SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application
and determines that thi~ review falls under the Type II category of the State's List of Actions, without further steps under
SEQRA.
SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk
County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its
reply dated March 17, 2009 stating that this application is considered a matter for local determination as there
appears to be no significant county-wide or inter-community impact.
PROPERTY FACTS/DESCRIPTION: The subject property is a 20,265.64 square foot parcel measuring 156.51
feet along Strohson Road on the southerly boundary, 115.51 feet along Little Neck Road on the westerly
boundary, 150.00 feet along the northerly boundary and 154.87 feet along the easterly boundary. By Code the
property has two front yards, one side yard, and one rear yard. The property is improved with a two-story single
family frame house a~d a detached frame garage. The house fronts Strohson Road. The asphalt driveway
egress/ingress is on Sirohson Road.
BASIS OF APPLICA'ClON: Request for a variance under Section 260-15, based on the Building Inspector's
October 7, 2008 Noti~:e of Disapproval concerning an application for a building permit to locate an accessory
swimming pool structure partially in a front yard, rather than entirely in a rear yard.
FINDINGS OF FACT
The Zoning Board of Appeals held a public hearing on this application on May 28, 2009, at which time written
and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the
property, and other evidence, the Zoning Board finds the following facts to be true and relevant:
AREA VARIANCE RELIEF REQUESTED: The applicant requests a variance for the installation of a 16 foot by
36 foot in-ground swimming pool to be partially in a front/rear yard.

ADDITIONAL INFORMATION: There were letters written by neighbors addressed to the Zoning Board and
neighbors were in attendance at the Public Hearing on May 28, 2009 to voice their concerns about viewing the
proposed in ground swimming pool and equipment from the road. The attorney for the applicant presented, at
the Public Hearing, a proposed landscape plan showing plantings throughout the property and plantings
adjacent to the proposed in ground swimming pool, screening its view from the road. The Zoning Board received
a supplemental affidavit on June 12, 2009 from the applicant addressing issues and concerns from neighbors.
The affidavit also states that the applicant has had meetings with the neighbors addressing same concerns.
The survey of the property dated April 21, 1999 with revision dated December 23, 2008 (added proposed pool),
prepared by Nathan Taft Corwin Ill, Land Surveyor, and cannot be relied upon since it is inaccurate and requires
updating to reflect pre,sent conditions.
REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal
inspections, the Board makes the following findings:
1. Town Law §267-b(3)(b)(3)(11. Grant of the variance will not produce an undesirable change in the character
of the neighborhood or a detriment to nearby properties. The proposed location of the in-ground swimming pool
will be approximately 75 feet from Little Neck Road. Applicant will install plantings to screen the in-ground
swimming pool from rOadside view. The pool equipment will be relocated to the area of the Northwest corner of
the frame garage and be contained in a sound abatement container.
2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method,
feasible for the applic'ant to pursue, other than an area variance. The properly is a corner lot and subjected to
two Front Yards. Thb second Front Yard along Little Neck Road reduces the width of the Back Yard by
apprex~mately 99 feet ?esult~ng in the need for an area variance for this proposed in ground swimming pool.
3. Town Law .~267-1~(3)(b)(3). The variance requested herein is not substantial. The proposed in ground
swimming pool is sited approximately 75 feet from Little Neck Road. Approximately 18 feet of the 36 foot wide
pool will extend the architectural rear yard.
4. Town Law .~267-b(3)(b)f5). The difficulty has not been self created. It is the result of the lot having two
Front Yards and the lOcation of the existing house.
5. Town Law §267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential
community will have au adverse impact on the physical or environmenta conditions in the neighborhood.
6. Town Law §267-b. ,Grant of the relief requested is the minimum action necessary and adequate to enable the
applicant to enjoy the:.'benefit of an in ground swimming pool, while preserving and protecting the character of
the neighborhood and the health, safety and welfare of the community.
RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under
New York Town Law 267-B, motion was offered by Member Schneider, seconded by Member Weisman, and
duly carried, to

