whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this conveyance and will hold the right to receive such consid-
eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply
the same first to the payment of the cost of the improvement before using any part of the total of the same for
any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.

ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon
erected, situate, lying and being at Nassau Point, in the town of Southold, County of Suffolk and
State of New York, being part of Lot 180, as shown on "Amended Map A of Nassau Point", and
filed in the office of the Clerk of the County of Suffolk on August 16, 1922, as Map. No. 156,
being bounded and described as follows:
BEGINNING at a point in the northerly side of Old Cove Road, formerly known as Broadwaters
Road, where the same is intersected by the easterly side of Lot 181 on the aforesaid map;
running thence North 9 degrees 18 minutes 20 seconds West, along the easterly side of said Lot
181, 511.83 feet to the ordinary high water mark of Broadwaters Cove; thence along the same,
on a tie line of North 80 degrees 41 minutes 40 seconds East, 5 feet; thence along land now or
formerly of Dowden; 1) South 9 degrees 18 minutes 20 seconds East 265 feet, and 2) North 80
degrees 41 minutes 40 seconds East, 111.64 feet to the westerly side of Nassau Point Road;
thence southerly along the westerly side of Nassau Point Road on an irregular curve bearing to
the right 200 feet more or less; said irregular curve having a tie line of South 2 degrees 34
minutes 00 seconds east, and a length of 199.98 feet to the northerly side of Old Cove Road and
thence westerly along the northerly side of Old Cove Road on a curve to the right, a distance of
105 feet more or less; said curve having a tie line of South 53 degrees 19 minutes 30 seconds
West and a length of 104.91 feet to the point or place of BEGINNING.
Being and intended to be the same premises as was conveyed by Sigmond F. Sarnowski and Ann
H. Samowski, his wife to Walden H. Leverick by deed recorded 7-24-1968 in Liber 6387 cp 221
and also the same premises conveyed by Walden H. Leverick to Harold C. Pownall by deed
recorded on 6-19-1972 in Liber 7180 cp 433 and also the same premises conveyed by Harold C.
Pownall to Carl A. Braun, Jr. and Joan Braun, his wife by deed recorded on 9-3-1975 in Liber
7902 cp 416 and also the same premises conveyed by Carl A. Braun, Jr. and Joan Braun, his
wife to Anthony E. Vallace and Yvonne A. Vallace, his wife by deed recorded on 5-20-1980 in
Liber 8825, cp 84.
