No. 6157 (Scourakis) ~/ The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is INCONSISTENT with the denoted following Policy Standards and therefore is INCONSISTENT with the LWRP. 4.1 Minimize losses of human life and structures from flooding and erosion hazards. The following management measures to minimize losses of human life and structures from flooding and erosion hazards are suggested: A. Minimize potential loss and damage by locating development and structures away from flooding and erosion hazards. 1. Avoid development other than water-dependent uses in coastal hazard areas. Locate new development which is not water-dependent as far away from coastal hazard areas as practical. Avoid hazards by siting structures to maximize the distance from Coastal Erosion Hazard Areas. The distance from the proposed addition from the top-of-bluff is 62'. The use is not "water dependent" and it is recommended that the structure be relocated to maximize the distance from the "coastal hazard area" to minimize the potential of future structural loss due to slope failure or erosion. Policy 6. Protect and restore the quality and function of the Town of Southold ecosystem. 6.3 Protect and restore tidal and freshwater wetlands. The distance from the proposed addition to top-of bluff is 62'7 a minimum setback distance of 100 feet from the bluff line is required pursuant pursuant to Chapter § 280-116 which states: Building setback requirements adjacen! to water bodies and wetlands'. Notwithstanding wry o~her provisions q/'tht~' chapter, the.fi~l/owing selback requirements sha[/ apply to all buildings located on lots afijacent lo water bodies and wetlands: A.Lots adjacent lo ~pn~g [y[~;!tf[~$f~und, Fishers Is/ami Sound and Block Island Sound. (1) All buildings or s,~uctures located on lots afijacent to sounds and upon which there exists a bluff or bank &ndward qf the shore or beach shall be set back no! fewer than l OO feet./hom the top qf such bhqff . Please require that the applicant amend the application to meet the above policy to the greatest extent practical. If the action is approved the following best management practice (BMP) are recommended: 1. Require a non-turf~ native vegetation buffer landward of the top of bluff. 2. Require gutters, leaders and dr~wells for the structures. Pursum~l to Chapter 268, tile Zoning Board ot Appeals shall consider this recommendation in preparing its written determination regarding the consistency of lhe proposed ac t ~on.
