- That the party of the first.part, in consideration of Ten and 00/100
($10.00) Dollars and other good and valuable consideration paid by the party of

the second part, does hereby grant and release unto the party of the second part
its successors and assigns forever, the Development Rights, by which is meant
3� the permanent legal interest and right, as authorized by Sec.247 of the New
York State General Municipal Law, as amended, to permit, require or restrict the
use of the premises exclusively for agricultural production as that term is pre-
sently defined in Sec. 301 of the New York State Agricultural and Markets Iaws,
and the right to prohibit or restrict the use of the premises for any purposes
other than agricultural production, to
ALL that certain plot, piece or parcel of land, situate,

lying and being at Cutchogue, Town of Southold, aunty of Suffolk,
State of New York, more particularly bounded and described as
follows:
BEGINNING at a pipe on the easterly line of New Suffolk Road,
323.74 feet northerly along said easterly line from the point where
said easterly line is intersected by the direct extension easterly
of the center line of. Wick's Road; running thence North 9°03' 20"
West, along the easterly side of New Suffolk Road, 1201.42 feet to
a pipe and land now or formerly of Henry P. Wickham; thence South

219.19 feet to a monument; thence South 181 33' 25" West, 432.40

feet; thence South 60° 27' 20" West, 355.54 feet to a pipe

and land now or formerly of the Estate of Margaret L. Breaker
and James Parker Wickham, Jr. ; thence North 720 00' 30" West,
along the last mentioned land, 485.00 feet to the pipe on
the easterly line of New Suffolk Road, at the point or place
of BEGINNING.
TO HAVE AND TO HOLD the said Development Rights in the premises herein
granted unto the party of the second part, its successors and assigns, forever.
SUBJECT to the trust fund provision of Sec. 13 of the Lien Law.
AND the party of the first part covenants that the party of the first
part has not done or suffered anything whereby the said premises have been en-
jcimibered in any way whatever, except as aforesaid. The party of the first part,
as a covenant running with the land in perpetuity, further covenants and agrees
for the party of the first part, and the heirs, legal representatives, successor
and assigns of the party of the first part, to use the premises on and after
the date of this instrument solely for the purpose of agricultural production.
The word "party" shall be construed as if it read "parties" whenever
the sense of this indenture so requires.
IN WITNESS WHEREOF, the party of the first part has duly executed this
deed the day and year first above written.
