BRUSH, residing at 1905 Stillwater Avenue (� DISIRierchogue, KTCnGN (� BLOCK ��LOTT party of the second paE l v l" I L.Ll� l © LJ.."JI Lu 2L�L..-1 1 L.L O WITNESSETH, the the party of thRrst part to whom perJanent letters testamentary were issued by the Surrogate's Court, Suffolk County, New York on August 2, 1994, and by virtue of the power and authority given in and by said last will and testament, and/or by Article 11 of the Estates, Powers and Trusts Law, and in consideration of -0- dollars, paid by the party of the second part, does hereby grant and release unto the party of the second part, the distributees orsuccessors and assigns of the party of the second part forever, ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying and being in the at Cutchogue, Town of Southold, Suffolk County, New York, bounded and described as follows: BEGINNING at a point on the easterly line of Stillwater Avenue at the southeast corner of the premises herein described adjoining land now or formerly of Pumillo on the south; RUNNING THENCE in an easterly direction along land now or formerly of Pumillo and continuing thence along other land now or formerly of Hand about 375 feet to the middle of the gutter leading to Eugene's Creek; RUNNING THENCE in a northwesterly direction along the middle of the gutter and along land now or formerly of the John Orlowski Estate about 500 feet to Stillwater Avenue; RUNNING THENCE southerly along the easterly line of Stillwater Avenue about 333 feet to the point or place of beginning. Dist. 1000 Sec' BEING AND INTENDED TO BE the same premises described in the deed to EDWARD BRUSH by deed 103.00 Block from MICHAEL S. HAND, dated July 5, 1961, recorded October 19, 1964, in Liber 5634, Page 518. 08.00 Lot TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads 001.000 abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances, and also all the estate which the said decedent had at the time of the decedent's death in said premises, and also the estate therein, which the party of the first part has or has power to convey or dispose of, whether individually, or by virtue of said will or otherwise; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the distributees or successors and assigns of the party of the second part forever. AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been incumbered in any way whatever, except as aforesaid. Subject to the trust fund provisions of section thirteen of the Lien Law. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
