The proposed action which has been reviewed to Chapter 268, Waterfront Consistency
Review of the Town of Southold Town Code and the Local Waterfront Revitalization
Program (LWRP) Policy Standards. Based upon the information provided on the LWRP
Consistency Assessment Form submitted to this department, as well as the records
available to me, it is my recommendation that the proposed action is CONSISTENT
from LWRP review pursuant to § 268 of the Southold Town Code.
Pursuant to Chapter 268, the Southold Town Zoning Board of Appeals shall consider this
recommendation in preparing its written determination regarding the consistency of the
proposed action.

The proposed construction, on this non-conforming 22,352 sq. ft. lot, is not permitted pursuant to
Article XXIII Section 280-122A which states:
"Nothing in this article shall be deemed to prevent the remodeling, reconstruction or enlargement of a
non-conforming building containing a conforming use, provided that such action does not create any
new non-conformance or increase the degree of non-conformance with regard to the regulations
pertaining to such buildings."
The dwell in g with additions, notes a side yard setback of 5.1'+/- on the East side and 13.7'+/- on the
West side and a total of 18.8' +/-,
Pursuant to the interpretation of Walz (5039) such addition & alteration will thus constitute an increase
in the degree of nonconformance. The construction is not permitted pursuant to Article XXIII, Section
280-124, which states that non-conforming lots, measuring 20,000 sq. ft. to 39,999 sq. fl. requires a
minimum side yard setback of 15' with a total of 35'.

a. This application MUST be completely filled in by typewriter or in ink and submitted to the Building Inspector with 4
sets of plans, accurate plot plan to scale. Fee according to schedule.
b. Plot plan showing location of lot and of buildings on premises, relationship to adjoining premises or public streets or

c. The work covered by this application may not be commenced before issuance of Building Permit.
d. Upon approval of this application, the Building Inspector will issue a Building Permit to the applicant. Such a permit

issues a Certificate of Occupancy.
f. Every building permit shall expire if the work authorized has not commenced within 12 months after the date of

Dear Mr. Stromski:
The Board of Town Trustees took the following action during its regular meeting held on
Wed., December 12, 2007 regarding the above matter:
WHEREAS, Searles, Stromski, Associates on behalf of JOAN SHANNON applied to
the Southold Town Trustees for a permit under the provisions of Chapter 275 of the
Southold Town Code, the Wetland Ordinance of the Town of Southold, application
dated November 14, 2007, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, the LWRP Coordinator issued a recommendation that the application be
found Consistent with the Local Waterfront Revitalization Program policy standards,
and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on December 12, 2007, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees have found the application to be Consistent
with the Local Waterfront Revitalization Program, and,
RESOLVED, that the Board of Trustees approve the application of JOAN SHANNON to
remove the existing roof and expand second floor within the existing footprint; construct
a new covered porch on the landward side of the existing dwelling; and install drywells
to contain a 2" rainfall for the proposed dwelling and existing detached garage, and as
depicted on the site plan prepared by Robert Stromski, last dated November 8, 2007.
Permit to construct and complete project will expire two years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.
Inspections are required at a fee of $50.00 per inspection. (See attached schedule.)

Dear Ms. Shannon:
Based on the information you have submitted, the New York State Department of Environmental
Conservation has determined that:
The portion of your property which is located landward of the twenty foot (MSL) elevation contour on
a gradual, natural slope, as shown on the survey prepared by Stanley J. Isaksen, Jr. last revised June
12, 2007, is beyond the jurisdiction of Article 25 (Tidal Wetlands).
Therefore, in accordance with the current Tidal Wetlands Land Use Regulations (6NYCRR Part 661)
no permit is required under the Tidal Wetlands Act. Please be advised, however, that no
construction, sedimentation, or disturbance of any kind may take place seaward of the tidal wetlands
jurisdictional boundary, as indicated above, without a permit. It is your responsibility to ensure that all
necessary precautions are taken to prevent any sedimentation or other alteration or disturbance to the
ground surface or vegetation within Tidal Wetlands jurisdiction which may result from your project.
Such precautions may include maintaining adequate work area between the tidal wetland jurisdictional
boundary and your project (i.e. a 15' to 20' wide construction area) or erecting a temporary fence,
barrier, or hay bale berm.
Please be further advised that this letter does not relieve you of the responsibility of obtaining any
necessary permits or approvals from other agencies.

LWRP CONSISTENCY ASSESSMENT FORM
A. INSTRUCTIONS
All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area (which includes all of Southold Town).
If any question in Section C on this fomr is answered "yes" or "no", then the proposed action will
affect the achievement of the LWRP policy standards and conditions contained in the consistency
review law. Thus~ each answer must be explained in detail~ listing both supporting and non-
supnortin~ facts. If an action cannot be certified as consistent with the LWRP policy standards and
conditions, it shall not be undertaken.
