Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is INCONSISTENT with the below listed policies and therefore is INCONSISTENT with the LWRP pursuant to § 268 of the Southold Town Code. Policy 6: Protect and restore the quality and function of the Town of Southold ecosystem. 6.3 Protect and restore tidal and freshwater wetlands. The setback from the proposed deck to the wood retaininE wall (bulkhead) is 36.7 feet; a minimum setback of 75 feet is required by Article XXIII. § 280-116. Building setback requirements adiacent to water bodies and wetlands. [Added 3-14-1989 by L.L. No. 3. 1989; amended 11-24-1992 by L.L. No. 20-1992; 6-15-1993 by L.L. No. 8-1993] "B. All buildings or structures located on lots upon which a bulkhead, concrete wall, riprap or similar structure exists and which are ad/acent to tidal water bodies other than sounds shall be set back not less than 75 feet from the bulkhead...." Due to the fact that the structure proposed is a deck that is going to be open to the sky above, there is no mass or amhitectural elements to be detrimental to the community. 2.) Due to the location in the rear yard, and the existence of a previously permitted structure there is no other alternate location for this structure. The deck proposed is the minimum we need for the homeowner to enjoy the water view on their property. We have also sited the proposed deck so that it requires only one variance. 3.) The amount of relief is minor as this is a deck application, and not a habitable structure. 4.)
