(631) 765-1809 Fax (631) 765-9064 FINDINGS, DELIBERATIONS AND DETERMINATION MEETING OF JUNE 16, 2009 RECEIVED-~ JUN 2 9 2OO9 ZBA FILE # 6278 - VINCENT and LAURA MANETTI, Applicants PROPERTY LOCATION: 150 West Shore Drive, Southold CTM 1000-80-5-5.1 adjacent to Southold Bay SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review fails under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. PROPERTY FACTS/DESCRIPTION: The subject property is a non-conforming 15,527 square foot lot in the Residential R-40 District with a 70.55 ft. frontage along West Shore Drive, 63.28 fl. along Peconic (Southold) Bay, 269.7 ft. on the easterly property boundary, and 227.12 ft on the westerly property boundary. It is improved with a single family dwelling add attached seaward deck. BASIS OF APPLICATION: Requests for Variances under Sections 280-116-B and 280-122, based on the Building Inspector's November 19, 2008 Notice of Disapproval concerning proposed additions and alterations to the existing single-family dwelling. The reasons stated for disapproving the building permit application are that the new construction will constitute an increase in the degree of nonconformance on a single side yard, on total (both) side yard setbacks, and at less than 75 feet from the bulkhead. LWRP DETERMINATION: A Letter dated May 12, 2009 from Mark Terry, LWRP Coordinator, confirming inconsistency was subnfiltted to the Board of Appeals under Chapter 95, Waterfront Consistency Review of the Town of Southold Code and LOcal Waterfront Revitalization Program (LWRP) standards. A letter dated May 20, 2009 from Nicole Spinelli, District Technician, of Suffolk County Soil and Water noted that upon site inspection on May 19, 2009, there were no observed natural resources concerns with regard to the construction of additions to the residence. The existing-bluff is stable and well vegetated. Potential adverse environmental impacts by granting the relief requested will be mitigated by the applicant's proposed removal of the existing non-conforming sanitary system located less than 100 ft from the bulkhead and replacement with an upgraded sanitary system located more than 100 ft from the bulkhead; addition of new gutters and leaders and drywells to capture and recharge roof runoff; and establishment of a six-foot wide non-turf buffer at the top of the slope leading to Southold Bay. The applicant proposes additions and alterations to their existing 1.5 story dwelling that will repair structural problems and a leaking roof and chimney as follows: construct a 1.5 story addition and covered porch addition in placeof existing sunroom and portion of attached deck to be removed; reconstruct (in place) a portion of the existing attached deck to remain; construct new gabled roof with dormer addition over existing one story portion of dwelling. These proposed additions and alterations will maintain the existing non-conforming single side yard setback of 9.7 ft from the corner of the existing dwelling and 8.8 ft from the corner of the existing deck where 10 ft. is required, maintain the existing non-conforming total side yard setback of 20.1 feet where 25 is required, and maintain the existing non-conforming setback from the bulkhead of +/- 47 feet. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Town Law §267-b(3)(b)(3)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. Proposed additions and alterations will all take place within the existing structural footprint with no further encroachment on the pre-existing non-conforming setbacks. The renovations will improve the appearance of the dwelling and correct substandard construction. The proposed architectural design is in. keeping with other homes in the neighborhood. 2. Town Law §267-b(3)ib)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue; other than area variances because the existing dwelling has pre-existing non-conforming setbacks. Therefore, any new construction or replacement of existing structures will require variances. 3. Town Law §267-b(3)ib)(3). The variances granted herein are not substantial in so far as no increase in the pre- existing nonconforming setbacks is being proposed. The setback relief of 47.8 ft. from the bulkhead represents 28 feet or 37% from the required 75 ft. and is mathematically substantial; the relief for the single side yard setback of 8.8 ft where 10 feet is the minimum required, is 1.2 feet or 12%, which is not substantial; the relief for a total side yard setback of 20.1 ft where 25 feet is required represents 4.9 ft. or 19.6 %, and is substantial. 4. Town Law §267-b(3)(b)(5}. The difficulty has not been self-created, but is the result of previous substandard construction that caused structural deterioration and leaking, and pre-existing non-conforming setbacks. 5. Town Law §267-b(:~)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have ah adverse impact on the physical or environmental conditions in the neighborhood. The existing bluff is stable and well vegetated. All construction will be within the footprint of existing structures and no increase in setback non-conformities is proposed. 6. Town Law §267-b..'Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of additions and alterations to their existing dwelling, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. Kramer, Architect and labeled first floor plan, second floor plan, south elevation, east elevation, north elevation, and west elevation, subject to the following conditions: 1. Removal of the existing non-conforming sanitary system that is currently located less than 100 feet from the bulkhead, and replacement with an upgraded sanitary system located more than 100 ft from the bulkhead and wetlands; 2. Incorporate a drainage system of gutters and leaders and drywells to capture and recharge roof runoff (as per code); 3. Establish a 6 ft. wide non-turf buffer of native coastal plantings at the top of the slope leading to Southold Bay; 4. A line of stacked hay bales be installed prior to construction (remaining during construction). That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Any deviation from the Variance given such as extensions, or demolitions which are not shown on the applicant's diagrams or survey site maps, are not authorized under this application when involving nonconformities under the zoning code. This actidn does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. The site was evaluated for potential natural rcsonrce concerns regarding the construction of additions to the r~sidcncc. At the time of this site visit, May 19, 2009, there were no obs~a-ved natural resource concerns. The house is partially fitted with gutters and downspouts; the lack of gutters on the remaining roof is not resulting in erosion. The rear yard is in grass cover and slopes to the east. The property is situated on Southold Bay and is proteeted by a short wooden bulkhead. Therc exists wooden stain that lead down to a sand beach. The bulkhead is currently in stabile condition; no erosion at the toe waz observed. The bluffwas also in stabile condition; it is densely vegetated, mostly with rose, small shrubs and weeds, One minor concern is thc condition of the ~stairs, The stairs are in nccd of repair, especially at the top of the bluffwhere the side boards are beginning to scparate from the railing. