DEVELOPMENT RIGHTS

1979, between ORIENT REALTY COMPANY, a partnership, with offices

and the COUNTY OF SUFFOLK, a municipal corporation having its
office and principal place of business at Riverhead, New York,
party of the second part;

That the party of the first part, in consideration of

party of the second part, does hereby grant and release unto
the party of the second part, its successors and assigns forever,
the Development Rights, by which is meant the permanent legal
interest and right, as authorized by s247 of the New York State
General Municipal Law as amended, to permit, require or restrict
I (2the use of the premises exclusively for agricultural production
/-\ as that term is presently defined in s 301 of the New York State
Agriculture and Markets Laws, ani] the right to prohibit or re-
strict the use of the premises for any purpose other than agri-
cultural production, to
C ALL that certain plot, piece or parcel of land, with the build-
ings thereon erected, situate , lying and being at Orient, in the
n Town of Southold, County of Suffolk and State of New York,
bounded and described as follows:
BEGINNING at a monument on the northerly side of Main Road (New
York State Route 25) where the same is intersected by the westerly
side of land now or formerly of Lloyd E . Terry, formerly Caroline
Terry, formerly Marcus Terry;
Running thence South 86 degrees 40 minutes 50 seconds West, along
the northerly side of Main Road, 433 .71 feet to a monument and
\ land now or formerly of William C . & Lillian A . Rose ;

Thence North 8 degrees 09 minutes 40 seconds West, along the last
mentioned land, 249. 61 feet to a monument and land formerly of
Orient Realty Co . , now or formerly of Lillian A. Rose ;
Thence along the last mentioned land the following two courses
and distances :
1) North 12 degrees 41 minutes 30 seconds West, 441.82 feet to
a point;
2) South 77 degrees 18 minutes 30 seconds West, 212 . 15 feet to
a point and land now or formerly of William D . Tuthill, etal .
Thence North 13 degrees 12 minutes 10 seconds West, along the
last mentioned land, along the easterly terminus of Whalers Road
(under construction) along Subdivision "Map of Soundview Acres at
Orient" , and along the easterly terminus of Soundview Road,
1881. 25 feet to the average high water mark of Long Island Sound;
Thence along the average high water mark of Long Island Sound,
the following two tie line courses and distances:
1) North 81 degrees 05 minutes 40 seconds East, 314 .68 feet;
2) North 78 degrees 43 minutes 50 seconds East 259 . 69 feet to
land now or formerly of Lloyd E . Terry;
Thence South 14 degrees 05 minutes 00 seconds East, along the
last mentioned land and passing thru two monuments, 2616 .00 feet
to the monument on the northerly side of Main Road at the point
or place of BEGINNING .
SUBJECT to the trust fund provisions of Section
Thirteen of the Lien Law.
TO HAVE AND TO HOLD the said Development Rights in the
premises herein granted unto the party of the second part, its
successors and assigns, forever;
AND the party of the first part covenants that, the
party of the first part has not done or suffered anything whereby
the said premises have been encumbered in any way whatever,
except as aforesaid . The party of the first part, as a covenant
running with the land in perpetuity, further covenants and
agrees for the party of the first part, and the heirs, legal
representatives, successors and assigns of the party of the
first part, to use of the premises on and after the date of this
instrument solely for the purpose of agricultural production.