GRANT the variance as applied for as shown on survey plan dated December 23 2008 prepared by Nathan
Taft Corwin III, subject to the following conditions:
1. Applicant shall submit to the Zoning Board of Appeals, before building permit is issued, an updated property
survey indicating existing conditions, the exact location of proposed in ground swimming pool, pool equipment
and screening plantings around pool,
2. Evergreen screening shall be continuously maintained around the swimming pool to create year-round
privacy,
3. Applicant shall ins~/all a drywell system(s) capable of receiving and dispersing underground all pool pump
and filter backwash w~ters,
4. Exterior pool mechanical system(s) shall be contained in a sound-proof structure and located as far as
possible from the northerly property line and as agreed by applicants/agent at the May 28, 2009 hearing.
That the above condit~'ons be written into the Building Inspector's Certificate of Occupancy, when issued.
Any deviation from the,variance given such as extensions, or demolitions which are not shown on the applicant's
diagrams or survey site maps, are not authorized under this application when involving nonconformities under
the zoning code. This action does not authorize or condone any current or future use, setback or other feature
of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as
are expressly addressed in this action.
The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does
not increase the degree of nonconformity.

INSTRUCTIONS
a. This application MUST be completely filled in by typewriter or in ink and submitted to the Building Inspector with 4
sets of plans, accurate plot plan to scale. Fee according to schedule.
b. Plot plan showing location of lot and of buildings on premises, relationship to adjoining premises or public streets or
areas, and waterways.
c. The work covered by this application may not be commenced before issuance of Building Permit.
d. Upon approval of this application, the Building Inspector will issue a Building Permit to the applicant. Such a permit
shall be kept on the premises available for inspection throughout the work.
e. No building shall be occupied or used in whole or in part for any purpose what so ever until the Building Inspector
issues a Certificate of Occupancy.
f. Every building permit shall expire if the work authorized has not commenced within 12 months after the date of
issuance or has not been completed within 18 months from such date. If no zoning amendments or other regulations affecting the
property have been enacted in the interim, the Building Inspector may authorize, in writing, the extension of the permit for an
addition six months. Thereafter, a new permit shall be required.

(2) The benefit sought by the applicant CANNOT be achieved by some method feasible for
the applicant to pursue, other than an area variance, because:
It is not possible to place an in-ground pool in the traditional back yard of the property.
The applicant's property is a corner lot. By Code the property has 2 front yards bordering
Strohson Road and Little Neck Road. There is very little open space in the back yard.
An explanation follows:
FRONT (facing South): There is a small front yard and a driveway on Strohson
Road to the South.
BACK (North): The driveway continues behind the house, where there are two (2)
septic systems, a separate frame garage and the oil tank. There is very little room for an in-
ground pool in the area that would be considered the back yard of the house.
Approximately eighteen (18) feet of the thirty-six (36) foot pool will be in the "back" yard.
There is an appropriate set-back along the North side of the property for placement of the
pool.
SIDE (West): Little Neck Road borders the majority of the house's open land. This
would be considered the side yard but by Code it is a second front yard. Approximately
eighteen (18) feet of the thirty-six (36) foot pool will extend into the "side/front" yard.
SIDE (East): The driveway and evergreen shrubs border the property now or
formerly of Heintges and McLeod. There is no open space in this area.
(3) The amount of relief requested is not substantial because:

We are the owners of the referenced premises and have submitted the referenced
application to the Town of Southold Zoning Board of Appeals ("ZBA"). We make this
affidavit in support of our application and in response to the ZBA's request for changes
and amendments to our application.
First, we apologize for our absence at the heating on May 28, 2009. While our work
schedules made attending the hearing difficult, we also thought that our meetings with
our neighbors had answered the critical questions and resolved their issues. Apparently,
this was not the case. We were, and are, stunned by the neighborhood response to our
application for an 18 foot variance to allow a pool in our backyard/sideyard.
With regard to our application before the ZBA, we are advised that the ZBA has
requested that we consider making five amendments to the proposed plan, and that we
amend our application accordingly. Each of the requested amendments and our response
is set forth below:
Sprinkler System. It has always been and it continues to be our intention to have a
sprinkler system. The Landscape Design Plan, dated October 22, 2007, was put together
by a professional to enhance the property and provide screening for the pool from the
street and while a sprinkler system is not shown on the landscape design we consider it
essential. I met with Terry Martin of Briarcliff Landscape with regard to the design and
the type of sprinklers that will be installed in connection with the project. Mr. Martin
advised that there will be different types of sprinklers, including drip type sprinklers. The
sprinkler system will be designed to keep the landscape alive and healthy. We have no
objection to a condition in the ZBA's determination that a sprinkler system, designed by
the sprinkler system company that is ultimately engaged to do the installation, be required
to be installed in connection with the landscape plan.
The Fence Around The Pool. The fence around the pool will be black to blend in with
the landscaping, and it will be as high as is required by the applicable code sections. The
type offence that is intended is referred to as an "estate fence". An estate type fence is
shown on Exhibit A hereto which is taken from an advertisement. The fence along the
northern side of the pool will not be an estaet type fence but will be a cyclone fence. The
cyclone fence will only be visible from our property since an existing six-foot wooden
stockade fence, previously erected by Mr. and Mrs. Welcome, will shield their view of
the pool. Photographs of the Welcome's six foot wooden stockade fence were included
with the original application.
Additional Screening on Strohson Road. Because of the extensive landscaping that is
planned for the area around the pool, we do not think additional screening on our
southern border, which is Strohson Road, is necessary. However, we will provide two
additional blue spruces, as shown on the amended plan, which is exhibit B hereto,
because the ZBA has requested that we provide additional screening. The southwest
comer will remain clear, except for the addition of San Jose Juniper and Maiden Grass,

