THIS INDENTURE made the day of 'V eWLV' , 1978 ,
!,, between LAWRENCE CHEN and FRANK CHO, c/o Michael L. Weinstein,
425 Broad Hollow Road, Melville, New York, party of the first
, part, and the COUNTY OF SUFFOLK, a municipal corporation having
its office and principal place of business at Riverhead, New
York, party of the second part;
Ii WITNESSETH
That the party of the first part, in consideration of $10 . 00 and
'i other good and valuable consideration paid by the party of the
second part, does hereby grant and release unto the party of the
second part, its successors and assigns forever, the Development
Rights, by which is meant the permanent legal interest and right,
as authorized by Section 247 of the New York State General munic-
ipal Law, as amended, to permit, require or restrict the use of

is presently defined in Section 301 of the New York State Agri-
cultural and Markets Laws , and the right to prohibit or restrict
the use of the premises for any purpose other than agricultural

ALL that certain plot, piece or parcel of land, situate , lying and
a K being at East Cutchogue , Town of Southold, County of Suffolk and
State of New York, bounded and described as follows :
BEGINNING at a monument on the southeasterly side of Middle Road
G OT (C .R. 27) distant 681 . 69 feet northeasterly when measured along
the southeasterly side of Middle Road from the extreme northeast-
erly end of the arc of a curve connecting the said southeasterly
side of Middle Road with the northeasterly side of Bridge Lane ;
RUNNING THENCE North 54 degrees 35 minutes 34 seconds East along
the southeasterly side of Middle Road and passing thru a monument
292 . 93;
THENCE South 54 degrees 18 minutes 50 seconds East, 290. 00 feet;
THENCE North 54 degrees 35 minutes 34 seconds East, 150 . 00 feet to
land now or formerly of the County of Suffolk;

THENCE South 54 degrees 18 minutes 50 seconds East along last
mentioned land and land now or formerly of Martha Stojan 1022. 00
feet to the northwesterly line of land of Long Island Railroad;
THENCE Southwesterly, northwesterly and again southwesterly along
the last mentioned line the following three courses and distances :
ii 1) South 46 degrees 23 minutes 40 seconds West, 436 . 83 feet to
a stake;
2) North 54 degrees 44 minutes 50 seconds West, 20. 39 feet;
3) South 46 degrees 23 minutes 40 seconds West, 321 . 50 feet to
land now or formerly of Subdivision "Ismar Acres" Suffolk

�ITHENCE North 55 degrees 00 minutes 20 seconds West, along last
mentioned land , 347. 46 feet to a monument and land now or formerly
of Lawrence Chen and Frank Cho;

THENCE Northeasterly and northwesterly along last mentioned land
the following two courses and distances :
1) North 50 degrees 47 minutes 00 seconds East, 354 . 52 feet to a
point;
2) North 54 degrees 58 minutes 00 seconds West and passing through
a monument and along land now or formerly of P.A. Brown and
M.F. Looney, 1, 039 . 20 feet to the monument in the southeasterly
side of Middle Road at the point or place of BEGINNING.
TO HAVE AND TO HOLD the said Development Rights in the premises
herein granted unto the party of the second part, its successors
and assigns , forever.
SUBJECT to the Trust Fund Provisions of Section 13 of the Lien Law
of the State of New York.
THE party of the first part covenants that the party of the first
part has not done or suffered anything whereby the said premises
have been encumbered in any way whatever , except as aforesaid.
The party of the first part, as a covenant running with the land
in perpetuity, further covenants and agrees for the party of the
first part, and heirs , legal representatives, successors and
assigns of the party of the first part, to use the premises on
and after the date of this instrument solely for the purpose of
agricultural production.
BEING the same premises as were conveyed to the party of the first
part by deed dated May 1, 1973 and record June 5 , 1973 in Liber
7411 Page 497 .
The word "party" shall be construed as if it read "_parties" whenev:
the sense of this indenture so requires.
IN WITNESS WHEREOF, the party of the first part has duly executed
this deed the day and year first abovewr ' ten.
