Wilmerding permitee) has been completed and is ready for final inspection. Please confirm that you

my understanding that the inspection will take place in the coming weeks or months as the project is on
Fishers Island and the inspections are done in batches rather than individually.

The following action was taken by the Southold Town Board of Trustees at their Regular
Meeting held on Wednesday, January 20, 2010:
RESOLVED, that the Southold Town Board of Trustees APPROVE the Amendment to
Wetland Permit #7061 and Coastal Erosion Permit #7061C to eliminate the 8'x57' fixed
dock previously approved for reconstruction and instead install (2) tie-off piles, and to
place two (2) 2-4 ton boulders in area of concrete removal to match the existing
retaining walls, and as depicted on the revised site plan prepared by CME Engineering,
Land Surveying & Architecture, PLLC last dated December 1, 2009, and received on
December 15, 2009.
Any other activity within 100' of the wetland boundary requires a permit from this office.
This is not a determination from any other agency.

Dear Mr. King:
At the present time we are seeking to modify this Permit 7061 &
706 lC (copy enclosed) which was issued on 4/22/09. As you may recall,
the project involved the reconstruction of an existing timber docking facility
in Hay Harbor. The existing facility consists of a ramp leading to an 8'x 88'
fixed dock with an 8'x 57' fixed dock in an "L" configuration on it's seaward
end.
At this time, the owner seeks to eliminate the 8'x 57' fixed dock
which had been approved for reconstruction and instead install (2) tie off
piles. For your review, I have enclosed copies of the revised plans prepared
by CME Engineering, Land Surveying & Architecture, PLLC. last dated
12/01/09.

AUTHORIZATION
Pursuant to the provisions of Chapter 275 and/or Chapter 111 of the Town Code of the Town of
Southold and in accordance with the Resolution of the Board of Trustees adopte~!~, at the meeting held on
Anri122. 2009. and in ¢~asideration of application fee in the sum of $500.00 Paid' by David Wilmerdin~ and
subject to the Terms and Conditions as stated in the Resolution, the Southold Town Board of Trustees
authorizes and permits the following:
Wetland Permit to construct a 5'x46' fixed dock onto an existing 8'x88' fixed
dock, to re-deck the existing 8'x88' fixed dock and to construct (2) steps on the existing
fixed dock, with the condition of the use of open-grate decking over the concrete, and
the seaward portion of the existing concrete ramp is to b~ removed, and as depicted on
the site plan prepared by CME Engineering, Land SurVeying & Architecture, PLLC,
last dated May 29, 2009, and received on June 9, 2009.
IN WITNESS WHEREOF, the said Board of Trustees hereby causes its Coq~orate Seal to be affixed,
and these presents to be subscribed by a majority of the said Board as of this date.
TERMS AND CONDITIONS
The Permittee David Wilmerding, residing at Private Road off of Equestrian Avenue, Fishers
Island, New York as part of the consideration for the issuance of the Permit does understand
and prescribe to the following:
That the said Board of Trustees and the Town of Southold are r~leased from any and all
damages, or claims for damages, of suifs arising directly or indirectly as a result of any
operation performed pursuant to this permit, and the said Permittee will, at his or her own
expense, defend any and all such suits initiated by third parties/and the said Permittee
assumes full liability with respect thereto, to the complete exclusion of the Board of
Trustees of the Town of Southold.
That this Permit is valid for a period of 24 months, which is considered to be the estimated
time required to complete the work involved, but should circumstances warrant, request for
an extension may be made to the Board at a later date.
That this Permit should be retained indefinitely, or as long as the said Permittee wishes to
maintain the structure or project involved, to pi'ovide evidence to anyone concerned that
authorization was originally obtained.
That the work involved will be subject to the inspection and approval of the Board or its
agents, and non-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
That there will be no unreasonable interference with navigation as a result of the work
herein authorized.
That there shall be no interference with the right of the public to pass and repass along the
beach between high and low water marks. ~
That if future operations of the Town of Southold require the removal and/or alterations in
the location of the work herein authorized, or if, in the opinion of the Board of Trustees,
the work shall cause unreasonable obstruction to free navigation, the said Permittee will be
required, upon due notice, to remove or alter this work project herein stated without
expenses to the Town of Southold.
That the said Board will be notified by the Permittee of the completion of the work
authorized.
That the Permittee will obtain all other permits and consents that may be required
supplemental to this permit, which may be subject to revoke upon failure to obtain same.

