The requested modification is to allow for the construction of an 8' wide path/boardwalk for the length of the path as we had originally proposed. At the area of Freshwater Wetlands depicted on sheets (L-5 & 6 as well as C- 5 & 6); the proposed boardwalk (+ 132') shall be kept to 4' in width. Located: Fishers Island The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of S6uthold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to us, it is our recommendation that the proposed action is CONSISTENT with LWRP policy standards and therefore is CONSISTENT with the LWRP. Policy 5 Protect and improve water quality and supply in the Town of Southold. 5.2 Minimize non-point pollution of coastal waters and manage activities causing nonpoint pollution. 5.3 Protect and enhance quality of coastal waters. Policy 9 Provide for publ~ccess to, and recreational use of,~llstal waters, public lands, and public resources of the Town of Southold. 9.1 Promote appropriate and adequate physical public access and recreation to coastal resources. 9.2 Protect and provide public visual access to coastal lands and waters from public sites and transportation routes where physically practical. § 275-11 Construction and operation standards. A. General. The following standards are required for all operations within the jurisdiction of the Trustees: (2) Erosion control. Installation of an erosion control structure is necessary during any building, grading, landscaping or site work activity within Trustee jurisdiction. This structure may include, but is not limited to, installation of a silt fence, hay bales, wood chip berm and silt booms. The placement of the erosion control structure(s) shall be determined by the Trustees or their designee. All intertidal construction and excavation requires the installation of a silt boom that will retain all suspended sediments within the immediate project area. In the event the proposed actions are approved, the following BMP's are recommended: 1) To install hay bales and silt fences as an erosion control measure to retain runoff sediments during construction; within the 100' jurisdictional setback of the Board of Trustees. 2) That the bike path leading to the proposed elevated board walks be constructed of pervious materials, mitigating storm water runoff and transport of pollutants; within the 100' jurisdictional setback of the Board of Trustees. 3) Maintain buffers widths landward of wetlands to achieve a high filtration efficiency of surface runoff as determined by vegetative cover type, soil characteristics, and slope of land. 4) Where buffers (within the jurisdictional setback) may be disturbed, retain and add indigenous plants to maintain and restore values of natural ecological wetland communities. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. J.M.O. Box 1179 Southold, NY 11971 RE: Fishers Island Recreational Path Dear Mr. King: I realize that the Board has not yet had a chance to inspect various projects on Fishers Island. I am enclosing for the Board's review additional information regarding the proposed Fishers Island Recreational Path. 1. An overall map of the recreational path which was prepared using the Suffolk County Tax Map of the island. The map depicts the location of the path adjacent to the existing roadway; off of the road; shared on the road, where the boardwalks are proposed and the proposed roadway realignment. 2. An overall map of the proposed road reconstruction. Please see attached project description Project Description for Fishers Island Development Corporation Proposed Recreational Path, Fishers Island, New York Fishers Island Development Corporation (FIDCO) is proposing to reclaim and repave East End Road on Fishers Island. East End Road is a private road extending fxom Oriental Avenue eastwardly approximately 4.5 miles to the east end of the island. The existing road is approximately 20 feet wide and was last paved in the early 1970% with minimal maintenance since then. The em'rent plan calls for reclaiming the existing pavement to create a new sub base, replacing old culverts with new larger pipes, grading and repaying, with two courses of bituminous concrete. There will be some minor relocation of the road bed in two areas to accommodate construction of the proposed recreational path. Existing, unpaved storm water leak offs will be improved with rip rap in areas not adjacent to freshwater wetlands and stone trenches and landscaped swales designed to accommodate runoff from a design storm will be installed in areas near wetlands. Reference is made to the accompanying drainage report. Silt fence will be installed and maintained in areas where runoffto the wetlands is possible. This will insure no disturbance to those areas during construction. Areas adjacent to the road disturbed during the grading process with be loamed and seeded. Sta. 38+75 - 40+55- The existing 8" culvert will be replaced with a 15"pipe and the road will be raised 1'-2' to provide adequate cover over the new culvert. Sm. 148 +50- The existing culvert will be extended approximately 50 feet and a dp rap pad installed