THIS INDENTURE,made the 22nd day of August , nineteen hundred and ninety-four
BETWEEN ROBERT A. CORTE, residing at 150 81st Street, Brocklyt;-New York 11209,
as Executor of 'the Last Will and Testament of Jos 'pine D. Corte, late of 150
81st Street, Brooklyn, New York 11209, deceased Nov er ,1993, who derived her
title as surviving spouse as co-tenant by the entirety with Anthony S. Corte, her
1 deceased husband, who died November 6, 1955,
party of the first part, and
ROBERT A. CORTE, Individually, residing at 150 81st Street, Brooklyn,
New York 11209,
party of the second part,

WITNESSETH, that the party of the first part, by virtue of the power and authority given in and by said last
will and testament, and in consideration of
----TEN and 00/100 and other good and valuable consideration dollars,
paid by the party of the second part, does hereby grant and
release unto the party of the second part, the heirs or successors and assigns of the party of the second part
forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate,
lying and being bud= at Mattituck, in the Town of Southold, Suffolk County, New York,
bounded and described as follows:
BEGINNING at a concrete monument set on the course running South 30 degrees
11 minutes 20 seconds East of the southwesterly line of Deep Hole Drive, said
monument being 10.0 feet southeasterly along said course from the initial point
of said course; from said point of beginning running along said southwesterly
line of Deep Hole Drive South 30 degrees 11 minutes 20 seconds East 90.0 feet;
thence along other land of the parties of the first part and at right angles
to said southwesterly line South 59 degrees 48 minutes 40 seconds West 275 feet,
more or less, to the ordinary high water mark of Deep Hole Creek; t
thence northwesterly along said ordinary high water mark of Deep Hole Creek
140 feet, more or less;
thence along other land of the parties of the 'first part North 65 degrees
10 minutes 10 seconds East 350 feet, more or less,- to the point of BEGINNING.
TOGETHER with all the right, title and interest of the parties of the first
part of, in and to that nortion of Deep Hole Drive, adjacent to said premises to
the center line thereof.
TOGa= with all the richt, title and interest of the parties of the first
part in and to waters and the land under water of Deep Hole Creek lying in front
of and adjoining the above described nremises.
BEING AND INTENDED TO BE for identification only, Lot Nos. 28 and 29 on Map
of farm owned by the Estate of Henry R. Gildersleeve, situate at Mattituck,
Suffolk County, New York, outline survyed September 5, 1934 by Otto W. VanTltyl,
Licensed Surveyor, Greenport, New York.
SUBJECT to the following covenants and restrictions:
1. That the purchasers shall not erect or permit to be erected on any lot
any buildings except one detached dwelling house for one-family and one garage
for private use for said dwelling.
2. That no dwelling erected thereon shall cost less than $3,000.00.
3. That no part of any building or cesspool on any lot shall be more than
190 feet from said Deep Hole Drive and less than 5 feet from the side boundary
line of any lot.
4. No outside toilets or stables shall be erected or permitted to be
erected on any part of the premises and no fowl or pigs shall be kept on said
premises.
5. The parties of the second part shall not manufacture, sell or permit to
be manufactured or sold, on said premises any goods qX"merchandise of any kind,
and shall not carry on, or permit any business or tz'ads whatsoever, upon said