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to us, it is our recommendation that the proposed action is INCONSISTENT with the denoted following Policy Standard and therefore is INCONSISTENT with the LWRP. Policy 6. Protect and restore the quality and function of the Town of Southold ecosystem. 6.3 Protect and restore tidal and freshwater wetlands. The separation distance from the bulkhead to the proposed actions is approximately 62 feet~ all buildings or structures shall be set back not less than 75 feet from the bulkhead pursuant to § 280-116. Moreover, the proposed renovations have been designed to maintain the traditional New England architectural style typical of the existing home and surrounding homes within the neighborhood. 2. The benefit sought by the applicant cannot be achieved by some method feasible for the applicant to pursue, other than an area variance, because: a) Due to the preexisting location of the deck and sunroom less than 75 feet from the bulkhead, the in-place replacement of the deck and in-place replacement of portions of the deck and sunroom with an addition and porch unavoidably require relief from Article XXII Section 280-116(B). Neither the easterly dormer addition nor the southerly 1.5-story addition requires relief from the 75' bulkhead setback. b) Due to the preexisting 8.8' and 11.3' side-yard setbacks of the principal structure, any additions to the principal structure unavoidably require relief from Article XXIII Section 280-122(A) pursuant to the interpretation that they would increase the degree of non-conformance with th~ minimum and total sldetyard setbacks set forth by Article XXIII Section 280-124{B). In this case, the applicant seeks the benefit of correcting the substandard de~:fihd~.i:ff/ist~dti6k~iffthe easterly and northerly portions ofthe existing dwelling. Specifically, ontheeast sideofthe house, the roof slope is too shallow to drain water properly due to the intersection of the original roof and that portion of roof apparently added as part of a past renovation, which provides a continual source of leakage. The proposed easterly dormer additions will thus create an upper story beneath an entirely new roof in that problematic area designed to match the roof slope and donner style of the original house. On the north side of the house, the wall separating the original dwelling from the sunroom apparently added as part of a past renovation bisects the existing stone chimney, causing part of the chimney to be interior and part exterior, resulting in a continual source of leakage from the underside of the roof to the basement. The proposed northerly addition will fully incorporate the stone chimney to the interior by extending the original roofline of the house. 3. The amount of relief requested is not substantial because: a) The bulkhead setback relief requested from Article XXII Section 280-116(B) for the deck replacement is mathematically substantial (28 feet or 37% relief) but not substantial in fact, as the existing deck will be replaced in the same location and configuration. The relief necessary for the northerly dwelling addition (12 feet or 16%) and porch (3 feet 4%) is neither mathematically substantial nor substantial in fact, as both structures will be constructed in place of and within the footprint of existing structures. The additions requiring setback relief from the bulkhead will thus maintain and not diminish the preexisting nonconforming bulkhead setbacks. b) The relief requested from Article XXIII Section 280-122(A) (i.e., relief from Article XXIII Section 280-124(B) to maintain an 8.8' minimum side-yard setback where 10 feet is required (1.2 feet or 12%) and a total side-yard setback of 20.1 feet where 25 feet is required (4.9 feet or 19.6%)) is not substantial because the structures requiring side-yard relief will be constructed in place of, entirely within, or over the preexisting structural footprint, thus maintaining and not diminishing the preexisting nonconforming side-yard setbacks. The project will not have an adverse impact on physical or environmental conditions because there will not be any significant change in the developed nature of the property, and there will be a net improvement to the ecological condition of the site as a result of the incorporated mitigation measures. Specifically, while the project will result in a nominal increase in the coverage of the parcel's buildable area of 349 square feet or 2.3 percent, it will incorporate the following environmental enhancements: a) The existing nonconforming sanitary system located less than 100 feet from wetlands will be replaced with an upgraded sanitary system located more than 100 2 feet from wetlands, which meets the current standards of the Suffolk County Department of Health Services; b) A drainage system of leaders, gutters, and drywells will be added to capture and recharge roof runoff from the renovated dwelling, which will decrease the volume of surface water runoff on the property; c) A 6' wide, approximately +380 square-foot nonturfbuffer will be established adjacent to the top of the slope leading to Southold Bay, wherein native, non- fertilizer-dependent vegetation will be planted, thereby increasing the amount of wildlife habitat on the property and improving the property's absorption and cleansing capacity of surface water runoff. The net result of implementing these mitigating measures will be a net improvement to both subsurface and surface water quality via improved domestic sewage treatment and a net reduction not only of the flow rate and volume of runoff potentially entering Southold Bay but of the potential concentration of fertilizers, fungicides, and other chemicals contained therein. The project was granted Wetlands Permit 6930 by the Board of Town Trustees on July 23, 2008, and the project is situated beyond the Tidal Wetlands jurisdiction of the New York State Department of Environmental Conservation.
