Hilary, LWRP Coordinator Date: December 11, 2008 Re: Chapter 268, WATERFRONT CONSISTENCY REVIEW Wetland Permit for MILDRED DICARLO SCTM#63-7-32 Catherine Mesiano, Inc. on behalf of MILDRED DICARLO requests a Wetland Permit to replace the existing dock with a low-profile 4'X 64' fixed dock on 16 8" dia. piles 12' on center, 3'X 15' metal ramp and a 6'X 20' floating dock affixed to 2-10" dia. piles, and in-place replacement of 125' of bulkhead and 37' return landward of high-water. Located: 1035 Calves Neck Rd., Southold. SCTM#63-7-32 THE FOLLOWING SECTION ADRESSES THE PROPOSED IN-PLACE BULKHEAD RFPLACMENT: The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to us, it is our recommendation that the proposed action is INCONSISTENT with LWRP policy standards and therefore is INCONSISTENT with the LWRP. Policy 6. Protect and restore the quality and function of the Town of Southold ecosystem. 6.3 Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction 1. Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions. The existing bulkhead is a preexisting non-permitted and/or nonconforming structure and therefore it cannot be replaced in kind without full review and approval by the Trustees pursuant to § 275-11 B (1) {h). Further~ new bulkheads in creeks and bays are prohibited~ unless the bulkhead is a Iow-sill. § 275-11 Construction and operation standards. B. Shoreline structures. The following standards are required for all operations relating to shoreline structures on residential properties. Operations conducted on properties zoned M1 or M2 may be given greater flexibility in these requirements given the water-dependent nature of their use. (1) Bulkheads, retaining walls, revetments and gabions. (h) New bulkheads in creeks and bays are prohibited, unless the operation involves construction of a low-sill bulkhead. THE FOLLOWING SECTION ADDRESSES THE PROPOSED DOCK STRUCTURE: The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to us, it is our recommendation that the proposed action is INCONSISTENT with LWRP policy standards and therefore is INCONSISTENT with the LWRP. 9.4 Assure public access to public trust lands and navigable waters. A. Provide free and substantially unobstructed passage along public trust shorelands. B. Ensure that interference with passage along the shoreline is limited to the minimum extent necessary to gain access from the upland to the water. C. Where public access is substantially impeded, provide passage around interferences on public trust lands through adjacent upland easements or provide other mitigation. D. Require that all publicly owned land allow for perpendicular access to trust lands whenever compatible with the principal use of the public land. E. Provide access to, and reasonable recreational use of, navigable waters and public trust lands under water. 1. Provide for free and unobstructed public use of all navigable waters below the line of mean high water for navigation, recreation, and other public trust purposes, including the incidental rights of public anchoring. 2. Permit limited obstruction of public use, including navigation, in navigable waters: 4. Structures extending beyond the minimum necessary for access to navigable waters impair public trust interests and open space values associated with the water's surface. Allow such structures only in the following circumstances: c. when the principal purpose of the structure is necessary: (i) to provide public access for recreational uses The proposed action (docking structure) extends beyond the minimum necessary for access to navigable waters, impairing the public trust interests. The proposed docking structure is private, noncommercial and will not support a pattern of development that enhances community character nor provide "Public" access for recreational activities. The applicant must prove that the following docks standards have been met pursuant to .~ 275-11 (specifically dock standards llh [2h and I3| as outlined below. § 275-11 Construction and operation standards. [1] No dock shall be erected or extended if, in the opinion of the Trustees, such structure wouM adversely affect navigation, fisheries, shell fisheries, scenic quality, habitats or wetland areas. [2J Whether the dock will unduly interfere with the public use of waterways for swimming, boating, fishing, shellfishing, waterslding and other water-dependant activities; [3] Whether the dock will unduly interfere with transit by the public along the public beaches or foreshore; [4] Whether the dock will significantly impair the use or value of waterfront property adjacent to or near the dock; [5] Whether the dock will cause degradation of surface water quality and natural resources'; [6J Whether the dock will cause habitat fragmentation and loss of significant coastal fish and wildlife habitats; [7] ~hether the dock will result in the destruction of or prevent the growth of vegetated wetlands, seagrasses including eelgrass (Zostera marina) and widgeon grass (Ruppia maritima) or shellfish; [8] Whether the dock will unduly restrict tidal flow or water circulation; [9] Whether the dock will be safe when constructe& [10] Whether the d~ck wil~ adverse~y a~ect views~ viewsheds and vistas imp~rtant t~ the c~mmunity; [11J Whether the cumulative impacts' ora residential and commercial dock will change the waterway or the environment and whether alternate design, construction, and location of the dock will minimize cumulative impacts; and [12J Whether adequate facilities are available to boat owners and/or operators for fueling, discharge of waste and rubbish, electrical service and water service. If the Agency~ (Board of Trustees) makes a contrary determination of consistency~ the Agency shall elaborate in writing the basis for its disagreement with their recommendations Pursuant to Chapter 268 Waterfront Consistency Review. § 268-5. Review of actions. H. In the event the LWRP Coordinator's recommendation is that the action is inconsistent with the LWRP, and the agency makes a contrary determination of consistency, the agency shall elaborate in writing the basis for its disagreement with the recommendation and state the manner and extent to which the action is consistent with the L WRP policy standards. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. IUDITII 1.
