 50 feet.
Landscaping or g~dening: 50 feet.
Placement ofC & D material: 100 feet.

§ 275-6 Application.
A. Contents of application. A permit may be issued i~pon the written, verified application of the person proposing to
perform operatiOns on wetlands. Three copies of the complete application, including all written descriptions, pictures and
surveys, shall be submitted to the Clerk. Such application shall contain the following information: [Amended 10-11-2005

Such application shall be accompanied by a survey and topographical map, created no more than one year prior
to the date of application, with contours at two-foot intervals, showing all wetlands within a two-hundred-foot
radius of the area from which the removal or in which the deposit of materials is proposed, or in which
structures are to be erected, certified by a registered land surveyor or registered professional engineer,
licensed by the State of New York. Such survey and topographical map shall show the soundings of the area
in which operations are proposed to be conducted. The horizontal control of said survey shall be based on an
approved local coordinate system. The vertical control for elevations shall be based on the United States Coast
and Geodetic Survey datum.
The sanitary system.as proposed will involve grade changes ~]0th~ sub[eot parcel and construction of a permanent
concrete water wall which may alter the existing stotm water draina~.e patterns therefore redirecting storm water
flow to the neighboring properties to the South, South East and West.
Policy 5 Protect and improve water quality and supply in the Town of Southold.
5.2 Minimize non-point pollution of coastal waters and manage activities causing nonpoint pollution.
A. Minimize non-potnt pollution of coastal waters using the following approaches, which are presented in order of
priority.
1. Avoid non-point pollution by limiting non-point sources.
b. Avoid activities which would increase off-site stormwater mnoffand transport of pollutants.
c. Control and manage stormwater mnoffto:
· achieve no net increase of runoff where unimpaired stormwater runoff conditions exisl
e. Preserve natural hydrologic conditions.
Pursuant to § 275-11 the applicant may be required to submit a drainage plan for the entire site detailing how all
surface waters generated from impervious surfaces shall be kept onsite through infiltration or retention pursuant
to § 275-11 as referenced below;
§ 275-11 Construction and ope."~tion standards.
A. General. The following standards are required for all operations within the jurisdiction of the Trustees:
(1) Drainage upgrade. Applicants for a permit for any form of construction may be required to tipgrade the site's
drainage system such that all surface water generated from impervious surfaces shall be kept onsite through infillxation or
retention. Applicants proposing grading or filling operations will be required to submit a drainage plan for the entire site
at the discretion of the Trustees. See § 275-6A (14) for requirements.
§ 275-6 Application.
A. Contents of application. A permit may be issued upon the written, verified application of the person proposing to
perform ~opera.tions on wetlands. Three copies of the complete application, including all written descriptions, pictures and
surveys, shall be submitted to the Clerk. Such application shall contain the following information:
(14) Drainage upgrade. At the discretion of the Board, nonadministrative applications may require submittal of a
drainage upgrade plan. This plan must indicate how all existing and proposed on-site drainage from a two-inch rainfall is
retained within the subject parcel landward of the wetland boundary. Retention can include but is not limited to
infiltration or impoundment. All drainage plans shall show the calculations used to develop the plan. At the discretion of
the Board said plans may require certification from a licensed engineer.
If the Agency~ (Board of Trustees) makes a contrary determination of consistene3'~ the Agency shall elaborate in
writing the bakis for its disagreement with their recommendations Pursuant to Chapter 268 Waterfront
Consistency Review.
§ 268-5. Review of actions.
IL. In the event the LWRP Coordinator's recommendation is that the action is inconsistent with the LWRP, and the
agency makes a contrary determination of consistency, the agency shah elaborate in writing the basis for its
disagreement with the recommendation and state the manner and extent to which the action is consistent with the
LWRP policy standards.

Harbor Wetlands, Hatlock's Bay, Dam Pond, Downs Creek, Orient Creek, West Creek, Richmond Creek and Beach,
Brush's Creek, Cedar Beach Creek, Corey Creek, Deep Hole Creek, Goldsmiths Inlet, Hall~ Creek~ Goose Creek, Little
Creek, Mill Creek and Pipes Cove Creelc
§ 275-11 Construction and operation standards.
(7) Critical environmental areas. At the discretion bf the Board of Trustees, any operations proposed in critical'
environmental areas (§ 275-2) may be subject to more stringent requirements than detailed in this section. Such
requirements may include, but are not limited to, denial of certain operations, shortening or reducing the size of
structures, and increasing the width.of nandisturbance buffers.
The applicant must demonstrate that the following dock standards pursuant to § 275.11 Construction and
operation standards have been met.

