OF
DEVELOPMENT RIGHTS
THIS INDENTURE made the 2, day of &rlekj ' 1978 ,
between LAWRENCE CHEN and FRANK CHO, c/o Michael L. Weinstein,
425 Broad Hollow Road, Melville, New York, party of the first
part, and the COUNTY OF SUFFOLK, a municipal corporation having
its office and principal place of business at Riverhead, New
York, party of the second part;
WITNESSETH
That the party of the first part, in consideration of $10 .00 and
other good and valuable consideration paid by the party of the
second part, does hereby grant and release unto the party of the
!, second part, its successors and assigns forever, the Development
Rights, by which is meant the permanent legal interest and right,
as authorized by Section 247 of the New York State General Munic-
ipal Law, as amended, to permit, require or restrict the use of
the premises exclusively for agricultural production as that term
�- is presently defined in Section 301 of the New York State Agri-
IS 1 cultural and Markets Laws, and the right to prohibit or restrict
the use of the premises for any purpose other than agricultural

ALL that certain plot, piece or parcel of land with the buildings
S E thereon erected, situate, lying and being at Peconic, in the
Town of Southold, County of Suffolk and State of New York, bounded
and described as follows:
BEGINNING at a point on the southeasterly side of Middle Road
� f (C.R. 27) distant 470. 39 feet northeasterly as measured along the
southeasterly side of Middle Road from the extreme northeasterly
end of the arc of the curve connecting the southeasterly side of
Middle Road with the northeasterly side of Bridge Lane;
RUNNING THENCE Northeasterly along the southeasterly side of
Middle Road along the arc of a curve bearing to the left having
a radius of 7699 . 44 feet a distance along said curve of. 52 . 08
feet to a monument and land now or formerly of P.A. Brown and
M.F. Looney;
THENCE along the last mentioned land the following 2 courses and
distances :
1) South 54 degrees 58 minutes 00 seconds East 141 . 03 feet to a
point;
2) North 35 degrees 02 minutes 00 seconds East 150 . 00 feet to a
monument and land now or formerly of Lawrence Chen and Frank Chc ;
C THENCE along the last mentioned land the following 2 courses and
distances :
1) South 54 degrees 58 minutes 00 seconds East 951. 47 feet to
point;
2) South 50 degrees 47 minutes 00 seconds West 354 . 52 feet to a
monument and land now or formerly of ' Subdivision - "Ismar
Acres" Suffolk County File #5872 ' ;

THENCE North 55 degrees 00 minutes 40 seconds West along the last
mentioned land and along land now or formerly of Atchez DePrez,
582. 94 feet to a point and land now or formerly of Antone and
Bertha Pawluczyk;
THENCE North 54 degrees 41 minutes 40 seconds West along the last
mentioned land 193. 86 feet to a point;
THENCE North 55 degrees 39 minutes 05 seconds East, 150. 00 feet;
THENCE North 54 degrees 41 minutes 40 seconds West, 7.90 . 00 feet
to the southeasterly side of Middle Road at the point or place
OG BEGINNING.
TO HAVE AND TO HOLD the said Development Rights in the premises
herein granted unto the party of the second part, its successors
and assigns, forever.
SUBJECT to the Trust Fund Provisions of Section 13 of the Lien Law
of the State of New York.
THE party of the first part covenants that the party of the first
part has not done or suffered anything whereby the said premises
have been encumbered in any way whatever, except as aforesaid.
The party of the first part, as a covenant running with the land
in perpetuity, further covenants and agrees for the party of the
first part, and heirs , legal representatives , successors and
assigns of the party of the first part, to use the premises on
and after the date of this instrument solely for the purpose of
agricultural production.
BEING -re same premises as were conveyed to the party of the first
part by deed dated December 26, 1973 and recorded January 3, 1974
in Liber 7563 Page 20.
The word "party" shall be construed as if it read "parties" whenev r
the sense of this indenture so requires.
IN WITNESS WHEREOF, the party of the first p t has duly executed