The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, April 22, 2009 regarding the above matter:
WHEREAS, J.M.O. Environmental Consulting Services on behalf of DAVID
WILMERDING applied to the Southold Town Trustees for a permit under the provisions
of Chapter 275 of the Southoid Town Code, the Wetland Ordinance of the Town of
Southold, and Chapter 111 of the Southold Town Code, Coastal Erosion Hazard Areas,
application dated December 2, 2008, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, in accordance with Chapter 268, said application was found to be Exempt
from the Local Waterfront Revitalization Program policy standards, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on April 22, 2009, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 and
Chapter 111 of the Southold Town Code,

with the condition of the use of open-grate decking over the concrete, and the seaward
portion of the existing concrete ramp is to be remove(:, and as depicted on the site plan
prepared by CME Engineering, Land Surveying & Architecture, PLLC, last dated May
29, 2009, and received on June 9, 2009.
Permit to construct and complete project will expire two years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold
Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information
provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to
us, it is our recommendation that the proposed action is EXEMPT pursuant to § 268-3.
§ 268-3. Definitions.
MINOR ACTIONS -- Include the following actions, which are not subject to review under this chapter:
A. Maintenance or repair involving no substantial changes in an existing structure or facility;
Replacement, rehabilitation or reconstruction of a structure or facility, in kind, on the same site, including

Erosion Hazard Area (CEHA) law where structures may not be replaced, rehabilitated or reconstructed
without a permit

Response to Coastal Policies - LWRP for Southold Town for
Wilmerding, Fishers Island
Policy 1- The project as proposed will have no impact whatsoever on the
character of the community of Fishers Island and will have no impact on
open space. The proposed work shall be concentrated in an existing area of
maritime activity. It is felt that this project is consistent with this policy.
Policy 2 - The project as proposed shall have no impacts whatsoever on any
existing historic or archaeological resources of the Town of Southold. It is
felt that this project is consistent with this policy.
Policy 3- The project consists of the rehabilitation of an existing private
recreational docking facility. The rehabilitation shall have no impacts
whatsoever on the visual quality or scenic resources located within Southold
Town. It is felt that this project is consistent with this policy.
Policy 4- The project as proposed does not involve the construction of a
shore hardening structure, nor does it involve the development in a natural
protective feature area. It is felt that this policy is not applicable to this
project.
Policy 5- The project as proposed does not involve development that will
have any impacts whatsoever upon the quantity or quality of potable water
supplies in the Town of Southold. It is felt that this policy is not applicable
to this project.
Policy 6- The project as proposed shall not cause any adverse changes to the
ecological quality of Little Hay Harbor. There shall be no degradation or
physical loss of ecological components nor shall the rehabilitation of the
existing private recreational docking facility have any impacts upon any
Significant Coastal Fish and Wildlife Habitat. It is felt that this project is
consistent with this policy.
Policy 7- The project as proposed shall have no impact whatsoever upon the
quality of air in Southold Town. It is felt that this policy is not applicable to
this project.
Policy 8- The project does involve the disposal of that portion oftbe
existing recreational docking facility to be replaced. The debris which shall
be removed will be disposed of properly. It is felt that this project is
consistent with this policy.
Policy 9- The project as proposed provides the property owner access to
Little Hay Harbor and the recreational use of coastal waters, public lands
and public resources of the Town of Southold. It is felt that this project is
consistent with this policy.
Policy 10- The project as proposed involves the rehabilitation of an existing
private recreational docking facility and shall not require the relocation of
the existing structure. It is felt that this project is consistent with this policy.
Policy 11- The project as proposed involves the rehabilitation of an existing
private recreational docking facility. The rehabilitation of said structure
shall have no impact upon the long term maintenance and health of living
marine resources. The project does not involve stocking or the introduction
of non-indigenous species offish, plant or wildlife and shall provide
recreational use of the Town of Southold's finfish, shellfish, crustaceans and
marine plants. It is felt that this project is consistent with this policy.
Policy 12- The project as proposed does not involve agricultural lands in the
Town of Southold. It is felt that this Policy is not applicable to this project.
Policy 13- The project as proposed does not involve the use of development
of energy or mineral resources. It is felt that this Policy is not applicable to
this project.
