The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold
Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information
provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to
us, it is our recommendation that the proposed action is INCONSISTENT with LWRP policy standards and
therefore is INCONSISTENT with the LWRP.
5.4 Limit the potential for adverse impacts of watershed development on water quality and quantity.
A. Protect water quality by ensuring that proposed expansion or intensification of existing watershed development
results in:
2. maintenance of natural characteristics of drainage systems, and
Policy 6 Protect and restore the quality and function of the Town of Southold ecosystem.
6.3 Protect and restore tidal and freshwater wetlands.
A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations
for all Andros Patent and other lands under their jurisdiction
1. Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions.
D. Provide adequate buffers between wetlands and adjacent or nearby uses and activities in order to ensure
protection of the wetland's character, quality, values, and functions. The adequacy of the buffer depends on the
following factors:
4. Buffer width necessary to achieve a high particulate filtration efficiency of surface runoff as determined by
vegetative cover type, soil characteristics, and slope of land.
E. Maintain buffers to ensure that adverse effects of adjacent or nearby development are avoided:
1. Maintain buffers to achieve a high filtration efficiency of surface runoff
2. Avoid permanent or unnecessary disturbance within buffer areas.
3. Maintain existing indigenous vegetation within buffer areas.
§ 275-3 Findings; purpose; jurisdiction; setbacks.
D. Setbacks.
(1) The following minimum setbacks apply to any and all operations proposed on residential property within the
jurisdiction of the Board of Trustees:
(a) Wetland boundary.

§ 275-11 Construction and operation standards.
A. General. The following standards are required for all operations within the jurisdiction of the Trustees:
(1) Drainage upgrade. Applicants for a permit for any form of construction may be required to upgrade the site's
drainage system such that all surface water generated from impervious surfaces shall be kept onsite through
infiltration or retention. Applicants proposing grading or filling operations will be required to submit a drainage plan
for the entire site at the discretion of the Trustees. See § 275-6A (14) for requirements.
(14) Drainage upgrade. At the discretion of the Board, non administrative applications may require submittal of a
drainage upgrade plan. This plan must indicate how all existing and proposed on-site drainage from a two-inch rainfall
is retained within the subject parcel landward of the wetland boundary. Retention can include but is not limited to
infiltration or impoundment. All drainage plans shall show the calculations used to develop the plan. At the discretion
of the Board said plans may require certification from a licensed engineer.
§ 236-13. Performance standards for approval of erosion, sedimentation and stormwater runoff control plans.
A. The site erosion, sedimentation and stormwater runoff control measures shall be appropriate for existing
topography, vegetation and other salient natural features of the site. The plan shall indicate that the development will
preserve natural features, minimize grading and cut and fill operations, ensure conformity with natural topography,
and retain natural vegetation and trees to the maximum extent practicable in order to create the least erosion potential
and handle adequately the volume and rate or velocity, of surface water rtmoff.
B. Site grading, excavation and filling shall minimize destruction of natural vegetation, the potential for
erosion, sedimentation and stormwater runoff and the threat to the health, safety and welfare of neighboring
property owners and the general public.
M. Stormwater runoff shall not be directly discharged to surface waters, marshes and wetlands. Stormwater
pollutants shall not be discharged directly into a wetland, but shall be attenuated by using holding ponds,
sedimentation basins, perimeter berming, vegetated buffer areas and other measures that reduce flow velocity and
increase storage time. Pollutants shall not be discharged into wetlands. In addition, any filtering devices constructed
as part of the drainage system must be adequately maintained in order to function properly.
R. Fill shall not encroach on natural watercourses, constructed channels, wetlands, or floodway areas. All
fill shall be compacted at a final angle of repose which provides stability for the material, minimizes erosion and
prevents settlement.
U. Natural floodplains and major drainage swales shall not be altered or disturbed in a manner which
decreases their ability to accommodate and channel stormwater runoff and floodwaters. If no practicable
alternative to thc location of development, roadway, driveways, and similar surfaces within these areas exists, such
facilities shall be sited and constructed to minimize and mitigate the amount and velocity of stormwater entering the
channel, floodplain or swale and to approximate the original functions of the undisturbed condition.
V. No land having a slope equal to or greater than 20% shall be developed or disturbed except for
conservation measures or measures intended to remove debris which inhibits thc functioning of the swale, except
accessways to shorelines approved by the Board of Trustees shall be permitted. Natural vegetation and topography
shall be retained to stabilize soils and reduce the volume of stormwater overflow.
§ 236-4. Definitions.
NATURAL WATERCOURSE -- The route farmed by natural processes, topography and geology leading to a natural
watershed.
NATURAL WATERSHED -- An area of land which, in its natural state and prior to any man-made change, and due
to its topography and geology, drains to a particular location within that area.

As per your request of January 16, 2008 I have reviewed the above referenced
application and site.
The site contains stormwater infrastructure, with a street drain on N.Y.S. Route
25 attached to a concrete pipe, rocks, and a swale running north to south on the
property from the road towards Marion Lake. See attached photos.
The survey submitted to the Trustee Office on December 17, 2007 was surveyed
by Nathan Taft Corwin III and last dated September 17, 2007. This survey does
not show a correct wetland line in the swale area as described above. During a
field visit of January 11,2008 I found indications of wetlands in this area.
Indicators include the many mature Red maple (Acer rubrum) trees throughout
the swale, and wetland soil types.
In order to fully evaluate the swale part of the property for a more accurate
wetland line a complete evaluation will be needed in the spring. A complete
species list and soil indicators can be completed at that time.

LWRP CONSISTENCY ASSESSMENT FORM
INSTRUCTIONS
All applicants for permits* including Town of Southold agencies, shall
complete this CCAF for proposed actions that are subject to the Town of
Southold Waterfront Consistency Review Law. This assessment is intended
to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions
including Building Permits and other ministerial permits not located within
the Coastal Erosion Hazard Area.
Before answering the questions in Section C, the preparer of this form
should review the exempt minor action list, policies and explanations of
each policy contained in the Town of Southold Local Waterfront
Revitalization Program. A proposed action will be evaluated as to its
significant beneficial and adverse effects upon the coastal area (which
includes all of Southold Town).
If any question in Section C on this form is answered "yes", then the
proposed action may affect the achievement of the LWRP policy standards
and conditions contained in the consistency review law. Thus, the action
should be analyzed in more detail and, if necessary, modified prior to
making a determination that it is consistent to the maximum extent
practicable with the LWRP policy standards and conditions. If an action
cannot be certified as consistent with the LWRP policy standards and
conditions, it shall not be undertaken.
