WITNESSETH, thaNothiirst part, in considellon of ten dollars and other valuable consideration
paid by the party of thS second part, iloes hereby grant and release unto the party of the second part, the heirs
or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate,
lying and beingittxher at Nassau Point Cutchogue, Town of SouthhoId, Suffolk County,
New York, designated on a certain map entitled, "Subdivision Map of Peconic Bay
Properties, Inc. " surveyed February 6, 1931 by Otto W. 4'an Tuyl, Surveyor, and
filed in the Suffolk County Clerk's Office on April 15, 1931 as Map No. 786.
PARCEL I Lot No. 13, and that portion of Lot No. 14 on said map, bounded and
described as follows:
BEGINNING at a point on the Southwesterly line of Haywaters Road marking the
division line between Lots No. 13 and 14 on said map; running thence
Southwesterly along said division line 185 feet, more or less, to the ordinary
high water mark of Cutchogue Harbor; running thence through Lot No. 14, North 38
degrees 43 ' East 185 feet, more or less, to the Southwesterly line of Haywaters
road; running thence along the Southwesterly line of Haywaters Road, South 48
degrees 00 ' East 21.40 feet to the point or place of BEGINNING.
TOGETHER with all the right, title and interest of the party of the first part,
of, in and to land below the high water mark and under the waters of Cutchogue
Harbor adjacent to said premises.
PARCEL II That part of Lot No. 22 on said map, bounded and described as follows:
BEGINNING at a point on the Northeasterly line of Haywaters Road South 48 degrees
00 ' East 25 feet as measured along the Northeasterly line of Haywaters Road from
the division line between Lot Nos. 21 and 22 on said map; running thence along
land of Perrone, North 30 degrees 00 ' East 20 feet, more or less, to ordinary
high water mark of Haywaters Cove; running thence Southeasterly along said high
water mark of Haywaters Cove, 25 feet more or less; running thence South 30
degrees 00 ' West 40 feet, more or less, to the Northeasterly line of Haywaters
Road; running thence along said Northeasterly line of Haywaters Road, North 48
degrees 00 ' West 25 feet to the point or place of BEGINNING.
TOGETHER with the right to maintain one water connection and subject to the
obligations thereto as contained in Agreement dated May 19, 1967 between former
Grantor, Herman W. Johnston, and Francis S. and Priscilla Perrone and recorded in
Suffolk County Clerk 's Office in Liber 6156, Page26;
BEINC the saire Premises conveyed to Grantors by William F. and Allysse E. Johnston
by Deed dated May 21, 1976, recorded June 2, 1976, Liber 8043, Page 138.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances
and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO
HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of
the party of the second part forever.

AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this conveyance and will hold the right to receive such consid-
eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply
the same first to the payment of the cost of the improvement before using any part of the total of the same for
any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture 5o requires.

Nassau Point , Cutchogue, Town of Southold, Suffolk County, New York,
designated on a certain map entitled, "Subdivision Map of Peconic Bay.
Properties, Inc. " surveyed February 6, 1931 by Otto Van Tuyl, Surveyor and
filed in the Suffolk County Clerk' s Office on April 15, 1931 as Map No. 786
that part of Lot No. 22 on said map, bounded and described as follows :
BEGINNING at a point on the Northeasterly line of Haywaters Road South 48
degrees 0 feet East 25 feet as measured along the Northeasterly line of
Haywaters Road from the division line between Lot Nos. 21 and 22 on said map;
RUNNING 'THENCE along land of Perrone, North 30 degrees 0 feet East 20 feet,
more or less, to rodinary high water mark of Haywaters Cove;
RUNNING THENCE Southeasterly along said high water of Haywaters Cove, 25 feet
more or less;
RUNNING THENCE South 30 degrees 0 feet West 40 feet, more or less, to the
Northeasterly line of Haywaters Road;
RUNNING THENCE along said Northeasterly. line of Haywaters Road, North 48
degrees 0 feet- West 25 feet to the point or place of BEGINNING.

designated as all of Lot 13 and part of Lot 14, on a certain map entitled,
"Subdivision Map of Peconic Bay Properties, Inc. " surveyed February 6th, 1931
by Otto W. Van Tuyl, Surveyor and filed in the Suffolk County Clerk's Office
on April 15th, 1931 as Map No. 786, being bounded and described as follows:
BEGINNING at a point on the Southerly side of Haywaters Road (private) at the
point where the division line of lots 12 and 13 as shown on said map
intersects said Southerly side of Haywaters Road;
RUNNING THENCE along said division line South 41 degrees 41 minutes 50 seconds
West- 184 . 70 feet to the ordinary high water line of Curchogue Harbor;
THENCE. along said high water line of Cutchogue harbor, North 49 degrees 05
minutes 30 seconds West 76.70 feet;
THENCE North 38 degrees 43 minutes 00 seconds East 180 . 50 feet to the
Southerly sidg&of Haywaters Road;
