Martin Sidor: Good evening, and welcome to a special meeting of the Southold Town
Planning Board. We need a motion to open the special meeting on the Harbes' Horse
Barn Final Determination.

SITE PLANS
Final Determinations:
Harbes' Horse Barn - This proposed site plan is for an 875 s.f. agricultural barn. The
property is located at 715 Sound Avenue, 500' west of the intersection of Aldrich Lane
and Sound Avenue, in Mattituck. SCTM#1000-120-1-4

George Solomon: WHEREAS, the applicant, David Harbes, submitted a formal site
plan application on May 18, 2009 for an 875 s.f. agricultural barn on a 15.5-acre parcel
located 500' west of the intersection of Aldrich Lane and Sound Avenue, in Mattituck;
and
WHEREAS, on May 18, 2009, the Planning Board accepted this application; and
WHEREAS, on May 21, 2009, the Planning Board, pursuant to Southold Town Code
§280-131 C., distributed the application to agencies having jurisdiction for their
comments, and the following agencies responded: Town Engineer, Suffolk County
Planning Commission, and the Mattituck Fire District; and
WHEREAS, the comments from those agencies referenced above were received and
accepted by the Planning Board, discussed with the applicant, and incorporated into the
site plan to the satisfaction of the Planning Board; and
WHEREAS, on May 29, 2009, the Southold Town Building Inspector reviewed the plan
and certified that the proposed agricultural building is a permitted use in this Agricultural
Conservation Zoning District; and
WHEREAS, the Southold Town Planning Board, pursuant to Southold Town Code
§280-131 B (5), has the discretion to vary or waive the parking requirements for site
plan applications where doing so would not have a detrimental effect on the public
health, safety or general welfare, and will not have the effect of nullifying the intent and
provision of the site plan requirements chapter of the Town Code. The Planning Board
has found that this application is eligible for a waiver of parking requirements because
there is no need to provide for parking - the barn is being used to house only a few
animals on an active farm where space for the parking of farm vehicles is ample, and
there will be no public access to the barn; and
WHEREAS, the Southold Town Planning Board, pursuant to Southold Town Code
§280-131H., has the discretion to waive the public hearing requirement for applications
involving uses strictly related to agriculture. The Planning Board has found that the
public hearing for this application may be waived for the following reasons: the use is
strictly related to agriculture, the barn that is being placed on the site is small (875 s.f.)
relative to the size of the property (15.5 acres), the barn is being used to house animals
and is not open to the public, the site is already used to house animals and the uses on
site will not change as a result of this barn being placed on the property, and the barn is
being placed in a location welt away from any property lines (>100'); thus, it has been
determined that the proposed barn would not have an adverse effect to surrounding
properties or the Town in general; and
WHEREAS, the Southold Town Planning Board, pursuant to Southold Town Code
§280-133 C., has the discretion to waive any or all of the requirements for site plan
approval for those applications involving uses strictly related to agriculture where such
requirements are not necessary to protect and maintain the public health, safety, or

welfare and to further the objectives set forth in §280-129. The Planning Board has
found that requiring the entire set of site plan application requirements for this site is not
necessary to further the objectives set forth in Town Code §280-129 and maintain
public health, safety, and welfare for the following reasons: the application is for a small
wood-frame barn (875 s.f.) being placed on an active farm property (15.5 acres), the
barn will not be open to the public, is being placed in a location that will not interfere
with vehicle circulation on other active areas of the site, and is located well away from
any property lines (>100'); be it therefore
RESOLVED, that the Southold Town Planning Board, pursuant to State Environmental
Quality Review (SEQR) (6 NYCRR, Part 617.5 (c) (3), has determined that the
proposed action is a Type II Action, and not subject to review under SEQR;

George Solomon: and be it further RESOLVED, that the Southold Town Planning
Board hereby waives the public hearing requirement, the parking requirements, and site
plan application requirements, except for the following items:
§280-133A. (1), (2), (4), and(5), B. (1) (a)-(f), B. (3) (a) B.(4)'(a) and(i);

George Solomon: and be it further RESOLVED, that the Southold Town Planning
Board has reviewed the proposed action under the policies of the Town of Southold
Local Waterfront Revitalization Program and determined that the action is consistent as
outlined in the May 26, 2009 memo prepared by the LWRP Coordinator;

George Solomon: and be it further RESOLVED, that the Southold Town Planning
Board grant approval, and authorizes the Chairperson to endorse the site plan entitled
"Survey of a Portion of Described Property", prepared by Stanley J. Isaksen, Land
Surveyor, dated April 10, 2001, with hand-written notations by the applicant, dated
4/21/09.
