THIS INDENTURE, made the 24th day of March, Two Thousand Nine
BETWEEN
ALFRED GESZCZYNSKI, residing at 545 Birch Road, Southold, New York 11971,
party of the first part, and
CAROL-ANN SHEA, residing at 359 Linwood Avenue, Ridgewood, New Jersey 07450,
party of the second part,
WITNESSETH, that the party of the first part, in consideration of Ten Dollars and other
valuable consideration paid by the party of the second part, does hereby grant and release
unto the party of the second part, the heirs or successors and assigns of the party of the
second part forever,
ALL THAT CERTAIN plot, piece or parcel of land, with the buildings thereon erected,
situate, lying and being in the Town of Southold, County of Suffolk and State of New
York, more particularly bounded and described as follows:
BEGINNING at a point on the southwesterly side of Birch Road, distant 116.38 feet
southeasterly from the comer formed by the intersection of the southwesterly side of
Birch Road and the southeasterly side of Sound View Avenue;
RUN, lNG THENCE South 42 degrees 10 minutes 20 seconds East along the
southwesterly side of Birch Road, 100 feet to land now or formerly of Smith;
THENCE South 47 degrees 49 minutes 40 seconds West along said land of Smith, 130.50
feet to land now or formerly of Posess;
THENCE North 42 degrees 10 minutes 20 seconds West along said land of Posess, 92
feet to other land now or formerly of Kearney;
THENCE North 44 degrees 19 minutes 10 seconds East along said last mentioned land,
130.74 feet to the southwesterly side of Birch Road, the point or place of BEGiNNiNG.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first
part by deed dated February 8, 1991, and recorded February 27, 1991, in the Suffolk
County Clerk's Office in Liher 11224, Page 547.
RESERVING, HOWEVER, a legal life estate in the above-described premises with the
buildings and improvements thereon erected, in and to the party of the first part.
THE PARTY OF THE FIRST PART HEREBY RESERVES A SPECIAL POWER OF
APPOINTMENT, exercisable as often as they may choose, to change their remainderman
as follows:
TO or among any one or more members of a class consisting of the party of the first
part's collateral descendants, in any degree, whether presently living or bom hereafter, in
such proportions and amounts, without regard to equality, outright or in trust, as the party
of the first part may direct and appoint during his lifetime by properly written and
acknowledged instrument, and recorded prior to death, making specific reference to this
power of appointment. The party of the first part may not appoint himself, his estate, his
creditors or the creditors of his estate, under any circumstances.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to
any streets and roads abutting the above described premises to the center lines thereof;
TOGETHER with the appurtenances and all the estate and rights of the party of the first
part in and to said premises; TO HAVE AND TO HOLD the premises herein granted
unto the party of the second part, the heirs or successors and assigns of the party of the
second part forever.
AND the party of the first part covenants that the party of the first part has not done or
suffered anything whereby the said premises have been encumbered in any way
whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants
that the party of the first part will receive the consideration for this conveyance and will
hold the right to receive such consideration as a trust fund to be applied first for the
purpose of paying the cost of the improvement and will apply the same first to the
payment of the cost of the improvement before using any part of the total of the same for
any other purpose..
The word "party" shall be construed as if it read "parties" whenever the sense of this
indenture so requires.
IN WITNESS WHEREOF, the party of the first part has duly executed this deed the day
and year first above written.
