Wetland Permit for KIMOGENOR POINT CO.

KIMOGENOR POINT CO. requests a Wetland Permit to construct approx. 343 linear ft. of vinyl bulkhead in place of
and up to 8" higher than existing timber bulkhead (to el. 4.7' ALW); construct +/-25' vinyl tatum on landward side of
existing northerly return to be removed; replace existing wood fence; remove existing return landward of existing dock to
be temporarily detached during construction; re-sheath approx. 655 linear ft. of existing bulkhead below the lower wale
on its seaward side with plastic sheathing; and backfill with approx. 200 cy. clean sand to be trucked in from an upland
source. Located: 50 Jackson St., Cutchogue. SCTM#116-6-24.1
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town
Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided
on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to us, it is our
recommendation that the proposed action is EXEMPT pursuant to § 268-3; provided that a silt boom is installed
prior to the replacement of the bulkhead that will retain all suspended sediments within the immediate project
area pursuant to § 268-3 GG.
MINOR ACTIONS -- Include the following actions, which are not subject to review under this chapter:

Attached please find an LWRP Consistency Assessment Form, which is being submitted in
association with an application to the Board of Trustees for a Town Wetlands Permit to repair or
replace (in-place) existing bulkheading.
I have indicated that all policies are "Not Applicable" because pursuant to Town Code §268-5
("Review of Actions") and the corresponding definitions of "action" and "minor action" by
§286-3 ("Definitions"), the proposed bulkhead repair and in-place bulkhead replacement meet
the following definitions of minor actions, respectively, and are thus not subject to waterfxont
consistency review pursuant to Chapter 268:
1. "A. Maintenanco or repair involving no substantial changes in an existing structure or
facility;"
2. "GG. Bulkhead to replace existing bulkhead on the applicant's property in the same
location with a silt curtain employed during construction."

2. Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area (which includes all of Southold Town).
If any question in Section C on this form is answered "yes" or "no", then the proposed action will
affect the achievement of the LWRP policy standards and conditions contained in the consistency
review law. Thus., each answer must be explained in detail., listing both supporting and non-
suooortinu facts. If an action cannot be certified as consistent with the LWRP policy standards and
conditions, it shall not be undertaken.