so as to maintain our view of the water.
Pool Equipment Location. We intended to put the pool pump equipment in a sound
abatement container and we have no objection to that requirement being contained in a
ZBA determination. We do object to a requirement that the pool pump equipment be
placed in the area of the southwest comer of the garage. We prefer to put the pool
equipment in the northwest comer of the garage between the pool patio and the fence.
We believe the placement of the pool equipment in the northwest comer of the garage
would cause absolutely no impact on our neighbors to the north. Also, it is our
tmderstanding that the Southold Town Code does not prohibit pool equipment from being
placed within the setback. However, we will abide by a requirement that the pool
equipment be placed in the southwest comer of the garage if that is the Board's
determination.
Plantings On Neighbor's Property To The East. We will not plant anything on the
IV!zC!::.:d property to the East. There is no need for additional plantings for screening
purposes. Exhibit C hereto is a picture taken from our driveway on the south side of the
garage. The view as shown in the photograph is to the east and slightly south. As is
apparent, ample screening already exists on our eastern boundary line. is much

I am writing in response to the Southold Board of Appeals Legal Notice dated May 5, 2009
regarding Board Action # 6279. Because I will be unable to attend the Public Hearing on
Thursday, May 28, I would like to make a few remarks herein regarding the above cited variance
for a swimming pool on the property of Kenneth Marlborough, at 95 Strohson Road, Cutchogue,
NY.
My husband Charles and I do not want to stand in the way of the Marlborough family having a
pool, but request that the pool be screened from the road by landscaping.
The proposed pool is sited on a 1999 survey of the property for 95 Strohson Road and many
substantial changes have occurred since that d~!e, All of the Bamboo has been removed and all
of the Hedge Row. There is only grass from the house to Little Neck Road and Strohson Road.
The pool would be visible from both roads as this is a comer property.
Ken Marlborough has a landscape plan for the property. Hopefully this plan includes a hedge
row about 5'- 6' high or similar plantings along Little Neck Road and Slxohson Road. Perhaps
the Board could include this landscaping as part and pamel of the application for the pool. In
this scenario, I think all the neighbors would approve.

Dear Board Members:
I am writing with respect to the Marlborough's request for a variance under section 280-15 to build a
swimming pool structure in part in a front yard. I have already talked and written to the Marlborough's
lawyer Daniel Ross at Keegan & Keegan, Ross & Rosner about my concerns.
I just want to note that the plan of the property for 95 Strohson Road that they submitted is inaccurate.
It appears to be an old plan of the property before the Marlborough's moved in. Subsequently they have
expanded the house considerably, including adding another story. In addition, they have removed the
bamboo area on Little Neck row and the hedge row on Strohson Road. This means that the pool would be
very exposed on both Little Neck Road and Strohson Road. In addition, there is currently no evergreen
hedge or hedge row separating our two properties although there is rather thick brush, most of which is
deciduous. I thought it would be helpful for the board to have an accurate plan of the present site
conditions before reaching a decision about the variance.
As I have indicated to the Marlborough's lawyer, I would be much less concerned if the pool were hidden
by a hedge or similar dense landscaping approximately 6 feet high along the property boundary of Little
Neck and Strohson Road. I feel this planting should occur before the pool is in use. Although I do not
know if I have any legal authority to request it, I would also be grateful if there was a hedge along our
shared property line (between 95 and 275 Strohson Road) at least between the garage and the back of
their house to minimize views and provide some acoustical protection.
The Marlborough's are wonderful neighbors and I sincerely hope a solution can be found that is amenable
to them and those living near by..