at the outlet. Sts~ 172+00- The existing culvert will be replaced with a 15" pipe, a catch basin installed and a vegetative swale constructed at the outlet. Sta. 174+50- 179+00- The road bed will be relocated approximately 10 feet to the north to accommodate constxucfion of the recreational path discussed later in this Sra. 188+50- 195+00- The road again will be relocated approximately 10 feet to the north and also raised 12% 18". Again to accommodate construction of the path. Sta~ 197+25 -200+50- The existing culvert will be replaced with 2- 15" pipes, and a concrete bin wall system installed to allow the road to be raised approximately 4 feet. Flooding is common in this area during storm events and with this, the only access to the east end of the island; it is important to keep this road passable at all times. 221 +00- 222+50- The road in this area will be raised approximately 18" in order to improve drainage at the intersection of East End Road and the gravel road extending northerly. page 2 In addition to the mad reconstruction, the Fishers Island Recreational Path Foundation is proposing construction of an 8' wide paved or boardwalk path. This path would generally follow the mad alignment for an approximate length of 3.25 miles. Several areas of this path are adjacent to property donated for conservation to the Henry L. Fergnson Museum Inc. either by F1DCO or private individuals. FIDCO is responsible for approximately 135 acres being added to the Museum land and this path will allow bicycle and pedestrian access between many of these Museum parcels. The design plans propose a corridor approximately 12 feet wide be cleared, topsoil removed, processed gravel base installed and a final 2" pavement course of bitum'mous concrete. Again, any disturbed areas will be loamed and seeded. In two of the areas where the path crosses freshwater wetlands, an elevated boardwalk with open grating is proposed. The foundation for these boardwalk sections will be helical anchors, be at least 18" above the wetlands. A third wetlands crossing, detailed below and on the plans, is proposed to have the boardwalk cantilevered from a concrete bin wall system so foundations within the wetlands will not be necessary. The concrete bins will be installed in the existing roadway. To mitigate clearing of the path route; approximately 60 major trees, 31 minor trees and 950 shrubs will be planted as part of this project. Below are key components of the path project. The path begins approximately 575 feet southerly along Wilderness Road from the intersection of Oriental Ave. and East End Road. This is proposed because of wetlands areas adjacent to East End Road-Sta~ 0+0 - 2+15. The beginning of the path follows the existing gravel access road to the capped landfill and then joins East End Road near Sm. 10+50. Sta. 27+50 - 28+80- This portion of the path is proposed to be elevated boardwalk crossing the southerly limits of a freshwater wetlands area. The option of relocating the road to the south to allow the path to be constructed outside the wetlands was considered but that would requ'n'e filling approximately 1000 square feet of wetlands on the southerly side of the road. This filling would be necessmy in order to provide property alignment and slope adjacent to the roadway. Sta. 38+75-40+75- Again, this portion of the path is proposed as elevated boardwalk. Freshwater wetlands exist on both the north and south sides of the road. Sra. 300 +00 - 352+00- The path in this area does not follow the paved road but extends northerly and easterly sharing the existing gravel road. Improvements to this road are proposed and detailed on the design plans. Sm. 131+ 75- 133+25, Sm. 170+60 172+50 and Sm. 163+50 - 166+50- The path in these areas are proposed to be elevated boardwalk because of the existing slopes along the side of the road. Excessive filling and disturbance would be necessary if acceptable slopes were proposed adjacent to the path. Two of these areas have freshwater wetlands nearby and the boardwalks as proposed will not impact these areas. Sta. 197+ 25 - 200 +50- The path in this area is proposed to be constructed on page 3 o steel beams cantilevered from a concrete bin system. The bin system will allow the road to be elevated approximately 2 -4 feet above existing road and wetlands elevation. A detail of this system is shown on the design plans. East End Road is a private road extending from Oriental Avenue eastwardly approximately 4.5 miles to the east end of the island. The existing road is approximately 20 feet wide and was last paved in the early 1970's with minimal maintenance since then. The current plan calls for reclaiming the existing pavement to create a new sub base, replacing old culverts with new larger pipes, grading and repaving, with two courses of bituminous concrete. There will be some minor relocation of the road bed in two areas to accommodate construction of the proposed recreational path. Existing, unpaved storm water leak offs will be improved with rip rap in areas not adjacent to freshwater wetlands and stone trenches and landscaped swales designed to accommodate ranoff from a design storm will be installed in areas near wetlands. Reference is made to the accompanying drainage report. Silt fence will be installed and maintained in areas where runoffto the wetlands is possible. This will insure no disturbance to those areas during construction. Areas adjacent to the road disturbed during the grading process with be loamed and seeded. Listed below are key components of the road project as shown of the design plans prepared by CME Associates, Engineering, Land Surveying and Architecture, PLLC and Mark K. Morris, on Associates LTD Landscape Architecture. 