The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation that
the proposed action is INCONSISTENT with the denoted following Policy Standards and
therefore is INCONSISTENT with the LWRP.
4.1 Minimize losses of human life and structures from flooding and erosion hazards.
The following management measures to minimize losses of human life and structures
from flooding and erosion hazards are suggested:
A. Minimize potential loss and damage by locating development and structures
away from flooding and erosion hazards.
1. Avoid development other than water-dependent uses in coastal
hazard areas. Locate new development which is not water-dependent
as far away from coastal hazard areas as practical.
Avoid hazards by siting structures to maximize the distance
from Coastal Erosion Hazard Areas.
The distance from the proposed addition from the top-of-bluff is 62'.
The use is not "water dependent" and it is recommended that the
structure be relocated to maximize the distance from the "coastal
hazard area" to minimize the potential of future structural loss due
to slope failure or erosion.
Policy 6. Protect and restore the quality and function of the Town of Southold ecosystem.
6.3 Protect and restore tidal and freshwater wetlands.
The distance from the proposed addition to top-of bluff is 62'7 a minimum
setback distance of 100 feet from the bluff line is required pursuant
pursuant to Chapter § 280-116 which states:
Building setback requirements adjacen! to water bodies and wetlands'.
Notwithstanding wry o~her provisions q/'tht~' chapter, the.fi~l/owing selback
requirements sha[/ apply to all buildings located on lots afijacent lo water bodies
and wetlands:

there exists a bluff or bank &ndward qf the shore or beach shall be set back no!

Please require that the applicant amend the application to meet the above policy to the
greatest extent practical.
If the action is approved the following best management practice (BMP) are recommended:
1. Require a non-turf~ native vegetation buffer landward of the top of bluff.
2. Require gutters, leaders and dr~wells for the structures.

The construction on this non-conforming 18680 sq. ft. lot is not permitted pursuant to
Article III Section 280-124 which states:
"This section is intended to provide minimum standards for granting of a building permit
for the principal buildings on lots which are recognized by the town under 280-9 are
nonconforming & have not merged pursuant to 280-10."
The required side yard setbacks are 15' & 35' combined and a front yard setback of 35'.
The survey indicates new construction resulting in a minimum side yard setback of 6.3'
& combined side yard setback of 14.5'& front yard of 17.4'.
New foundation work is proposed.
Also, the proposed construction is not permitted pursuant to XXII Section 280-116 which
states:
"All buildings & structures located on lots adiacent to sounds.., shall be set back not
fewer than 100 feet from the top of such bluff or bank."
The survey indicates construction at approx. 90' from top of the bluff.
In addition, the proposed lot coverage on this 13,369 sq. ft. buildable area is 20.6%.
The required lot coverage is 20%.

Upon request of the office of Lefferts P. Edson, Esq.,
Main Road, Southold, New York, I made an inspection of the
buildings on this premises. I admitted myself to dwelling
with key provided by applicant and began this inspection at
approximately 11:20 A.M.
The dwelling is a one-story wood fra~ed building con-
structed on a concrete block foundation and consists of two
bedrooms, living roo~, full bathroom, and kitchen. Heat is
furnished to all rooms from a gas-fired forced warm air fur-
nace located in partial cellar. A raised deck is attached
to west side of building. A wood framed accessory building
is located in rear yard area. Electric water pump for domestic
water is looated in covered pit on east side of dwelling.
The following violations of the Housing Code, Chapter 52,
Code of the Town of Southold, New York, were found:
Entries - to kitchen and living room, no means of
contr~ling light in room at points of entries,
Article V, Section 52-56 B 2.
Lam~ cord electric outlets - kitchen and northeast
bedroom, Article V, Section 52-56 A 1.
Electric hot water heater - leg support rusted awayl
two remaining legs rusted and weakened, unable to
support unit in upright position causing stress on
plumbing connections. Unit is not in service,
Article V, Seotion 52-50 A & 52-51 A 1 & D 1.
Furnace - gas fired, not connected to suitable chimney.
Smoke pipe from furnace runs through bedroom floor and
ceiling terminating through roof with type A~smoke
pipe. Insufficient clearance from combustable materials,
Article V, Section 52-54 B.
Electrical - hook up for water pump, splice made in
cellar, wires taped and exposed without junction box.
Wire from splice to pump motor has no ground wire ~
connection, Article V, Section 52-56 A 1.

Sewage system - no house trap provided, Article V,
Section 52-51 C 1.
Cellar stairwa~ - from exterior, sides of stairwell at
top constructed of red brick masonry. Brickwork
collapsing inward on two sides causing open joints
and excessive deformation of wall, Article III, Section
52-30 A, B & 52-31 A.
Accessory structure and deck added since 1971 are in
violation of the Zoning Ordinance, Chapter 100, Section
100-141 in that this construction was done without a
buildin~ permit as required by statute, Code of the Town
of Southold, New York.
Inspection completed at approximately 11:50 A.M. Key
was returned to office of Building Department ~or return to
applicant.

LWRP CONSISTENCY ASSESSMENT FORM

Ali applicants for perm/ts* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consisteucy Review Law. Tiffs
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits.

Before answering the questions in Section C~ the preparer of this form should review the exempt
minor action list, policies and e?cplanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its significant '
beneficial and adverse effects upon the coastal area (wkich includes all of Southold Town).
If any question in Section C on this form is answered "yes", then the proposed action may affect the
achievement of the LWRP policy standards and conditions contained in the consistency review law.
Thus, the action should be analyzed in more detail and, if necessary, modified prior to making a
determination that it is consistent to the maximum extent practicable with the LWRP policy
standards and conditions. If an action cannot be certified as consistent with the LWRP policy
standards and conditions, it shall not be undertaken.
