WITNESSETH, that the party of the first part, in consideration of TEN dollars and other good and valuable
consideration paid by the party of the second part, does i~ereby grant and release unto the party of the second
~art, the heirs or successors and assigns of the party of t,he second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate,
lying and being in the*Town of Southold, County of SuffOlk and State of New York, known and designated as
lot nos. 123 and 124 on a certain map entitled, "Map of Gardners Bay Estates, Section 2" and filed in the
Office of the County Clerk of Suffolk on September 23,; 1927, as Map No. 275, which said lots when taken
together, are more particularly bounded and described as follows:
Beginning at a point on the southerly side of Bayview Drive, at a concrete monument set at the point where the
division line between lots 122 and 123, as shown on said :map, intersects the southerly side of Bayview Drive;
Running thence along said division line, south 15 degrees 52 minutes 10 seconds east, 190 feet, more or less
to the highwater mark of Spring Pond;
Running thence in a northwesterly direction along the highwater mark to the division line of lots 124 & 125 on
the aforesaid map where said division line intersects the highwater mark of Spring Pond;
Running thence along said division line, north 22 degree,s 12 minutes 10 seconds west 128 feet per filed map,
125 feet more or less per survey used herein to the south,erly side of Bayview Drive, at a concrete monument;
Thence along the southerly side of Bayview Drive along t~he arc of a curve bearing to the right the following two
courses and distances;
1. South 79 degrees 12 minutes 10 seconds east 57 feet;
2. South 73 degrees 42 minute, s 10 seconds east 53 feet per filed map 55.95 feet per survey used herein
to the division line between lot 122 and 123 on aforesaid map, the point or place of beginning.
Said premises known as 180 Bayview Drive East Marion, NY 11939.
Being and intended to be the same premises as conveyed to the party of the first part by deed, dated
1/6/1989, recorded 1/27/1989 in Liber 10787 page 235 in the Suffolk County Clerk's Office.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads
abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all
the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the
~remises herein granted unto the party of the second part, the heirs or successors and assigns Of the party of
the second part forever. ~
AND the party of the first part covenants that the part,) of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the
first part will receive the consideration for this conveyance and will hold the right to receive such consideration
as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same
first to the payment of the cost of the improvement before using any part of the total of the same for any other
purpose. The word "party" shall be construed as if it re~d "parties" when ever the sense of this indenture so
requires.