2. 3. 4. Sta. 38+75 - 40+55- The existing 8" culvert will be replaced with a 15"pipe and the road will be raised 1'~2' to provide adequate cover over the new culvert. Sta. 148 +50- The existing culvert will be extended approximately 50 feet and a rip rap pad installed at the outlet. S~ 172+00- The existing culvert will be replaced with a 15" pipe, a catch basin installed and a vegetative swale constructed at the outlet. Sta. 174+50- 179+00- The road bed will be relocated approximately 10 feet to the north to accommodate consm~ction of the recreational path discussed later in this Sta. 188+50- 195+00- The road again will be relocated approximately 10 feet to the north and also raised 12"- 18". Again to accommodate construction of the path. Sta. 197+25 -200+50- The existing culvert will be replaced with 2- 15" pipes, and a concrete bin wail system installed to allow the road to be raised approximately 4 feet. Flooding is common in this area during storm events and with this, the only access to the east end of the island; it is important to keep this road passable at ail times. 221 +00- 222+50- The road in this area will be raised approximately 18" in order to improve drainage at the intersection of East End Road and the gravel road extending northerly. p~e2 In addition to the mad reconstruction, the Fishers Island Recreational Path Foundation is proposing construction of an 8' wide paved or boardwalk path. This path would generally follow the mad alignment for an approximate lengthof3.25 miles. Several areas ofthis path are adjacent to property donated for conservation to the Henry L. Fergnson Museum Inc. either by FIDCO or private individuals. FIDCO is responsible for approximately 135 acres being added to the Museum land and this path will allow bicycle and pedeslxian access between many oftbese Museum parcels. The design plans propose a coffidor approximately 12 feet wide be cleared, topsoil removed, processed gravel base installed and a final 2" pavement course of bituminous concrete. Again, any disturbed areas will be loamed and seeded. In two of the areas where the path crosses freshwater wetlands, an elevated boardwalk with open grating is proposed. The foundation for these boardwalk sections will be helical anchors, be at least 18" above the wetlands. A third wetlands crossing, detailed below and on the plans, is proposed to have the boardwalk cantilevered from a concrete bin wall system so foundations within the wetlands will not be necessary. The concrete bins will be installed in the existing roadway. To mitigate clearing of the path mute; approximately 60 major trees, 31 minor trees and 950 shrubs will be planted as pa~ of this project. Below are key components of the path project. The path begins approximately 575 feet southerly along Wilderness Road from the intersection of Oriental Ave. and East End Road. This is proposed because of wetlands areas adjacent to East End Road-Sm. 0+0 - 2+15. The beginning of the path follows the existing gravel access mad to the capped landfill and then joins East End Road near Sta. 10+50. Sm. 27+50 - 28+80- This portion of the path is proposed to be elevated boardwalk crossing the southerly limits of a freshwater wetlands area. The option of relocating the road to the south to allow the path to be constructed outside the wetlands was considered but that would require filling approximately 1000 square feet of wetiands on the southerly side of the mad. This filling would be necessary in order to provide property alignment and slope adjacent to the roadway. Sta~ 38+75-40+75- Again, this portion of the path is proposed as elevated boardwalk. Freshwater wetlands exist on both the north and south sides of the Sm. 300 +00 - 352+00- The path in this area does not follow the paved road but extends northerly and easterly sharing the existing gravel road. Improvements to this mad are proposed and detailed on the design plans. Sm. 131+ 75- 133+25, Sm. 170+60 172+50 and Sm. 163+50 - 166+50- The path in these areas are proposed to be elevated boardwalk because of the existing slopes along the side of the mad. Excessive filling and disturbance would be necessary if acceptable slopes were proposed adjacent to the path. Two of these areas have freshwater wetlands nearby and the boardwalks as proposed will not impact these areas. Sta. 197+ 25 - 200 +50- The path in this area is proposed to be constructed on page 3 steel beams cantilevered f~om a concrete bin system. The bin system