or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate,

Of Suffolk and State of New York, known and designated on a certain map
entitled "Subdivision Map of Peconic Bay Properties, as Lot Number 23
" and part of Lot 22 , being more particularly bounded and described as
follows:
{ BEGINNING at a point on the northerly side of Haywaters Road where the
same is intersected by the westerly side of Lot Number 24 on the above
mentioned map; RUNNING THENCE along the northerly side of Haywaters Road
the following two (2) courses and distances:
1. ) North 54 degrees 50 minutes 10 seconds West 48. 03 feet;
2 . ) North 48 degrees 00 minutes 00 seconds West 51. 97 feet;
THENCE North 30 degrees 00 minutes East 30 feet more or less to the
ordinary high water mark of Haywaters Cove; THENCE easterly along the
ordinary high water mark of Haywaters Cove 100 feet more or less to the
westerly side of Lot Number 24 on the above mentioned map; THENCE along
the westerly side of Lot Number 24 on the above mentioned map South 30
degrees 09 minutes 50 seconds West 60 feet more or less to the northerly

SAID PREMISES being known as and by 5 Haywaters Road, Cutchoque, N.Y.
Grantor herein is the same person as grantee in deed dated 3/7/88 and
recorded in the Suffolk County Clerk's Office on 3/23/88 in Liber 10567

TOGETHER WITH all right, title and interest, if any, of theparty of the first
part and in and to any and all lands under water adjacent to the subject premises.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances
and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO
HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of
the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this conveyance and will hold the right to receive such consid-
eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply
the same first to the payment of the cost of the improvement before using any part of the total of the same for
