TERMS AND CONDITIONS
The Permittee Fishers Island Development Corp., residing at Private Road, Fishers Island, New
York as part of the consideration for the issuance of the Permit does understand and prescribe
to the following:
That the said Board of Trustees and the Town of Southold are released from any and all
damages, or claims for damages, of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit, and the said Permittee will, at his or her own
expense, defend any and all such suits initiated by third parties, and the stiid Permittee
assumes full liability with respect thereto, to the complete exclusion of the Board of
Trustees of the Town of Southold.
That this Permit is valid for a period of 24 months, which is considered to be the estimated
time required to complete the work involved, but should circumstances warrant, request for
an extension may be made to the Board at a later date.
That this Permit should be retained indefinitely, or as long as the said Permittee wishes to
maintain the structure or project involved, to provide evidence to anyone concerned that
authorization was OriginallY obtained.
That the work involved will be subject to the inspection and approval of the Board or its
agents, and non-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
That there will be no unreasonable interference with navigation as a result of the work
herein authorized.
That there shall be no interference with the right of the public to pass and repass:along th~
beach between high and low water marks.
That if future operations of the Town of Southold require the removal and/or alterations in
the location of the work herein authorized, or if, in the opinion of the Board of Trustees,
the work shall cause unreasonable obstruction to free navigation, the said Permittee will be
required, upon due notice, to remove or alter this work project herein stated without
expenses to the Town of Southold.
That the said Board will be notified by the Permittee of the completion of the work
authorized.
That the Permittee will obtain all other permits and consents that maybe required
supplemental to this permit, which may be subject to revoke upon fa~ to obtain same.

Dear Mr. Just:
The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, May 20, 2009 regarding the above matter:
WHEREAS, J.M.O. Environmental Consulting Services on behalf of FISHERS ISLAND
DEVELOPMENT CORP. applied to the Southold Town Trustees for a permit under the
provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the
Town of Southold, application dated April 15, 2009, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Water[rent Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, the LWRP Coordinator issued a recommendation that the application be
found Consistent with the Local Waterfront Revitalization Program policy standards,
and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on May 20, 2009, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the struCture complies with the standards set forth in Chapter 275 of the
Southold Town Code,
WHEREAS, the Board has determined thatthe project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees have found the application to be Consistent
with the Local Waterfront Revitalization Program, and,
RESOLVED, that the Board of Trustees approve the application of FISHERS ISLAND
DEVELOPMENT CORP. to clear and remove vegetation in a 30'x450' area, excavate a
15'x450' area to a depth of -1' and remove any topsoil or unsuitable subsoil and install a
15'x450' stone driveway; excavated soils shall be used to re-establish any disturbed
slopes along the proposed drive; any excess soils shall be trucked off site; the proposed
drive shall have a 1, compacted bank run gravel base with a 4" compacted native brown

unsuitable subsoil and install a 15'X 450' stone driveway. Excavated soils shall be used to

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of
Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based
upon the information provided on the LWRP Consistency Assessment Form submitted to this
department, as well as the records available to us, it is our recommendation the proposed action is
CONSISTENT with LWRP policy standards and therefore is CONSISTENT with the LWRF.
In the event that the proposed driveway is approved, the following (BMP) Best Management Practice is
recommended:

The drainage plan for driveway should be designed so that a two-inch rainfall can be
retained on-site, within the subject parcel landward of the wetland boundary.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing
its written determination regarding the consistency of the proposed action.

Driveway project, Private road, nog, Fishers Island
Policy #1
It is felt that the project shall not have an adverse impact on the landscape character of
Southold. It must be noted that the parcel of property on which the proposed driveway
would be built is 2.67 acres and is zoned for a single family residence. Upon approval of
this application, the existing FIDCO road (0.39 acres) located at the north end of the
parcel shall be conveyed to the adjacent property owner, Walter C. Flower m. Then the
area (40,720 s.f.) north of the proposed drive and south of the area being conveyed to Mr.
Flower shall have a conservation easement to the Henry L. Ferguson Museum, Inc. Then
the area south of the proposed drive (61,280 s.fi) shall be deeded to the Henry L.
Ferguson Museum, Inc. With this, I believe that this project shall be consistent with this
policy.
Policy #2
The project as proposed should have no negative impacts upon the archeological or
historic resources of the Town of Southold. It is felt that this project is consistent with
this policy.
Policy #3
The project as proposed shall not have any negative impacts upon the visual quality or the
scenic resources of Fishers Island. It is felt that this project is consistent with this policy.
Policy g4
The project as proposed does not involve a shoreline nor is it located in a flood-prone
zone. I believe that this policy is not applicable to this project.
Policy #5
The project as proposed will not have any negative impacts upon water quality or water
supply on Fishers Island. It is felt that this project is consistent with this policy.
Policy #6
The project plans are based on sound engineering and attention was made to drain any
rainwater away fi'om the area of freshwater wetlands. Only the minimum amount of
clearing of vegetation needed to construct the driveway is being applied for and the use of
staked hay bales and silt fencing were incorporated into the plans to curtail runoff. The
project should not result in any habitat impairment. It is felt that this project is consistent
with this policy.

The project shall not have any negative impacts upon air quality. It is felt that this project
is consistent with this policy.
Policy #8
The project does not involve waste, solid waste or hazardous substances. It is felt that
this project is consistent with this policy.
Policy #9
The project does not involve coastal waters, public lands or public resources nor will it
limit public access to and recreational use of coastal waters, public lands or public
resources. It is felt that this project is consistent with this policy.

The project does not involve Southold's water dependent uses. It is felt that this project is
consistent with this policy.

The project does not involve nor shall it have any impact upon the use of the living
marine resources. It is felt that this project is consistent with this policy.

with this policy.
