O v THIS INDENTURE, made the 31st day of August , nineteen hundred and ninety five BETWEEN NICHOLAS KATOS, residing at 10 Homecrest Drive, Huntington Station, NY 11746 and KASSIANI KATOS, residing at 25 Bingham Circle, Manhasset, NY 11030 DISTRICT �(SECTION FTI LOT party of the first part, and � O `—''--`-''c M FTI MT61 ® FT-n( 0 12 17 21 20 KASSIANI KATOS, residing at 25 Bingham Circle, Manhasset, NY 11030 party of the second part, WrMESSEfH, that the party of the first part, in consideration of ten dollars and other valuable consideration paid by the party of the second part, does hereby grant and release unto the party of the wooed part, the heirs or successors and assigns of the party of the second part forever, ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying and being in the Village of Mattitiuck , Town of Southold, County of Suffolk and State of New York, known and designated as Lot 81 on a certain Map entitled, "Map of Captain Kidd Estates" and filed in the Office of the Clerk of the County of Suffolk on January 19, 1949, as Map Number 1672" being more particularly bounded and described as follows: BEGINNING at a point on the northwesterly side of Summit Drive, said point being distant .144.00 feet northeasterly from the end of an arc connecting the northerly side of Central Drive with the northwesterly side of Summit Drive; thence from said point of beginning and along a division line between Lots 7 and 8 on aforementioned map, North 35 degrees 39 minutes 40 seconds West, 355.34 feet to the southerly side of Sound Beach Drive; thence along Sound Beach Drive, North 57 degrees 55 minutes 20 seconds East, 366.63 feet to the northwesterly side of Summit Drive; thence southwesterly along the northwesterly side of Summit Drive and the arc of a curve bearing to the left, having a radius of 260.00 feet for a distance of 110.85 feet to the point or place of BEGINNING. BEING the same premises conveyed to the party of the first part herein by deed dated December 611984 and recorded December 12, 1984 in Liber 9693 cp. 539. THIS conveyance is made in the regular course of business actually conducted by the party of the first part. SAID premises known as and by 255 Summit Drive, Mattituck, ITY TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consid- eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
