WHEREAS, Suffolk Environmental Consulting, lnc. On behalf of Joseph Farrell applied to the S outhold Town Trustees for a permit under the provisions of the Wetland Ordinance of the Town of Southold, application dated October 3rd 2002 WHEREAS, said application was referred to the Southold Town Conservation Advisory Council for their findings and recommendations, and WHEREAS, a Public Heating was held by the Town Trustees with respect to said application on November 20th 2002 at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, 2 WHEREAS, the structure complies with the standard set forth in Chapter 97-18 of the Southold Town Code. WHEREAS, the Board has determined that the project as proposed will not affect the health, Safety and general welfare of the people of the town. NOW THEREFORE BE IT, RESOLVED, that the Board of Trustees approved the application of Joseph Farrell for a Wetland Permit to construct a 1,196 square foot +/- (footprint) private single family dwelling, driveway sanitary system and private well with the stipulation that the sanitary system will be 100 feet or greater fi.om the delimitation line and also a non-turf buffer line on the back of the house, as per plan submitted. BE IT FURTHER RESOLVED that this determination should not be considered a determination made for any other Department or Agency, which may also have an application pending for the same or similar project. Fee must be paid, if applicable and permit issued within six months of the date of this notification. If inspections are required, at a fee of $5.00 per inspection (See attached schedule). This was via a "Notice to Adjacent Property Owner," and a copy of the sketch/survey for SCTM# 1000-135-03- 026. We are the direct adjacent homeowners at 1000-135~03-025. We were informed by the home's previous owner and after visiting the Southold Assessors office over the summer, that the likelihood of the small property being built upon was remote due to the proximity of the cesspools and the private wells. We were also told that it may pose a possibility if our area ever changed to "main water." We are not opposed to the structure, however we are concerned with its proximity to the water and our property. We are also concerned that our current private well sad cesspool are not in any compromised position by this applicant. I have called several different agencies, (by the recommendation of your office) and have not heard any responses with regard to the legal implications/impact of this structure on a possible sensitive environmental area. These agencies include Bruce Anderson of Suffolk Environmental Consulting Inc. (retained by the applicant) at 53%5160 sad the Suffolk County Health Dept. (Dr. Robert Nuzzi and Charles Brigham of Waste and Water Management) at 852-2100. I know that the opportunity for land is scarce. However I am asking that the Board of Trustees consider the quality/sefety of life for those of us who are already here and not to encroach/allow any variance to build if it is deemed to compromise our current home (cesspool and well) at 145 Mill Creek Drive. Thank you for your consideration and we plan on attending the meeting to be held on the 20* of November to learn more about the feasibility of this plan. This parcel is adjacent to our home, along our west side property line. It has been brought to our attention that you will have an Environmental Review on the Farrell application on Wednesday, November 20. We plan to attend the hearing in order to find out more about the application process and what is involved in your review of the application. There must be many issues that you consider before granting anyone approval to build, especially on waterfkont property. The fbllowing four questions are some issues that we hope are on your list consideration prior to approving a building permit application. 1. What other governmental agencies have to give approval in addition to Southold Town? Will these be done as of the hearing date? 2. Will the "horizontal separation between the well and the closest edge of all leaching pools" and the "separation of water and sewer lines" be within the guidelines of the Suffolk County Private Water Systems Standards and Approval of Plans and Construction - Sewage Disposal Systems For Single-Family Residences? Does "all" mean applicant's and neighbors' wells and leaching pools in relation to each other? Ifa variance is necessary, what is/are the reasons for this necessity? What are the specific measurements necessary to comply with the variance'? 3. Will the "well depth" meet the required minimum depth'? Will a variance be required? If yes, why is one being approved, and what are the new depth requirements? 4. Are there any guidelines with regard to tree removal when clearing property for the construction of a dwelling? If there are, what are the particulars? We are looking fbrward to the November 20th meeting in order to get answers to our que~ior~q.