Docks.
Review and approval of dock applications. Before issuing a permit for a dock structure, the Trustees shall
consider whether the dock will have any of the following harmful effects:
Whether; the dockwill impair navigation or be located in areas of high vessel traffic or vessel congestion;
Whether the dock will unduly interfere with the public use of waterways for swimming, boating, fishing,
shellfishing, Waterskiing and other water-dependant activities;
Whether the dock will undidy interfere with transit by the public along the public beaches or foreshore;
Whether the dock will significantly impair the use or value of waterfront property adjacent to or near the dock;
Whether the dock will cause degradation of surface water quality and natural resources;
Whether the dock will cause habitat fragmentation and loss of significant coastal ftsh and wildlife habitats;
The proposed docking facility if approved will result in habitat fragmentation and impairment with the
physical loss offish and wildlife habitat within a Critical Environmental Area. If the dock is constructed
the loss of high and Iow intertidal marsh habitats will occur. The proposed action and associated impacts
could be mitigated by seasonally mooring a vessel in public waters. This alternative would lessen the
potential impacts to the habitat within Goose Creek a Critical Environmental Area.
[7] Whether the docl~ will result in the destruction of or prevent the growth of vegetated wetlands, ~eagrasses

B. Protect and restore ecological quality by adhering to the following measures~

resources within and among communities.
a. Each individual resource area should be maintained as complete contiguous areas to protect the area's natural
resource values. Specifically, actions that would fragment the ecological community into separate ecological islands
should be avoided.
b. Where fragmentation of ecological communities has already occurred the adverse effects of fragmentation can be
mitigated by maintaining or providing connecting corridors to allow exchange of biological resqurces.
Habitat fragmentation can be avoided through other public, land access alternatives such as vessel moorings. The
action, as proposed~ will rgsult in thi~ continued fragmentation of a Critical Environmental Area. If approved~ the
proposed action will result in the physical loss of habitat within Goose Creek an ecological sensitive aro~-

c. to minimize the fragmentation, impairment and physical loss of wetland habitat.

DECLARATION OF COVENANTS AND RESTRICTIONS
This DECLARATION is made and dated the Ill'day of November, 2005 by Mark
Baxter and Jacqueline Baxeter,residing at 5805 Main Bayview Road, Southold, NY 11971.
Herein referred to as the DECLARANT.
WITNESSETH:
WHEREAS, the DECLARANT is the owner of a certain real property situate on the
northeasterly side of Main Bayview Road, Town of Southold, Suffolk County, New York,
more particularly bounded and described in Schedule "A" attached hereto (hereinafter
referred to as the Property); and
WHEREAS, the DECLARANT has made an application for and has received conditional
approval from the Planning Board of the Town of Southold to subdivide said property into
two (2) Iota, as shown on the Subdivision Map of Mark Baxter prepared by Young & Young,
Land Surveyors last dated January 18, 2004 which map will be filed herewith in the Office
of the Suffolk County Clerk; and
WHEREAS, for and in consideration of the granting of said approval, the Planning Board
of the Town of Southold has deemed it to be in the best interests of the Town of Southold
and the owners and prospective owners of said lots that the within Covenants and
Restrictions be imposed on said lots 1 and 2, and as a condition of said approval, said
Planning Board h~s required that the within Declaration be recorded in the Suffolk County
Clerk's Office; and
WHEREAS, the Declarant has considered the foregoing and b~s determined that the same
will be for the best interests of the DECLARANT ans subsequent owners of said parcel;
NOW, THEREFORE, THIS DECLARATION WITNESSETH:
That the DECLARANT, for the purpose of carrying out the intentions above expressed, does
hereby make known, admit, publish, covenant and agree that the sail lots within said
subdivision map shall hereafter be subject to the following covenants and restrictions' as
herein cited, which shall nm with the land and shall be binding upon all purchasers, lot
owners and holders of said Property, their heirs, executors, administrators, legal
representatives, distributees, successors and assigm, to wit:

There shall be no further subdivision of Lots land 2. No lot lines shall be
changed unless authorized by the Town Planning Board.
No structure or sanitary disposal facility shall be constructed or otherwise
located wiihln 100 feet of the top of the wetlands as designated on the
subdivision map.
3)
There shall be a 50' non-disturbed buffer adjacent to the wetland boundary on
the subject premises as shown on the subdivision map approved by the
Planning Board.

Storm-water resulting from the development and improvement or use of Lots
1 and 2 of such subdivision map shall be retained and disposed of on site. No
storm-water shall be discharged to public lands or waters.
Prior to the commencement of any construction activity on lots 1 and 2
NYSDEC SPEDS General Permit must be secured and submitted.
This declaration of covenants shall run with the land and shall be binding upon the owner and
his distributees, executors, administrators, successors and assigns, and upon all persons or
entities claiming under them, and may be terminated, revoked or amended by the owners of
the Property only with the written consent of the Town granted by a majority plus one vote
of the Planning Board after a public heating.
If any section, subsection, paragraph, clause, phrase or provision and restrictions shall, by
a Court of competent jurisdiction, be adjudged illegal, unlawful, invalid or held to be
unconstitutional, the same shall not affect the validity of these covenants as a whole or any
other part or provision hereof other than the part so adjudged to be illegal, unlawful, invalid
or unconstitutional.
The aforementioned Reslxictive Covenants are intended for the benefit of and shall be
enforceable by the Town of Southold, State of New York, by injunctive relief or by any other
remedy in equity or at law. The failure of said agencies or the Town of Southold te enforce
the same shall not be deemed to affect the validity of this covenant nor to impose any liability
whatsoever upon the Town of Southold or any officer or employee thereof.
The within Declaration is made subject to the provisions of all laws required by law or by
their provisions to be incorporated herein and made a part hereof, as though fully set forth.
That the within Declaration shall nm with the land and shall be binding upon the Declarant