will allow the road to be elevated approximately 2 -4 feet above existing road and wetlands elevation. A detail of this system is shown on the design plans. Path ends at the drive to the golf club Sra. 204+ 50. Adequate sediment and erosion control will be provided along the path as necessary and as previously mentioned.; extensive planting will be done along the entire path as part of this project. Summary Fishers Island Development Corporation (FIDCO) retained Eschbacher VHB to review traffic (vehicle, pedestrian, bicycle) statistics for East End Road to assess the benefits of providing an adjacent recreational path for the use of walkers, joggers, and recreational bicyclists. In summary, we believe that the construction of an adjacent recreational path will be safer for pedestrians and other recreational users than the existing condition and significantly improve the East End Road corridor for all users. The adjacent path will provide walkers, joggers, end recreational bicyclists with a separate path from motor vehicle traffic. Currently, each time a motor vehicle passes a pedestrian or bicyclist in the roadway, there is a potential conflict point. Furthermore, the existing constrained cross-section (approximately 18 to 20 feet) of East End Road forces motor vehicles to pass in close proximity to pedestrians/bicyclists. The provision of a separate path for walkers, joggers, and recreational bicyclists will significantly reduce potential conflict points by better accommodating joggers, walkers, and recreational bicyclists through a separate path adjacent to the roadway. I. Review of Traffic Statistics As the primary access point to the "East End" of Fishers Island --including many residences, the golf course, and the Club House--East End Road is currently heavily used by pedestrians, joggers, bicyclists, and motor vehicles. The roadway is a private rural collector that generally has a 19 foot cross-section (9 1/2 foot travel lanes in each direction) with a posted speed limit of 30 mph. This constrained cross-section makes it very difficult for the roadway to accommodate a vehicle in each direction with an adjacent walker or bicyclist at the same time. Since June 2006, traffic statistics-for both motor vehicles and pedestrians/bicyclists-have been recorded during select months at the gate house on East End Road. The current level of pedestrian and bicycle traffic observed using East End Road during this period indicates there are operational benefits that could be gained from the construction of the recreational path. · Traffic observed at the Gatehouse April-October during 2007 and 2008 on Monday-Friday (5AM to 8PM) and Saturday-Sunday (7AM to 8PM) · Traffic (vehicular and pedestrian) peaks during summer months; the highest monthly traffic volume was observed for August 2008 (approximately 28,600 cars, 900 bicycles, and 600 pedestrians) Date: December 5, 2008 2 Project No.: 41485.00 · Between 2007 and 2008, traffic volume remained essentially static during the summer months (June, July, and August) · During the same period (June, July, and August in 2007 and 2008), pedestrian traffic- walkers, joggers, and bicyclists -increased by approximately 31 percent · During August 2008 (the month with the highest observed volume of use), pedestrian/bicycle traffic constituted approximately 5 percent of all traffic observed on the roadway These traffic statistics demonstrate that the use of East End Road travel way by pedestrians and bicyclists has been growing. The limited roadway cross-section (approximately 18 to 20 feet) requires motorists, bicyclists, and pedestrians to continually negotiate for operating space. However, relocating pedestrians and recreational users to a separate recreational path will drastically reduce potential conflicts with motor vehicles. Under the existing condition, each pedestrian and bicyclist on the road has the potential to come into conflict with each passing motor vehicle, resulting in thousands of opportunities for conflicts each month. The introduction of a recreational path will reduce potential conflict points between pedestrians/bicyclists and motor vehicles to intersections, which are more controlled situations. Providing bicycle lanes within the roadway cross section would require widening of the roadway by an additional eight to ten feet to meet current guidelines for bicycle lanes (four-foot lanes in each direction). This approach would not address pedestrian safety issues within the roadway corridor and may induce higher vehicle speeds along East End Road because of the wider roadway cross- section. This approach could also create potential confusion among various levels of bicyclists, joggers, and walkers all traveling in various directions within each established bicycle lane. Finally, a roadway widening to accommodate bicycle lanes could also have significant impacts to adjacent properties and environmentally sensitive areas. Accordingly, we do not recommend bicycle lanes as a mitigation measure to address pedestrian and other recreational user safety concerns within the roadway cross-section.
