BETWEEN JOHN BEDELL and SUSAN BEDELL, residing at 85 Garden
Street, Garden City, New York 11530, party of the first part,
AND the COUNTY OF SUFFOLK, a municipal corporation having
its office and principal place of business at Riverhead, New York
party of the second part;
WITNESSETH
that the narty of the first part, in consideration of $10.00 and
other good and valuable consideration paid by the party of the
second part, DOES ~REBY ~RANT AND ~ unto the party of
the second part, its successors and asszgns forever, THE
DEVELOPMENT RIGHTS, by which is meant the permanent legal
interest and right, as authorized by §~247 of the New York State
General Municipal Law as amended, to permit, require or restrict
the use of the premises exclusively for agricultural production
that term is presently defzned in )§301 of the New York State
Agriculture and Markets Laws, and Suffolk County Local Law 16-81
and the right to prohibit or restrict the use of the premises for
any purpose other than agricultural production, to the property
described as follows:
ALL that certain plot, piece or parcel of land, situate, lying
and being at East Cutchogue, Town of Southold, County of Suffolk
and State of New York, bounded and described as follows:
BEGINNING at a point on the Northerly side of Main Road, at
the southwesterly corner of the hereinafter described parcel, said
point being distant 880 feet more or less northeasterly, as
measured along the Northerly side of Main Road, from the corner
formed by the intersection of the Northerly side of Main Road with
the northeasterly side of Bridge Lane; running thence thru lands
of Jdhn C. Bedell and Susan, his wife the following (3) courses

The above described premises are a portion of the premises
conveyed to the grantors by deed recorded in Liber 8755 cp 565.
The excepted parcels that are being retained by the grantors and
are more particularly bounded and described as follows:
BEGINNING at a point on the Northerly side of Main Road
distant 560 feet more or less Northeasterly, as measured along the
same from the corner formed by the intersection of the
Northeasterly side of Bridge Lane, with the Northerly side of Main
Road, said point being also at the Southeast Corner land now or
formerly of Joseph P. and Margaret Szymanowski;
RUNNING THENCE along said land, North 54 degrees 44 minutes 25
seconds West 360 feet; /

BEGINNING at an interior point on the Southerly corner of the
hereinafter described parcel where the same is intersected by the

formed by the intersection of the Northeasterly side of Bridge

Northeasterly side of Map of Ismar Acres, Number 5872, North 55°
54' 05" West 330 feet to the Southeasterly side of land now or
formerly of Richard A. Foster and Margaret, his wife;

TO HAVE AND TO HOLD the said Development Rights in the
premises herein.granted unto the party of the second part,
successors and assigns, forever;

AND the party of the first part covenants that the party of
the first part has not done or suffered anything whereby the said
premises have been encumbered in any way whatever, except as
aforesaid. The party of the first part, as a covenant running
with the land in perpetuity, further covenants and agrees for the
party of the first part, and the heirs, legal representatives,
successors and assigns of the party of the first part, to use of
the premises on and after the date of this instrument solely for
the purpose of agricultural production.
The development rights conveyed herein are subject to the further
terms and provisions as set forth in a certain contract of sale
between the parties hereto dated July 16, 1983 as the same is
recorded in the office of the Suffolk County Clerk in Liber ~
Page 312, portions of which as contained herein have and will
surviv~-~ the delivery of this instrument of conveyance.
The word "party" shall be construed as if it read "parties"
whenever the sense of this indenture so requires.
IN WITNESS WI{EREOF, the party of the first part has duly
