The Building Department took immediate legal steps after
receiving Town Board letter dated 10/24/85. Mr. Sepen-
oski was supposed to appear in court 3/21/86; requested
an adjournment and was granted until 4/4/86, he appeared
and the case was adjourned until the end of June so that
Mr. Sepenoski will be able to get all the necessary per-
mits. I believe on June 20th, 1986 a trial will be held
for determination.

Re: John B. Sepenoski, Jr. Trailer Permit No. 106
In answer to your request for direction with respect to the Sepenoski Trailer
Permit which expired on September 26, 1985, please be advised that the Town
Board has not renewed this permit. As stated in your memorandtun of August 30,
1985, it appears Mr. Sepenoski is in violation of the Zoning Code. Further-
more, Mr. Sepenoski assured the Town Board, by letter of March 21, 1985, that
he would make the necessary applications to the Town to legalize the placement
of this modular home. It appears hehas not done this. The Board is of the
opinion your department should take whatever steps necessary to see that this
conforms.

The modular house was not put where it was indicated
on the submitted survey. The modular was placed 300 ft.
plus to the rear of the dwelling on a permanent foundation.
A well was installed along with a cesspool. Permanent
underground electricity was run from a L.I.L. Pole. All
this was done without the benefit of: underwriters; health
dept.; and permits along with a certificate of occupancy
from the building dept. They are at present in violation
of that section of the Zoning Code that allows one resi-
dence per lot. When the building inspector was observed
taking a photo of electric hook-up, in the middle of July,
an application for a sub-division was then filed the third
week in July. I strongly advise the Town Board that this
permit be terminated or allowed to expire and not be rein-
stated for another period of time. The building dept. will
be forced to take legal action because of this condition.

Mr. Lessard advises that as soon as the permit expires, which
is September 26, 1985, the Building Dept.will proceed in taking
action against Mr. Sepenoski.

Dear Victor:
Please make an inspection of the premises o£ John B. Sepenoski,
North Road, Peconic, N.Y. on which the Southold Town Board granted
trailer permit no. 106 on a temporary basis for six (6) months at a
regular Town Board meeting held on March 26, 1985. Subject permit
will expire on September 26~ 1985.
Please conduct your inspection and investigation to determine
whether or not Mr. Sepenoski has complied with the conditions set
forth on his temporary trailer permit and respond to my office as
soon as possible.

hardship .
I am in a unique~situation. This problem appeared quite
suddenly and unfortunately must be expedited. My family
has been farming on the same land since 1903, we currently
have two farms in the Southold agricultural district. I
enjoy my occupation~ I hope it does not end with me, I
would like to pass my heritage on to the next generation. I
will not innumerate the local and national problems besetting
farmers:I am sure that you are aware of them. My current
farm operation is mainly retail. It is too small to hire
additional permanent help;but large enough to keep myself~
mother, aunt, one worker, and seasonal part-time help very
busy. With changing times and a death ih the family a
future was uncerkain. However, last year, I found a worker
willing to put in the 80-100 hours of time per week necessary
in the peak summer season. This person% enthusiasm has inspired
me to continue farming. This person has a housing problem-
becoming acute on March 31. I have the opportunity to
purchase a modular home from a neighbor who used it last
summe~ when his house burned down.
I currently live on a four-acre parcel and will apply
for an offset to split this land into two - two acre
parcels and place the modular home on one.( This is not
agricultural land, as I have no irrigation available here.)
Before this approval becomes reality I may lose my helper
and the home. If I could have a temporary permit to place
this home behind my own house; one of my agricultural
problems would be solved. I plan to hook the sewer,
electricity, and water to the existing facilities of my
own home. Because of my house, trees, and garage and the
property being off the main highway, it would not be noticable.
I believe it would not be objectionable to anyone because you would
have rio search for it rio see it. Without this particular
worker I am not sure I could or would continue my current
agricultural operation.
